RE: APPROVAL OF RECORDED EXEMPTION NO. 472 - MR. AND MRS . GEORGE
SANDLIN
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public meeting held on
the 24th day of December, 1980 in the Chambers of the Board of
County Commissioners of Weld County, Colorado, that the division
into two parcels of land, as shown on the plat known as Recorded
Exemption No. 472, being the property of Mr. and Mrs. George
Sandlin, described as part of Section 29 , Township 1 North,
Range 66 West of the 6th P.M. , Weld County, Colorado, being more
particularly described as follows:
The Northwest Quarter of the Northeast
Quarter of Section 29, Township 1 North ,
Range 66 West of the 6th P.M. , Weld
County, Colorado
does not come within the purview of the definition of the terms ,
"subdivision" and "subdivided land" , pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973, as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado finds that this particular division of land is not
within the purposes of the Weld County Subdivision Regulations
and the Board desires to exempt this particular division of land
from the definitions of "subdivision" and "subdivided land"
pursuant to its authority under Section 30-28-101 (10) (d) , CRS
1973, as amended, and Section 2-lA (3) of the Weld County Subdi-
vision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcel of land owned by Mr. and Mrs. George Sandlin be, and
hereby is, exempt from the definition of the terms "subdivision"
and "subdivided land" pursuant to its authority under Section
30-28-101 (10) (d) , CRS 1973, as amended.

Re: Recorded Exemption #472
Dear Commissioners:
The attached application, plat, and related items are in reference to a
request from Mr. and Mrs. George Sandlin for a recorded exemtpion. The
parcel of land on which this request has been made is described as the
NWµ NEµ, Section 29, TIN, R66W of the 6th P.M. , Weld County, Colorado.
This property is located li miles north of Brighton, Colorado. The property
contains approximately 40 acres of Class 11 and 111 irrigated soils. The
request is to split the property into parcels of 5 acres and 35 acres.
On November 19, 1980 the Board of County Commissioners approved a request
by the Sandlins for a lot size variance so that they could make applica-
tion for this recorded exemption. At the time the Board make the decision
on that request, the Department of Planning Services Staff submitted a letter
of recommendation. A copy of that letter of recommendation is included in
the attached packet. Nothing has been received by our office which would
change our recommendation of approval for this request as outlined in the
letter to the Board of County Commissioners dated November 19, 1980.
On December 18, 1980 the Weld County Board of Adjustment approved a request
from the Sandlins for a variance of 180 feet from the 180 foot minimum lot
width requirement along a public road as set forth in Section 3. 14 of the
Weld County Zoning Resolution and Section 9-4 A. (3) of the Weld County
Subdivision Regulations. Therefore, this request complies with the provi-
sions of Section 9-4 A. of the Weld County Subdivision Regulations.

Re: Lot Size Variance #118
Dear Commissioners:
The attached letter and related materials are in reference to a request
for a lot size variance from George and Charlene Sandlin. The property
on which this request has been made is described as the NW1 NE14, Section
29, T1N, R66W of the 6th P.M. , Weld County, Colorado. This property is
located 111 miles north of Brighton.
The property under consideration contains approximately 40 acres of class
II and III irrigated soils. The request is to obtain a variance from
the minimum lot size requirement, Section 9-4. A. (6) of the Weld County
Subdivision Regulations, so that they may make application for a recorded
exemption.
Mr. and Mrs. Sandlin are requesting this lot size variance in order to
move their mother's home onto the property.
Based upon the information submitted and the adopted policies in the
County, the Department of Planning Services Staff recommends the request
be approved for the following reasons:
1. The proposed request conforms with the intent clause of the
recorded exemption procedure (Section 9-2 of the Weld County
Subdivision Regulations) , the intent clause of the Agricultural
Zone District (Section 3.3.A. of the Weld County Zoning Resolu-
tion) , and the Weld County Comprehensive Plan in that the uses
will be compatible with the surrounding agricultural uses. The
request will allow agriculture and related uses to be the pre-
dominant land uses.
2. The City of Brighton has reviewed this request and has no objec-
tions to it.
3. The request complies with the provisions of Section 9-4 A. of
the Weld County Subdivision Regulations with the exception of the
lot width requirement.

The required minimum road frontage in the Agricultural Zone District is
180 feet. The Sandlin's request as presented does not have the required
public road frontage. Therefore, if this lot size variance request is
approved by the Board, Mr. and Mrs. Sandlin should provide the minimum
road frontage or apply for a variance from that requirement prior to ap-
proval of a recorded exemption on this property.
