This site plan review is continued until further information is provided:
1. Prior to recording the Site Plan Review plat, the applicant shall address the following to the
Department of Planning Services' satisfaction:
a. The plat shall be amended to delineate the following:
1. All parking stalls shall adhere to Section 41.1.2.1 of the Weld County Zoning
Ordinance. Specifically, parking stalls shall be nine feet wide and nineteen feet in
length. Handicapped stalls shall be thirteen feet wide and nineteen feet in length. and
shall adhere to the standards set forth in the American for Disabilities Act.
2. All parking stalls shall adhere to Section 41.1.2.4 unless the applicant provides a
continuous curb and gutter adjacent to parking stalls.
3. Offstreet Loading and Parking Requirements shall be in accordance with Section 41
of the Weld County Zoning Ordinance. Presently the applicant shows 13 parking
spaces including one handicapped parking space.
Under sub-section 41.1.3 Office-one space for every two employees plus one space
for every 500 square feet of office space is required. For warehousing, one space
is required for every 1000 square feet of floor area designated for this use.
Drawings submitted with application designate 3000 square feet for office space and
12000 square feet for warehousing. Given these floor area totals, nine parking
stalls are required for office space, and twelve (12) spaces are required for the
warehouse facility. Total parking required for this parcel is 21 parking spaces.
Handicapped parking stalls shall be clustered near the office entry door to the
building. All handicapped parking stalls shall adhere to the National ADA standards.
The applicant shall provide curb cuts and curb ramps for ease of access to the

disabled public per ADA standards.
4. All accesses to public rights-of-way shall adhere to Section 33.6.1.3.5 of the Weld
County Zoning Ordinance. The Site Plan shall reflect adherence to this section. The
applicant has met this condition.
5. The trash receptacle north of and immediately adjacent to the building shall be
screened per Section 33.6.1.6 of the Weld County Zoning Ordinance. This shall be
delineated on the Site Plan.
6. The loading area shall be screened in accordance with Section 33.4.3.2 of the Weld
County Zoning Ordinance and Section 2.6.3#5 of the Mixed Use Development Plan
which states, "Loading, service, or storage areas must be screened with an opaque
screen that is an integral part of the building architecture. Chain link fencing with
slats or pallets are not an acceptable screening material. Plant material shall be
used to soften the appearance of the screen". Opaque screening shall be located
along the parcel line between Parcel 1 and Parcel 2. Opaque screening shall also
occur at right angles to the proposed property line screening to connect and abut
with the existing fencing parallel to Mulligan Drive. Other fencing types located on
the property to remain without modification. (Dept. of Planning Services)
7. Appropriate landscaping of parking lots shall be in accordance with Section 2.6 3 of
the MUD Ordinance. The applicant has met this condition.(Dept. of Planning
Services)
8. Appropriate landscaping and buffering along 1-25 Frontage Road and Mulligan Drive,
in accordance with Section 2.6.4#2a and #2b of the Mixed Use Development Plan,
(Ordinance 191). (Dept. of Planning Services)
9. The applicant shall place a typical cross-section of the parking lot on the alat and
identify the depth of base and concrete or full depth concrete according to the Weld
County Subdivision Ordinance, Sections 10.2.3 and 10.2.4., Geometric Design
Standards and Road Structures. (Dept.Of Public Works, Dept. of Planning Services)
10. The applicant shall adhere to the lighting standards, in accordance with Section
23.2.1.21.6 of the Weld County Zoning Ordinance (Ordinance 89, as amended).

11. The applicant shall provide additional information regarding the Storm water
Detention pond located in the northwest corner of the property. Further, the
Storm water pond shall adhere to the design standards per Section 33 6.1.1 of
the Weld County Zoning Ordinance, as amended. The applicant has met this
condition.
12. The gravel parking area immediately adjacent to the east access drive shall be
removed. There shall be visual signage, either with a physical sign or with stripping
on the pavement that no parking shall occur at this location. (Public Works Dept.)
13. The applicant shall provide the Department of Planning Services'with evidence that
the yard gate has an acceptable lock/pass key, as approved by Mountain View Fire
Protection District. (Dept. of Planning Services)

b. The applicant shall include a detailed Landscape Plan that conforms with the requirements
of Sections 23.2.1.13, 35.3.1 and 35.3.5 of the Weld County Zoning Ordinance, as amended,
and Section 9.3 of the Weld County Planned Unit Development Ordinance. In addition, the
Landscape Plan shall be recorded on the Site Plan or recorded as a separate Landscape
Plan. The Landscape Plan shall address the following information:
1. An installation schedule which specifies when the landscaping will be installed on
site (Dept. of Planning Services).
2. A Plant Material List specifying the Botanical and Common names of all plant
material to be installed; the size of the plant material at installation and whether the
plant material is in a container or is B&B (Dept. of Planning Services).
3. A landscape maintenance schedule which specifically states who will perform
maintenance and that maintenance is on-going and shall not end upon final
acceptance by the Department of Planning Services (Dept. of Planning Services).
c. The following notes shall be placed on the plat:
1. In accordance with the Weld County Zoning Ordinance, no land, building or structure
shall be changed in use or type of occupancy, developed, erected, constructed,
reconstructed, moved or structurally altered or operated in the commercial or
industrial zone districts until a Site Plan Review has been approved by the
Department of Planning Services (Dept. of Planning Services).
2. There will be no parking or staging of trucks allowed on Mulligan Drive or 1-25
Frontage Road. (Public Works Dept.)
3. Sufficient space shall be provided in loading areas to accommodate the vehicles
being loaded or unloaded without encroachment upon neighboring property or rights-
of-way. (Department of Public Works, Dept. of Planning Services)
4. The applicant shall adhere to Section 6.3.6.5 of the PUD Ordinance and to Section
2.8.2 of the MUD Ordinance for the design provisions and requirements for signs in
the MUD Zone District. The applicant has met this condition. (Dept. of Planning
Services)
5. Adequate toilet facilities shall be provided for the public and employees. (Dept of
Public Health and Environment)
6. The facility shall utilize the existing public water supply. (Little Thompson Water
District) (Dept. of Public Health and Environment)
7. The facility shall utilize the proposed municipal sewage system when it becomes
available, if the facility is within 400 feet of the sewer line.
8. Landscaping materials as indicated in the approved landscape plan shall maintained
at all times. Dead or diseased plant materials shall be replaced with
materials of similar quality and quantity at the earliest possible time.
9. All structures, including signs, on site must obtain the appropriate building permits.

10. The site shall maintain compliance with the Weld County Planned Unit Development
(PUD) and Mixed Use Development (MUD) Standards at all times.
d. The applicant shall submit evidence to the Department of Planning Services that final
approval has been received from the Mountain View Fire Protection District. (Mountain View

e. The applicant shall submit two sets of engineered blueprints, including engineered foundation
and structural design to the Weld County Building Inspection Department to determine code
compliance. (Building Inspection)
f. The applicant shall submit a plan describing any proposed on-site signage. Any proposed
sign shall adhere to Section 42.3 of the Weld County Zoning Ordinance, Section 6.3.6 of
the PUD District Regulations and Section 2.8.2 of the MUD Ordinance. All proposed signs
shall comply for and receive a building permit.
2. Prior to recording the plat:
a. The applicant shall enter into an Improvements Agreement according to policy regarding
collateral for improvements and post adequate collateral for parking and landscaping
requirements. The agreement and form of collateral shall be reviewed by County Staff and
accepted by the Board of County Commissioners prior to recording the plat.
3. Prior to the release of building permits:
a. In conjunction with the requirements for the Final Plan of Sekich Business Park, all street
signs and lot identification shall be in place. (Planning Services)
b. Upon approval of the Department of Planning Services, the Site Plan Review plat shall be
recorded. (Planning Services)
c. The applicant shall submit two complete sets of blueprints to the Building Department
(Building Inspection, Planning Services)
4. Prior to the release of the Certificate of Occupancy:
a. A final inspection of the occupancy will be required by a member of the Mountain View Fire
Protection District. (Mountain View Fire Protection District)
b. The applicant shall have in place, all paving, parking and utilities. All parking spaces shall
include paint striping. (Planning Department, Public Works)

IMPROVEMENTS AGREEMENT ACCORDING
POLICY REGARDING COLLATERAL FOR IMPROVEMENTS
(PRIVATE ROAD MAINTENANCE)
THIS AGREEMENT,made and entered into this day of ,20 by and
between the County of Weld, State of Colorado, acting through its Board of County Commissioners,
hereinafter called "County," and Cannon Properties, Inc. hereinafter called "Applicant."
WITNESSETH:
WHEREAS, Applicant is the owner of, or has a controlling interest in the following described
property in the County of Weld,Colorado: Lot 1, Block 1, Sekich Business Park
•
WHEREAS, a Final Subdivision/Planned Unit Development (PUD) plat of said propeny, to be
known as Lot 1, Block 1, Sekich Business Park has been submitted to the
County for approval, and
WHEREAS,relevant Weld County Ordinances provide that no Subdivision Final Plat,Planned Unit
Development Final Plat, or Site Plan shall be approved by the County until the Applicant has submitted a
Subdivision Improvement Agreement guaranteeing the construction of the public improvements shown on
plans,plats and supporting documents of the Subdivision Final Plat, Planned Unit Development Final Plat,
or Site Plan,which improvements,along with a time schedule for completion,are listed in Exhibits "A" and
"B" of this Agreement.
NOW, THEREFORE, IN CONSIDERATION OF the foregoing and of the acceptance and
approval of said Final Plat, the parties hereto promise, covenant and agree as follows:
1.0 Engineering Services: Applicant shall furnish, at its own expense, all engineering services
in connection with the design and construction of the Subdivision or Planned Unit
Development improvements listed on Exhibit"A,"which is attached hereto and incorporated
herein by reference.
1.1 The required engineering services shall be perforated by a Professional
and La..; Surveyor registered in the State of Colorado, and shall conform to the
standards and criteria established by the County for public improvements.
1.2 The required engineering services shall consist of, but not be limited to, surveys,
designs,plans and profiles,estimates,construction supervision,and the submission
of necessary documents to the County.

Dear Ms. Cannon:
The Department of Planning Services' is presently processing your application for a Site Plan
Review for the subdivision of land, specifically Lot 1 of Block 1 into Parcel 1 and Parcel 2 of Lot 1,
Block 1 Sekich Business Park.
As your application is for a land division, the property comes under review for conformance with
the present Weld County Ordinances, including the Zoning Ordinance, the Planned Unit
Development Ordinance, and the Mixed Use Development Ordinance that regulate uses on this
property and throughout the Sekich Business Park development.
Therefore, the Environmental Health Services Department requests more information from the
applicant before they can review this Site Plan Review. Specifically, they are seeking answers to
the Site Plan Review questions for the Western Refractory property.
Further, the Department of Public Works requests information regarding the Detention Pond in the
northwest corner of the property, a drainage study sizing the pond and the storm water
management plan for the property.
Please find enclosed the questionnaire sheets for the Site Plan Review application for your use and
information. At your earliest convenience please provide the Department of Planning Services'with
this required information. Your site plan review will not move forward until this additional
information is received by our office and the referral entities have had an opportunity to review and
address their referral comments.
Please note, per Section 15 of the Weld County Subdivision Ordinance, Ordinance 173 E, dated
October 6, 1997, that states "any subdivider, or agent of a subdivider, who transfers or sells or
agrees to sell or offers to sell any subdivided land before a final plat for such subdivided land has
been approved by the board and recorded or filed in the office of the County Clerk and Recorder
shall be guilty of a misdemeanor and shall be subject to a fine not to exceed five hundred dollars
for each parcel or interest in subdivided land which is sold or offered for sale. All fines collected
shall be credited to the General Fund of the County."
The sign posted on the property by Carol Davis of Century 21 Realty, The Parker Group lists "Land
for Sale." As no parcel has been created, she is in direct violation of Section 15 of the above
referenced Ordinance, unless she is selling the entire six acre parcel including the improvements.
Please inform her of this Section of the Weld County Subdivision Ordinance pertaining to listing of
land for sale.
A second field inspection will be conducted to verify this situation has been addressed, and
corrected.

We are in the process of splitting Lot 1, Block 1, Sekich Business Park,Weld County, Colorado
into two parcels. We are requesting the split under Site Plan Review SPR-317.
We are requesting your input in this matter to limit the process to a site plan review of the vacart
lot that is being created, not the existing building and developed portion of the land that has beer
in existence since 1990.
We started the process to split our land in early October 1999, when Nadine Woodside from ow
office met with county planner Eric Jerman. Eric immediately contacted the county attorney and
it was determined that the spit would be properly conducted under Site Plan Review.
On October 21, 1999 based on the meeting that Nadine had with Eric, Pat Cannon submitted a
letter, requesting the split of the land, and a plat map. Shortly after that date Bob Terry had a
meeting with Eric to go over the site plan review process and to determine precisely what needed
to be submitted with the official application. Eric went over the detailed list and eliminated many
items with the statement to Bob Terry that most of these items, on the site plan review list, are rot
necessary because we are only dealing with vacant land.
We then began pulling together the items outlined by Eric Jerman. The formal survey and the
letter of commitment from Little Thompson Water District took the longest time to get because of
time tables not under our control. On January 25, 2000, Bob Terry hand delivered the site plan
review application to Julie Chester.lead planner. Julie reviewed the items submitted and called
the county attorney to confirm that the site plan review process was the correct method to split
land in the Sekich business park. Julie did not say anything about needing to perform a site plar
review of the existing developed part of Lot 1.
On January 28, 2000, Kim Ogle,planner, wrote to Ginger Cannon, of Cannon Properties, stating
"the application and related materials for the request are complete and in order". There was no
mention of needing information on the existing properties.
On March 9, 2000, Kim wrote to Ginger Cannon seeking answers to the Site Plan Review
questions for the Western Refractory property, which is the portion of the Lot 1 developed in
1990.

During the third week of March, Bob Terry met with Kim Ogle to find out what type of issues
Kim had with the existing property.
While in the meeting with Kim,the lady from the health department stopped by to say she had no
issues and that she could sign off immediately on the vacant land. She seemed confused about
why we would look at the existing property.
Kim mentioned no problems with the vacant land,but he did want to get into redoing the
landscaping of the developed area occupied by Western Refractory. He specifically mentioned
replacing the chain link fence that surrounds the storage area with cedar fence. Attached are
pictures of the neighboring properties in Sekich Business Park showing that almost all are chain
link.
Kim also mentioned issues raised by Diane Houghtaling,public works. Bob Terry went over to
talk to Diane at public works.
Diane said that she did not need to review the existing developed portion of Lot 1 unless required
by county planning. If required by planning, she would request information on truck traffic
patterns, changing culverts to 15", and AI)A parking and ramp into the building. The attached
pictures shows that striping provides a 20 foot wide handi-capped parking area and a wheelchair
ramp at the front of the W RC building. The pictures also show that the driveways into the
property are 40 foot wide with a 33-foot wide gate into the yard. This provides ample turning
radius into the parking lot. Signage directs all truck traffic to the rear of the building. Because of
the wide driveway entrances it would be very costly to rip up and install 15 "culverts at this tune.
The pictures also show that there is already extensive attractive landscaping on the developed part
of Lot 1.
Because of the of the late notice that the planning department wants a site plan review of the
existing property, and the quality of the improvements already in place, we hereby request that
the site plan review be restricted to the vacant land only.
If you restrict the review to the vacant land only, it appears that everything has been approved by
the various agencies and the land can be split.

Dear Mr. Boos,
At your request, and as required by Weld County, we have prepared this drain-
age study for the proposed office and shop building at this site.
This Storm Drainage Report has been prepared using accepted engineering prac-
tices and procedures and should provide you and the reviewing agencies with
adequate information to analyze the storm drainage conditions affecting the
site and to review the outline of proposed drainage improvements.
GENERAL:
A 14,000 square foot building to provide office space and a shop area, and a
2,000 square foot detached storage building is to be constructed on this site.
Sixteen parking spaces, with asphalt drives and access to the buildings are
also provided. Access is to Mulligan Drive. The proposed improvements are
located on the Westerly 310 feet (2.27 Acres) of the 6.00 Acre site.
General site drainage is from East to West at about 0.33% grade. Present
drainage is collected in the borrow ditch along the North side of Mulligan
Drive, running Westerly to the I-25 Frontage Road along the West side of the
property, and thence Northerly. There are no other storm drainage systems
within the Business Park, and each lot is responsible for providing "On-site"
detention and controlled discharge.

The proposed improvements for the storm drainage are based on the defined im-
provements. The pond is about 20% over designed, but any additional improve-
ments will need to be reviewed to see if the pond is adequate, or if more de-
tention volume is required to meet the criteria.
DESIGN CRITERIA:
This plan is in accordance with the Weld County Performance Standards and
generally accepted design procedures for site drainage analysis. The pond
volume was calculated using Weld County requirements to retain all storm water
from a 100-Year Design Storm in excess of the historical runoff from a 5-Year
Design Storm.
A Rainfall Intensity-Frequency Table prepared by W R C Engineering for this
area was used. The Modified Rational Method was used to determine the pond
inflow; the allowable release rate; and consequently, the required detention
pond volume. The calculation of the formula input items are shown on the cal-
culation sheets. The design variables used in the Rational Formula Q a CIA
are as follows: "Q" represents the peak runoff rate; "C" represents the co-
efficient of runoff; "I" represents the rainfall intensity based on a time of
concentration (Tc) from the most distant point timewise; and "A" represents
the contributory drainage area.
STORM DRAINAGE FACILITIES:
Drainage from the South Half of the main building and the service area to the
South, is to be collected along an asphalt curb and directed Westerly along
the curb and across the Westerly entrance in an asphalt swale and then Northerly
in a "landscape" swale to the Detention Pond in the Northwest corner of the site.
The Northerly Half of the building and the area to the North of the building
are collected in a swale in the middle of the gravel open space which drains
to the Detention Pond. The Northerly 2.5 Acres of the undeveloped area to the
East is also carried to the Detention Pond through this swale.

The Southerly 1 .2 Acres of the undeveloped area will continue to flow South
into the borrow ditch along Mulligan Drive. Drainage from any new improve-
ments in this area will need to be directed to the "on-site" drainage systems
and thence to the Detention Pond.
The Detention Pond in the Northwest Corner of the site is to be constructed
by excavation and grading as shown on the Grading Plan. At the High Water
Line of Site Elevation 99.9. The detention volume is approximately 11 ,000 CF.
Controlled discharge is through a 12" 0 pipe through the berm to the borrow
ditch along the East side of the I-25 Frontage Road.
CONCLUSIONS:
We feel that this study provides a workable solution to the storm drainage
from this site. The additional storm drainage created by the improvements
on this site can be detained and discharged without adverse effect upon the
surrounding and/or downstream property. It should be recognized that storms
of a greater magnitude than considered or a different combination of conditions
could exist that could cause flooding and storm water quantities greater than
considered in this report.

Dear Mr. Ogle:
I have reviewed the submitted material pertaining to Canyon Properties, Inc. lot split and
site plan, located at 4023 Mulligan Drive in Weld County (Case Number SPR-317). 1 he
property named is within the boundaries of the Mountain View Fire Protection District
and receives fire protection from the District. The Fire District does not object to the lot
split and proposed building provided the requirements of the Fire District are met. Based
on my review, I have the following comments regarding project:
• Existing fire hydrants were not shown on the site plans submitted. Fire hydrants m ast
be located such that all required fire hydrants are within 600 feet of the building as
measured along approved fire apparatus access route around the exterior of the
building; and, at least one fire hydrant shall be located such that it is within 450 feet
of all portions of the building. If existing fire hydrants do not meet the distance
criteria outlined above, additional fire hydrants may need to be installed by .he
building owner/developer.
• Fire apparatus access appears to be adequate as indicated on the plans. Fire apparatus
access roads must be designed and maintained to support the imposed loads of tire
apparatus (60,000 pounds), must have a surface that provides all-weather driv ng
capabilities and be free from obstructions which includes locked gates.
• A final site plan and building construction plans must be submitted to the Fire District
for review and approval before a building permit may be issued. The final site plan
must show the location of all proposed and existing fire hydrants. Building
construction plans must include information on the building construction type, the
occupancy classification and the proposed use of the building.

This letter is in response to your request for a water service
commitment for one additional lot, in the location described as
follows :
A portion of lot #1, Block #1, Sekich Business park in SEC.23 ,
T3N, R6BW -- WELD COUNTY, CO
Little Thompson Water District currently has 6" Dia. water
line located along the I-25 Frontage road and along Mulligan Dr.
with additional capacity available . We will commit to provide
service to this proposed lot via one standard 5/8" X 3/4" water tap
with the following conditions :
1 . In August of 1993 the Little Thompson Board implemented a
"system impact" fee of $1050 per lot for all lots to be added
to the system. This is due upon application for the tap .
2 . All improvements to District facilities required to
provide service will be the financial responsibility cf the
developer in accordance with the District Rules and
Regulations . All improvements must conform to District
Specifications .
3 . The installation of a fire hydrant requires payment of
a $2 , 000 fire hydrant fee prior to installation of the fire
hydrant .
4 . The tap fee for a fire sprinkler tap is $2 , 000 . 00 for up
to a 6" Dia . Fire tap.
5 . You will be responsible for any improvements needed to
meet the specific fire flow requirements for your new
subdivided lot . Fire flow from hydrant # 551 @ 4023 Mulligan
Dr. has been in the 500 - 600 G. P.M. range . Some recent
changes to the system feeding the Sekich Business Park may
have helped to increase the flows in this area. You would need
to work with Mt . View Fire Protection District to determine if
the existing system would meet your needs .
This commitment will expire one year from the date of :his
letter if the tap has not been purchased and installed by That
date . The current fee for the domestic 5/8" X 3/4 " tap is
$10 , 000 . 00 These fees area subject to change without notice .
