HomeMy WebLinkAbout830584.tiff RESOLUTION RE ; APPROVAL OF USE BY SPECIAL REVIEW FOR A NATURAL GAS PRO- CESSING PLANT - COLORADO GATHERING AND PROCESSING COMPANY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 13th day of July, 1983, at the hour of 2 : 00 o ' clock p.m. in the Chambers of the Board for the purpose of hearing the application of Colorado Gathering and Processing Company, P.O. Box 1022 , Boulder, Colorado 80306, for a Use by Special Review for a natural gas processing plant, on the following described real estate, to-wit: Part of the Eh, Section 28 , Township 6 North, Range 65 West of the 6th P.M. , Weld County, Colorado. WHEREAS, Section 24. 4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Plan- ning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, finds that: 1. The submitted materials are in compliance with the application requirements of Section 24. 7 of the Weld County Zoning Ordinance; 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 . 4 . 2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the Comprehensive Plan policies in that the use does not infringe on continued agricultural use in the vicinity or the County. The proposal does not appear to have any adverse impacts on the agricultural interests of the County or the environments. b. The proposal is consistent with the intent of the Agricultural Zone District; and is provided for as a Use by Special Review. c. No overlay districts affect the subject site. d. It is the opinion of the Board of County Com- missioners that the attached Operation Standards will minimize impacts on surrounding uses and the area to the greatest extent possible and provide adequate protection of the health, safety, and welfare of the inhabitants of the area and the County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners that the application for a Use by Special Review for a natural gas processing plant on the hereinabove described par- cel of land be, and hereby is, granted subject to the following conditions: 1. The attached Standards for Use by Special Review be adopted. 2 . The plat for the Use Permit be placed on records by the Department of Planning Service' s staff prior to any building permits being issued on the site. The permitted use on the hereon described parcel of land shall be a natural gas processing plant. 2. The major facilities shall be one (1) office, one (1) warehouse, one (1) mobile home, one (1) compressor building, two (2) natural gas storage tanks, and one (1) two-hundred-ten (210) barrel oil tank, a chain link fence, a minimum of six (6) feet in height shall enclose the Use by Special Review area and additional equipment as listed and identified on the plat submitted for record. 3. All accesses shall have the approval of the Weld County Engineering Department. All accesses shall be constructed in accordance with the recoumuendations and/or requirements of the Weld County Engineer- ing Department. 4. A reservation of an additional twenty (20) feet of right-of-way west of the centerline on Weld County Road 64 shall be identified on the recorded plat. 5. The gas storage tanks shall be setback a minimum of fifty (50) feet from property lines. The fifty (50) foot setback shall be identified on the plat. The oil tank shall be setback forty (40) feet and identified on the plat. 6. Design and construction of the facility shall be in accordance with the submitted application materials, recorded plat and Weld County Building Code Regulations. 7. The appearance of the facility shall be maintained in a neat and orderly condition through periodic painting and maintenance. 8. The Special Use Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust, and the growth of noxious weeds. 9. All phases of the operation shall comply with all County and State Health Standards and Regulations pertaining to air quality, water quality, noise emission, and sanitary disposal systems. 10. The Special Use Permit shall be limited to the plans shown hereon and governed by the Operation Standards stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Development Standards, as shown or stated above, shall require the approval of an amendment of the Special Use Permit by the Planning Commission and the Board of County Commis- sioners before such changes from the plans and/or Operation Standards shall be permitted. Any other changes from the plans and/or Operation Standards shall be filed in the office of the Department of Planning Services. 11. The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Operation Standards. Noncompliance with any of the above stated Operation Standards may be reason for revocation of the Special Use Permit by the Board of County Commissioners. The Department of Planning Services staff recommendation is conditional and based upon the following: 1. The attached Standards for Use by special Review be adopted; 2. The plat for the use permit be placed of record by the Depart- ment of Planning Services staff prior to any building permits being issued on the site. The major facilities shall be one (1) office, one (1) warehouse, one (1) mobile home, one (1) compressor building, two (2) natural gas storage tanks, and one (1.) two-hundred-ten (210) barrel oil tank, and additional equipment as listed and identified on the plat submitted for record. 3. All accesses shall have the approval of the Weld County Engineering Department. All accesses shall be constructed in accordance with the recommendations and/or requirements of the Weld County Engineer- ing Department. 4. A reservation of an additional twenty (20) feet of right-of-way west of the centerline on Weld County Road 64 shall be identified on the recorded plat. 5. All oil and gas storage tanks shall be setback a minimum of fifty (50) feet from property lines. The fifty (50) foot setback shall be identified on the plat. 6. Design and construction of the facility shall be in accordance with the submitted application materials, recorded plat and Weld County Building Code Regulations. 7. The appearance of the facility shall be maintained in a neat and orderly condition through periodic painting and maintenance. 8. The Special Use Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust, and the growth of noxious weeds. 9. All phases of the operation shall comply with all County and State Health Standards and Regulations pertaining to air quality, water quality, noise emission, and sanitary disposal systems. 10. The Special Use Permit shall be limited to the plans shown hereon and governed by the Operation Standards stated above and all applicable Weld County Regulations. It will basically be operated 24 hours per day with one to two people at the plant during normal work hours . It will be main- tained by a crew working out of the office at the plant site to operate and maintain the gas collection and transmission system which sends raw natural gas to the plant. The proposed structures will be constructed of steel frame with siding. All tanks will be constructed of steel, and liquid tanks will be bermed around the exterior high enough to contain the total volume of liquid that might be spilled should the tank rupture. All roads within the plant site will be graveled and natural drainage will be controlled so that it does not exceed the normal runoff from the site prior to construction of the facilities . The domestic sewage system at the site will be a septic system sized to accommodate the eauivalent of a single-family residence. A Permit for this installation will be obtained from the Weld County Health Department in accordance with the standard requirements . A letter is provided showing that the North Weld County Water District will provide domestic water service to the plant. The vehicular traffic to the site will consist of pipeline service vehicles which will be one or two pickups in and out of the site three to four times per day. At the beginning of processing there will be one to threesemi trucks per day hauling product from the site and in two to chree years when the plant is operating at maximum capacity, there will be one to five semi trucks hauling product from the site. It is not the intent of Colorado Gathering and Processing Company to store or stockpile any quantity of materials or waste at the site. There is no waste associated with the processing plant and the only materials that would be stored would be a few valves ; a small amount of pipe materials for maintenance and repair of the pipeline system. The operator intends to construct the plant in sixty (60) days and have it in operation in late June of 1983. No specific land- scaping plan is proposed with this site. The reclamation procedure that would be completed when the plant is no longer needed for use • would be to sell all major equipment and move it from the site. Only a minor amount of piping and unsalvagable material would remain. All facilities will be constructed in accordance with the oil insurance association guidelines . The fire protection measures necessary for a processing plant of this type consist primarily of continual attention to safety pro- cedures by the employees. Fire extinguishers will be available at the facilities and in all vehicles , however, if a major fire occurred even the local fire departments would not be able to control such a fire. It would be necessary to shut down the gas pipeline system and let the fire burn itself out . All facilities subject to burning are set back one-quarter mile from the County Road to provide extra protection to the roadway. We have included a copy of the Soils and Geological Study for the plant, for your information. We have also included a cony of the Purchase Agreement and Title Insurance. C Colorado Gathering and Processing Company is requesting approval to construct a natural gas processing plant on the subject property which is presently zoned Agricultural , under the County regulations for Use by Special Review. This use is consistent with the Weld County Comprehensive Plan and similar plants have been constructed in Agricultural zones throughout the County. The use requested is compatible with surrounding land in that it is adjacent to an abandoned railroad right-of-way and about one-half mile from any residence. It is also compatible in that numerous wells have been drilled throughout the area and production cannot commence on these wells without the processing plant. Future development in the area is anticipated to be additional Agricultural uses with continued development of the oil and gas available in rural Weld County. This future development is compatible with the use intended and in fact is necessary in the case of oil and gas development. This application complies with the Weld County Zoning Ordinance, Section 50, Overlay District Regulations , in that no overlay districts exist at the proposed gas processing plant site. The applicant has negotiated with numerous property owners in the area to establish the best possible location for minimum interfer- ence with the agricultural land and has located the site in accord- ance with these property owners desires .
