RESOLUTION
RE: GRANT CHANGE OF ZONE FROM A (AGRICULTURAL DISTRICT) TO I-3
(INDUSTRIAL DISTRICT) FOR MARTIN AND WILMA OASE
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
No Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, a public hearing was held on the 1st day of Sept-
3 ember, 1982, at 2: 00 o' clock p.m. for the purpose of hearing
the application of Martin and Wilma Oase, 4784 Weld County Road
12 , Erie, Colorado 80516, requesting a Change of Zone from
A (Agricultural District) to I-3 (Industrial District) for a
parcel of land located in the N1/2NEa of Section 11, Township 1
mu North, Range 68 West of the 6th P.M. , Weld County, Colorado

being more particularly described in Exhibit "A" , attached

hereto and incorporated herein by reference, and

c.aw WHEREAS , Section 21. 6. 2 of the Weld County Zoning Ordinance
uz provides standards for review of such a Change of Zone, and

WHEREAS , the Board of County Commissioners heard all the
cx:r testimony and statements of those present, has studied the re-
quest of the applicant and the recommendations of the Weld
County Planning Commission, and having been fully informed finds
as follows:
1. The applicant has complied with Section 21. 7 et. seq.
of the Weld County Zoning Ordinance regarding the
application requirements for a change of zone.
2. The request is in conformance with Section 21. 5. 1. 1
of the Weld County Zoning Ordinance as follows :
a) It is the opinion of the Weld County Board of County
Commissioners that the proposed zone change is con-
sistent with the Weld County Comprehensive Plan,
and the proposed district will be compatible with
the existing surrounding land uses and future de-
velopment. The subject site is located in the
Tri-Area Planning Commission Comprehensive Plan
Areas . The Tri-Area Planning Commission is
recommending approval of the request and identifies
the subject site for future industrial land use.
b) Weld County Road 12 will provide adequate access
to the site.
c) The proposed rezoning would not interfere with ex-
traction of any known commercial mineral deposits.

d) Soil conditions do not present limitations to the
construction of structures on the site.
e) The proposed sewer system has been determined
adequate.
f) Water will be made available to the site by North
Central Weld.

The following business was transacted:
I hereby certify that pursuant to a notice dated July 26, 1982,
duly published July 29, 1982 and August 19, 1982 in the LaSalle Leader, a
public hearing was held on the request of Martin and Wilma Oase for a
Change of Zone, from A (Agriculture District) to I-3 (Industrial District) .
The Planning Commission recommended that this request be approved with
conditions. Mr. Oase was present and answered questions. He stated that
this property lends itself to industrial zoning because the area has
changed into an industrial area. The possible subsidence of the area
was discussed. There were no objections to this request. After study,
Commissioner Steinmark made a motion to approve said Change of Zone from
A to I-3 because the request appears to be consistent with the community's
desires and the development that has occurred in the area. Commissioner
Steinmark included the following conditions: 1) A geological hazard survey permit
is required for any portions of the property which are within the potential
subsidence areas before any building permits are issued or before any toxic
materials are stored on the property; 2) Prior to the issuance of building
permits, the applicants shall contact the Longmont Fire Protection District to insure
that an adequate water supply is available for fire protection. Commissioner
Kirby seconded the motion and it carried by the following vote: All the
Commissioners voted yea except Commissioner C. Carlson who voted nay.
Commissioner C. Carlson stated that this request is almost like spot zoning
and, further he would like the subsidence questions answered before said
Change of Zone is approved.

Moved by Jack Holman that the following resolution be introduced
for passage by the Weld County Planning Commission:
Be it Resolved by the Weld County Planning Commission that the appli-
cation for rezoning from "A" ( Agriculture District) to
"I-3" (Industrial District) covering the following described
property in Weld County, Colorado, to-wit:
NZ NE1, Section 11, TIN, R68W of the 6th P.M. , Weld County,Colorado.

II . 1 . The history of industrial land use in said area supports
the proposal for zoning change . The town of Dacona in
the past has given permission for industrial growth in
the area ; it has approved Oase request for zoning change .
Present industrial users are St . Vrai.n Block , Flatirons ,
Pre—cast Concrete , oil wells , salvage yards , and car
race track ; therefore , it is suggested that the proposal
is consistent with the Weld County Comprehensive Plan .
35 . 4 . 1 implies that present zoning for said property
could be considered faulty because of increasing industrial
users .
2 . The future uses of said property that are allowed in 1-3
zoning shall be computable with surrounding land uses
as noted above .
3 . Weld Central Water district can provide adequate water .
it has a 6 inch line on the north side of road 12 and a
3 inch line on the east side of road 11 . The present
industrial users in the area are using septic tanks which
is what would probably be used by new users of comparable
size . If a large factory wanted the site then it would
probably use Dacono sewer system which is one mile east
and ', mile north .
4 . The present heavy truck traffic appears to present no
problems . Until industrial users are found for the prop—
erty , it is difficult to evaluate the roads . It may be
best to pass approval on future users in terms of road
conditions .
5 . a . Said property is not in a flood plain .
b . Item b . is not applicable at this time because the
type of future structures needed are yet to be de-
termined .
c . There appears to be interference with the future
extraction of mineral deposits , since there appears
to be no minerals for extraction (not applicable) .
d . The limitations subject to soil conditions will be
addressed by applicant prior to the development of
industrial structures .
III . It is assumed by applicant that items 8 through 14 have been
adequately considered by the responses given in items II . 1 .

that time Mrs . Wilma Oases presented herself before us to ask
our opinion on their request for a re-zoning of their property,
80 acres more or less, southwest of the Dacono Town limits in
Weld County.
Their present zoning for that area is Agriculture. She and her
husband Martin, have requested a zone change to Industrial . I
understand that they have approached you on this matter.
This Commission has no objection to the zone change on this parti-
cular property, to Industrial-I. This falls in n with our Compre-
hensive Plan. Dacono Planning Commission emphsized Industrial-I.

Dear Rod:
An on site review of this tract shows that the major portion of the
80 acres is considered "prime farmland." There is a portion of
the area that is in a major drainageway and should not be considered
for any other use. The farm is presently planted to mostly hay
crops and the land is irrigated.
In keeping with the District's expressed concern of loss prime
farmland, this request should receive guarded scrutiny before
any decision is made to change the present agricultural zoning.
