HomeMy WebLinkAbout20001749 HEARING CERTIFICATION DOCKET NO. 2000-36 RE: SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT#1273 FOR AN AGRICULTURAL SERVICE ESTABLISHMENT (WHOLESALE/RETAIL NURSERY) IN THE A (AGRICULTURAL) ZONE DISTRICT - WILLIAM AND MARY BERG/TRIPLE B TREES AND SHRUBS A public hearing was conducted on August 23, 2000, at 10:00 a.m , with the following present: Commissioner Barbara J. Kirkmeyer, Chair Commissioner M. J. Geile, Pro-Tern Commissioner George E. Baxter Commissioner Dale K. Hall Commissioner Glenn Vaad Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Chris Gathman Health Department representative, Charlotte Davis Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated July 10, 2000, and duly published July 13, 2000. in the South Weld Sun, a public hearing was conducted to consider the request of William and Mary Berg,Triple B Trees and Shrubs,for a Site Specific Development Plan and Use by Special Review Permit #1273 for an Agricultural Service Establishment (wholesale/retail nursery) in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Chris Gathman, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Mr. Gathman gave a brief description of the location of the site, and stated three of the six referral agencies responded indicating no conflicts with their interests. He further stated the Weld County Departments of Public Works, Building Inspection, and Planning Services all recommend approval of the proposal as indicated in his Administrative Recommendation, marked Exhibit 2. Mr. Gathman submitted a memorandum, marked Exhibit F, recommending changes to the Conditions of Approval and Development Standards. In response to Commissioner Geile, Mr. Gathman stated Condition of Approval #2.A is necessary because the applicants are concurrent y applying for Recorded Exemption #2740 which creates Lot A that this proposal is located on. Lot B is owned by Paul and Ann Linn. Mr. Gathman further stated the Recorded Exemption was approved by staff subject to recording the plat. William Berg, applicant, stated he and his wife have worked with the property owner to make this a viable operation, the neighbors have indicated they would like this operation in the area and they intend to provide affordable trees and shrubs. In response to Commissioner Geile, Mr. Berg stated he has continued leasing the property beyond December 1, 1999, although the Lease Agreement had the option for early termination if this permit were not approved by that date. He further stated there are two facilities on the site, he will not live there, and he understands that although he may buy 10 additional acres for expansion, the area may not be granted as an amendment to this permit. No public testimony was offered concerning this matter. In response to Chair Kirkmeyer, Mr. Berg stated he has reviewed and agrees with the Conditions of Approval and Development Standards. In response to Chair Kirkmeyer, Mr. Gathman stated that although his memorandum indicates removing Development Standard#12 and inserting it as a Condition of Approval, he feels it would be better to also keep it as a Development Standard so that the requirement is in place for future expansion. He concurred with Chair Kirkmeyer that Condition of Approval #2.G should be amended to indicate the Waste Handling Plan is tc be reviewed and approved by the Health Department. Commissioner Vaad moved to approve the request of William and Mary Berg, Triple B Trees and Shrubs, for a Site Specific Development Plan and Use by Special Review Permit #1273 for an Agricultural Service Establishment (wholesale/retail nursery) in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission with the Conditions of Approval and Development Standards as entered into the record, with the addition of Condition of Approval #2.1 to state, "The recreational vehicle located on the property shall be removed," add Condition of Approval #2.J using the language from Development Standard #12, and add the phrase "for review and approval" to the end of the first sentence of Conditior of Approval #2.G. The motion was seconded by Commissioner Geile, and it carried unanimously This Certification was approved on the 31st day of July 2000.
