HomeMy WebLinkAbout20002431.tiff „AenfA( h� /6 - ORDINANCE NO. 191-E U) ,;)000 IN THE MATTER OF THE REPEAL AND RE-ENACTMENT, WITH AMENDMENTS TO CERTAIN MAPS TO ORDINANCE NO. 191, WELD COUNTY MIXED USE DEVELOPMENT PLAN, AS CURRENTLY AMENDED BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF WELD, STATE OF COLORADO: WHEREAS, the Board of County Commissioners of the County of Weld, State of Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners has the power and authority under the Weld County Home Rule Charter and Article 28 of Title 30, C.R.S., to adopt planning goals and policies for the unincorporated areas of the County of Weld, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, has previously adopted Ordinance No. 191, Weld County Mixed Use Development Plan, establishing a comprehensive revision of the planning goals and policies for the unincorporated areas of the County of Weld and has adopted amendments in Ordinance No. 191-A through 191-D, and WHEREAS, the proposed Mixed Use Development Plan revision has been reviewed by the Weld County Planning Commission and the Board of County Commissioners, and WHEREAS, the Board of County Commissioners of Weld County hereby finds and determines that there is a need for a revision of the Mixed Use Development Plan for the County of Weld, and that this Ordinance is for the benefit of the health, safety, and welfare of the people of Weld County. NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of the County of Weld, State of Colorado, that the Weld County Mixed Use Development Plan be, and hereby is, repealed and re-enacted with amendments as follows: 1. The Structural Land Use Plan Map 2.1 is amended to include the following parcels: A. The N1/2 NE1/4 of Section 36. Township 3 North, Range 68 West c1 the 6th P.M., Weld County, Colorado. B. Part of the SW1/4 NW1/4 and all of the SE1/4 of Section 36, Township 3 North, Range 68 West of the 6th P.M., Weld County, Colorado. 2. Move Map 1.1, Regional Influences Map to the from the Mixed Use Development Map to the Department of Planning Services background materials document. 2000-2431 ORD191E RE: ORDINANCE #191-E PAGE 2 3. The Structural Transportation Network Map 2.2 is amended to illustrate the correct Mixed Use Development Area, road classification names, and modifications requested by the Department of Public Works. 4. Amend Section 1.1.2 to read, "The MUD area covers approximately 12,800 acres with approximate boundaries at Weld County Road (WCR) 1 on the west, WCR 11 on the east, State Highway 66 on the north and WCR 20 on the south. The MUD planning area boundaries are shown on Map 2.1." 5. Add subsection 2.8.2(5)e, to read: "Signs or components of signs that change physical position or light intensity by any movement or rotation of the physical sign or components which make up the sign or which give the visual impression of movement or rotation." 6. Move all Figures labeled 2.10 to the Subdivision Ordinance, Section 10. 7. Section 2.7.3, Road Structure paragraph, add a sentence to read, "All roads shall adhere to the standards set forth in Section 10 of the Subdivision Ordinance." 8. Delete entire Section 3. Inventory of Existing Uses from the Ordinance, and place it in the Department of Planning Services background material document. 9. Section 4.1, Table 4.1, Listing of Plant Materials, shall be moved to Section 3.1 and revised to read as follows: Section 3. Appendix 3.1 Plant Materials. The following is a partial list of plant materials that are native or adapted to Colorado's Front Range in the MUD area. This is not an all inclusive list and is intended only to act as a general resource. New plant materials are being made available on a commercial basis and local nurserymen are a valuable resource when trying to determine the appropriateness and adaptability of plant materials to a particular location. With the wide range of altitudes, micro-climates and soil conditions, not every plant is suitable or hardy in all locations. BE IT FURTHER ORDAINED by the Board that this Ordinance No. 191-E, insofar as it is the same as Ordinance No. 191 as amended, is intended to be a continuation of the prior ordinance and not a new enactment. BE IT FURTHER ORDAINED by the Board, if any section, subsection, paragraph, sentence, clause, or phrase of this Ordinance is for any reason held or decided to be unconstitutional, such decision shall not affect the validity of the remaining portions hereof. The Board of County Commissioners hereby declares that it would have enacted this Ordinance in each and every section, subsection, paragraph, sentence, clause, and phrase thereof irrespective of the fact that any one or more sections, subsections, paragraphs, sentences, clauses, or phrases might be declared to be unconstitutional or invalid. The above and foregoing Ordinance Number 191-E was, on motion duly made and seconded, adopted by the following vote on the 23rd day of October, A.D., 2000.
