RE: APPROVE AMENDMENT TO AGREEMENT AND AUTHORIZE CHAIR TO SIGN -
WELD COUNTY HUMANE SOCIETY, DBA NORTHERN COLORADO ANIMAL
LEAGUE, INC.
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution #760368, dated May 12, 1976, the Board of County
Commissioners entered into an agreement with the Humane Society of Weld County, Inc., for
the purpose of establishing a countywide animal shelter, and
WHEREAS, the Board has been presented with an Amendment to said Agreement
between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, and Weld County Humane Society, dba Northern Colorado
Animal League, Inc., with terms and conditions being as stated in said amendment, and
WHEREAS, after review, the Board deems it advisable to approve said amendment, a
copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Amendment to Agreement between the County of Weld, State
of Colorado, by and through the Board of County Commissioners of Weld County, and the
Weld County Humane Society, dba Northern Colorado Animal League, Inc., be, and hereby is,
approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said amendment.

AMENDMENT TO AGREEMENT
THIS AMENDMENT TO AGREEMENT is made and entered into this 26th day of
April ,2000,by and between the WELD COUNTY HUMANE SOCIETY, d/b/a,NORTHERN
COLORADO ANIMAL LEAGUE,INC.,a Colorado non-profit corporation,w lose address is 1620
42n° Street, Evans, CO 80620, hereinafter referred to as "League," and the COUNTY OF WEED,
a political subdivision of the STATE OF COLORADO, by and through the Board of County
Commissioners of the County of Weld, whose address is 915 10th Street, Greeley, CO 80631,
hereinafter referred to as "County."
WITNESSETH:
WHEREAS,the parties hereto entered into an Agreement dated May 12, 1976,approved by
Resolution of the Board of County Commissioners, copies of which are attached hereto as Exhibit
"1," and
WHEREAS, pursuant to the terms of said Agreement, property owned by County was
transferred to League by Warranty Deed dated May 12, 1976, a copy of which is attached hereto as
Exhibit "2," and
WHEREAS, Section 4 of said Agreement states that if, " . . . at any time said property shall
not be used for animal shelter purposes, that title to said property shall revert to the County of
Weld," and
WHEREAS,the parties now desire to modify said Section 4 to eliminate any such reversion
requirement so that title shall be free and clear in League.
NOW, THEREFORE, in consideration of the mutual covenants and Promises contained
herein and in the original Agreement between the parties which is attached hereto as Exhibit 1, the
parties agree to amend said Agreement to eliminate Section 4, thereby eliminating any reversion
requirements on the transfer of the property described in the Warranty Deed attached hereto as
Exhibit 2. All other provisions set forth in the original Agreement shall remaia the same.
FURTHERMORE, the parties agree that County shall execute a Quit Claim Deed
transferring to League the property described in the original Warranty Deed which is attached hereto
as Exhibit 2.
FURTHERMORE, the parties agree that this Amendment to Agreement shall be recorded
in the Office of the Weld County Clerk and Recorder.
