Thank you for your recent notice on August 15, 2000, concerning Docket
#2000-40. After reading this notice we reviewed our ownership interests in
Section 16-T5N-R66W. Our records indicate the following:
1)We sold most of our surface in this section but have retained 5.8
acres, more or less, of surface ownership specifically excluded from
the patents we issued for this land (State Patent#s 2498 -2.7 acres,
#3262 - 1.9 acres, #3916 - 0.25 acres, and #4889 - 0.95 acres).
2)We retained the mineral ownership on all of Section 16 and have a
producing lease for this section.
3)The information provided is insufficient to determine exactly how
this resubdivision action will affect our continuing surface ownership
and our mineral ownership.
Until we have more detailed information we find that we cannot adequately
review this action and ask that you delay any further action. Please
provide us with a copy of the plat to help us determine exactly where this
resubdivision is located within the section for further response.

Ogle contacted Mr. Killip, Special Projects Manager for the Colorado State Board of Land Commissioners
in Denver via telephone and later facsimile on August 18, 2000. He informed this office that the status of
their holdings are not impacted by the proposed Faith Tabernacle Development. The holdings of record
for them are located predominately in the N2 and the SE4 of this section. Ogle sent via facsimile a map of
the area and asked for confirmation of property holding status given the location of Faith Tabernacle
Church. Killip was to respond if there was any conflicts with their interests. Killip did not respond
indicating a conflict.

COLORADO SUBJECT: Continuance of S #518 - Faith Tabernacle Church
On August 14, 2000, a legal notice was sent to the County newspaper for publication on
August 17, 2000. This notice was overlooked and did not get published. The earliest hearing
date that the applicant was able to attend is September 20, 2000. I request this matter be
continued to September 20, 2000, at 10:00 a.m. to allow for proper publication of the notice.
