HomeMy WebLinkAbout20002176.tiff RESOLUTION RE: APPROVE VACATION OF SPECIAL USE PERMIT#230 - LOT HOLDING INVESTMENTS, LLC WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution dated November 28, 1973, the Board did approve Special Use Permit#230 for an expansion of an existing cattle feedlot operation for Bob Ehrlich, ciba Apollo Land and Cattle Company, on the following described real estate, to-wit: NE1/4 NE1/4 of Section 14, Township 4 North, Range 67 West of the 6th P.M., Weld County, Colorado WHEREAS, the Board has received a request from Lot Holding Investments, LLC 3026 4th Avenue, Greeley, Colorado 80631, current property owners to vacate said Special Use Permit#230, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations of the Department of Planning Services staff and all of the exhibits and evidence presented n this matter and, having been fully informed, deems it advisable to approve said vacation. This agreement outlines a cooperative planning agreement between the Town and County. As part of this agreement, staff from the Weld County Department of Planning Services conducted research into all land-use applications in Milliken's planning boundary This research included a permit on property formerly owned by Mr. Bob Ehrlich for Apollo Land and Cattle Company, located in the Northeast Quarter of Section 25, Township 5 North, Range 67 West. Case number SUP-230 was issued for an expansion of an existing cattle feed lot operation. This permit is still associated with the aforementioned property. The field inspection incicated that perhaps, this permit is no longer in use. In cases such as this, the property owner has the option of vacating this Special Use Perriit. What a vacation of land use permit means is simply a closing of the permit so that the permit is no longer associated with your property, located in part of the Northeast Quarter of Section 26 and part of the Northwest Quarter of Section 25, Township 5 North, Range 67 West of the 6th P.M., Weld County, Colorado. For your ease, I have enclosed a letter for you to complete in requesting that this use be vacated from your property. By vacating the land-use application, the operation will no longer be associated with your property. Should you not desire to vacate this permit, please notify me in writing.
