RESOLUTION RE: ACTION OF THE BOARD CONCERNING REVIEW OF CONDITION OF APPROVAL #2.B FOR AMENDED RECORDED EXEMPTION #343 -WAYNE AND LUANNA IACOVETTO, C/O WAYNE HOWARD WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on December 10, 1999, the Department of Planning Services approved Amended Recorded Exemption #343, for property which is described as Lots A and B of Recorded Exemption #343; being part of the NW1/4 of Section 3, Township 6 North, Range 65 West of the 6th P.M., Weld County, Colorado, for a lot line adjustment, with Conditions of Approval, and WHEREAS, the request to the Board of County Commissioners for review of Condition of Approval #2.6 for Amended Recorded Exemption #343 was submitted by Wayne and Luanna lacovetto, do Wayne Howard, 907 30th Avenue, Suite 105, Greeley, Colorado 80634- 5100, and WHEREAS, on April 12, 2000, the Board of County Commissioners reviewed Department of Planning Services staff concerns and heard the testimony presented, and WHEREAS, pursuant to the Weld County Home Rule Charter, Article 3, Section 3-13, the concurrence of three of the members of the Board is required to approve a Resolution, and WHEREAS, the motion to delete Condition of Approval #2.6 for Amended Recorded Exemption #343 received only one vote and therefore failed; and the effect of the failure to obtain a majority vote is a denial of the motion. Approved with Conditions The Department of Planning Services has determined through the review, that the standards of Section 11.4.2.1 through 11.4.2.6 of the Weld County Subdivision Ordinance have been met. This Recorded Exemption is approved with the following conditions in accordance with information submitted in the application and the policies of the County. 1. A Weld County septic permit is required for any proposed home. The septic system shall be installed according to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations. 2. Prior to recording the plat: A. The applicant shall provide the Department of Planning Services with a certificate from the County Treasurer showing no delinquent taxes for the original parcel (mother parcel) area. B. Due to the prime agricultural soils on Lot B, the applicant shall submit a proposed building envelope to the Department of Planning Services for review. In accordance with Weld County Public Works Ordinance #180, Lot A shall be granted one residential/agricultural access. Lot B shall utilize the existing residential/agricultural access point. No circle drives or additional accesses shall be granted. The access will be placed in such a location to have adequate sight distance in both directions and not below the crest of a hill or where physical obstructions are present. These roads will be graded and drained to provide all weather access. D. All approved accesses shall be clearly shown on the plat. The applicant shall contact the Weld County Public Works Department to determine if a culvert is necessary at any approved access point. If a drainage culvert is required, a 15-inch CMP is the County minimum size. If the applicant chooses to place a larger culvert, please contact the Public Works Department to adequately size the culvert. E. This road is maintained by Weld County. F. Pursuant to the definition of SETBACK in the Weld County Zoning Ordinance(Ordinance 89, as amended), the required setback is measured from the future right-of-way line. 2) Any future structures or uses on site must obtain the appropriate zoning and building permits. 3) Prior to the release of building permits the applicant shall submit evidence to the Department of Planning Services that the lot has an adequate water supply of sufficient quality, quantity and dependability. 4) RIGHT TO FARM COVENANT Weld County is one of the most productive agricultural counties in the United States. The rural areas of Weld County may be open and spacious, but they are intensively used for agriculture. Persons moving into a rural area must recognize there are drawbacks, including conflicts with longstanding agricultural practices and a lower level of services than in town. Agricultural users of the land should not be expected to change their long-established agricultural practices to accommodate the intrusions of urban users into a rural area. Well run agricultural activities will generate off-site impacts, including noise from tractors and equipment; dust from animal pens, field work, harvest, and gravel roads; odor from animal confinement, silage, and manure; smoke from ditch burning; flies and mosquitoes; the use of pesticides and fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs cannot simply be moved out of the way of residential development without threatening the efficient delivery of irrigation to fields which is essential to farm production. Weld County covers a land area of over 4,000 square miles in size (twice the State of Delaware) with more than 3,700 miles of state and county roads outside of municipalities. The sheer magnitude of the area to be served stretches available resources. Law enforcement is based on responses to complaints more than on patrols of the county and the distances which must be traveled may delay all emergency responses, including law enforcement, ambulance, and fire. Fire protection is usually provided by volunteers who must leave their jobs and families to respond to emergencies. County gravel roads, no matter how often they are bladed,will not provide the same kind of surface expected from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may not be cleared for several days after a major snowstorm. Snow removal for roads within subdivisions are of the lowest priority for public works or may be the private responsibility of the homeowners. Services in rural areas, in many cases, will not be equivalent to municipal services. Children are exposed to different hazards in the county than in an urban or suburban setting. Farm equipment and oil field equipment, ponds and irrigation ditches, electrical power for pumps and center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs, and livestock present real threats to children. Controlling children's activities is important, not only for their safety, but also for the protection of the farmer's livelihood. 5) Prior to the release of building permits on Lot A or B, the applicant will be required to submit a recorded deed describing the lot upon which the building permit is requested with the building permit application. The legal description on such deed shall include the lot and recorded exemption number. 6) Should noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Ordinance 169A. 3. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty (60) days from the date of approval by the Department of Planning Services. The applicant shall be responsible for paying the recording fees. 4. Condition of Approval 2B. required the applicant to propose a building envelope on Lot B to the Department of Planning Services for approval. In the applicant's submission materials, via a survey plat by Alles and Associates, Inc., the Building Envelope was designated in the northwest corner of the property outside of the center pivot and immediately adjacent to the intersection of WCR 43 and WCR 74. This was the location approved by staff. Planning staff determined that a building envelope was appropriate for this Amended Recorded Exemption as Lot B has a center irrigation pivot and the land is considered "Prime" per the USDA Soils Conservation Service Map. This Amended Recorded Exemption was conditionally approved by Planning Staff on December 10, 1999. Today Mr. locovetta and Planning Staff are asking the Board to consider Condition of Approval 2B. Survey Map The proposed amended recorded exemption is located on 157.81 acres. Lot B is approximately 153 acres without existing improvements. Lot A is approximately 4.81 acres, containing a landscape yard and private residence, stables and corrals. The parcel is approximately two miles east of Eaton, and at the intersection of WCR 74 and' 43 which has a four-way stop. Proposed Lot B is irrigated farm ground, designated "Prime" by the United States Department of Agriculture. The parcel slopes east to west. A center pivot provides irrigation to the property. Section 1 .3.1 of the Weld County Subdivision Ordinance proposes to assist orderly and integrated development. Section 1.3.10 proposes to preserve agricultural land and to promote its most productive agrarian use. Section 11.4.3 of this Ordinance allows Weld County Planning Staff to condition Recorded exemptions with Building Envelopes to carry out the intent of Section 1.3. The Weld County Planning Staff recommends denial of this request to remove Condition of approval 2B. Planning Staff consistently asks for building envelopes on parcels of this size located on Prime farmground. Staff is proposing a moderately sized building envelope of no more than 5 acres to preserve the prime farm ground. The larger parcel will remain irrigated land and will also be large enough to apply for either a domestic well or water tap if necessary. b) Irrigation Water: The larger parcel will remain sprinkler irrigated farm land utilizing the existing water rights from existing irrigation wells. The smaller parcel will remain irrigated utilizing the existing irrigation well that it has lease rights to. 2) The smaller parcel currently has an existing residence and an approved septic system. The larger parcel has no improvements or residence and therefore no existing septic system. It is large enough though to adequately support a septic system as required by the Weld County Health Department. 3) The larger parcel is currently being operated as a sprinkler irrigated farm. It consists of approximately 125 acres of prime sprinkler irrigated farmland and 25 acres of non-prime farmland corners. The smaller parcel consists of a rural residential property on approximately 5 acres of non-prime farmland defined by the Weld County Comprehensive Plan. 4) The reason for the proposed recorded exemption is simply to readjust the property boundary between the two lots. When the two current owners purchased the respective parcels, they both discovered that the previous owner had misrepresented the property boundaries. Instead of filing a law suit, they both decided to work together and readjust the property lines. The process has been put off until now. 5) The subject parcels are located north east of Greeley on the east side of Weld County Rd 43 approximately 'A to YZ mile south of WCR 74. The smaller parcel will be approximately 5.0 acres, while the larger parcel will be approximately 150 acres. The area in which the new parcels will be created consists of predominately irrigated farms from 80-160 acres with some scattered small rural residential 5-10 acre tracts. 6) There are no unique physical characteristics on the site that need to be addressed. 7) There are no existing improvements located on the larger parcel, allowing all future building to meet all required setbacks. Any future improvements would be required to meet any setback requirements at the time building permits are applied for. 8) The owner's do not wish to pursue a conservation easement at this time. 9) A building envelope is advised not be established for the larger parcel at this time since there are three potential building sites that would not interfer with the agricultural production of prime farmland. No prime agricultural land will be taken out of production. 10) The proposed partitioning of this property is consistent with the Weld County Comprehensive plan and will not detract from any long-range goals or any other intergovernmental agreements. 11) The proposed uses of all parcels will be compatible with existing surrounding land uses and will not change from their current use. The proposed smaller parcel will utilize the highest and best use of the non-farmed sprinkler corner. The larger parcel will continue to be used as sprinkler irrigated agricultural farmland. 12) The proposed partitioning of the property is consistent with the intent of the agricultural district as expressed in the amended Weld County Zoning Ordinance, and the Weld County Comprehensive Plan. There is presently 60 feet of right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning Ordinance (Ordinance 89, as amended), the required setback is measured from the future right-of-way line. WCR 74 is designated on the Weld County Transportation Plan Map as an arterial status road which requires 100 feet of right-of-way at full build out. There is presently 60 feet of right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning Ordinance (Ordinance 89, as amended), the required setback is measured from the future right-of-way line. REQUIREMENTS: The applicant shall utilize the existing access to this parcel as no additional accesses shall be granted.
