RE: APPROVE CANCELLATION AND RELEASE OF COLLATERAL AND ACCEPT
REPLACEMENT COLLATERAL FOR SANDRA'S VISTA FINAL PLANNED UNIT
DEVELOPMENT, S #476 - KERMIT BOHRER

WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated May 24, 1999, the Board did approve an
Improvements Agreement According to Policy Regarding Collateral for Improvements (Private
Road Maintenance) with Kermit Bohrer, concerning property described as part of the S1/2
NW1/4 of Section 19, Township 3 North, Range 68 West of the 6th P.M., Weld County,
Colorado, and
WHEREAS, pursuant to said Improvements Agreement, Irrevocable Letter of Credit
#7988567 from First Bank of Longmont, 1707 North Main Street, Longmont, Colorado 80501, in
the amount of$37,000.00, was submitted to Weld County, and
WHEREAS, staff from the Weld County Departments of Planning Services and Public
Works have conducted a visual inspection of the project and recommends cancellation and
release of said collateral, with 15 percent of the total amount to be retained for a one-year
period, and
WHEREAS, personal check #3302 from Kermit Bohrer, dated April 11, 2000, in the
amount of$450.00, has been presented to Weld County, and
WHEREAS, the Board of County Commissioners deems it advisable to cancel and
release Irrevocable Letter of Credit#7988567 from First Bank of Longmont, 1707 North Main
Street, Longmont, Colorado 80501, in the amount of$37,000.00, and to accept personal
check #3302 from Kermit Bohrer, dated April 11, 2000, in the amount of$450.00.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that Irrevocable Letter of Credit#7988567 from First Bank of
Longmont, 1707 North Main Street, Longmont, Colorado 80501, in the amount of$37,000.00,
be, and hereby is, canceled and released.
BE IT FURTHER RESOLVED by the Board that the Clerk to the Board be, and hereby
is, directed to return said collateral to the appropriate issuing party.
BE IT FURTHER RESOLVED by the Board that personal check #3302 from Kermit
Bohrer, dated April 11, 2000, in the amount of$450.00, be, and hereby is, accepted.

SUBJECT: Release of collateral for S-476
Mr. Kermit Bohrer has requested a release of collateral for S-476. The applicant has completed the
transportation items to the satisfaction of the Weld County Departments of Planning Services and
Public Works.
Weld County Department of Public Works requests the letter of credit be reduced to retain 15% of
the street base item for one year.

COLORADO SUBJECT: S-476: Kermit Bohrer
I visited the subdivision on March 27, 2000, to verify transportation items for release of collateral. Street grading,
street base, and culverts have all been completed to my satisfaction. The street name sign needs to be placed
on a separate post and not on the power pole adjacent to WCR 1.
As per#8.1.6 of the requirements for collateral,the letter of credit shall be reduced to retain 15%of the street base
item for one year. At that time,the applicant will contact Weld County Public Works Department for a reinspection.
If no repairs are needed, the 15% will be released.

Dear Ms Lockman,
I would like to request an inspection and release of collateral for the afro mentioned PUD Case number S-476.
I would appreciate a timely effort on Mr. Carrot's part as the letter of credit will renew automatically next month,
and will of course be another expense. I am sorry to have to ask for the effort but the contractor ran into some
delays.
