Proper building permits shall be obtained prior to any construction or excavation. 2. Building permits are required for any accessory buildings being constructed or moved onto the property. Additionally, permits are required for any decks and patios. 3. All foundations of principal dwellings will be required to be engineered. The preliminary soils report indicates that the soil has "fair to poor potential for urban development." It was also noted that the soil has "moderate to high shrink swell, low strength and moderately slow permeability." As a result of these preliminary results a site-specific geotechnical report is required. Any fill material placed must be of the type allowed by the 1997 Uniform Building Code (UBC) and be compacted to a minimum of 90%. The test results of that compaction must be supplied to the Weld County Building Inspection Department. 4. Normally engineering is not required for accessory buildings. However, in some cases it is required (See 20.1.13 of The Weld County Building Code Ordinance). 5. All buildings or structures shall maintain distances from property lines and adjacent buildings as outlined in Table 5-A of the 1997 Uniform Building Code. 6. When building permit applications are accepted, a complete plan review is done. A review of the building or structure by the Weld County Inspection Department may reveal other building issues or areas needing attention. Our comments and requirements are as follows: External Roads:WCR 1 and 46 are designated as local roads in the Weld County Comprehensive Transportation plan. Each road has the required 60 feet of right-of-way. WCR 1 is maintained by Larimer County Internal Streets: Internal local streets require 60 feet of right-of-way. All internal roadways are two-way roadways. The minimum roadway width is 28 feet wide (2-10 foot lanes and 2-4 foot shoulders)per section 10.2.1.8. The minimum roadway requirements mentioned in section 4.6.9.6 shall be are allowed only under severe physical constraints and very low traffic volumes (under 20 vehicles per day). In my opinion this subdivision does not meet these requirements. Cul-de-sacs require a 65' radius with a 50' paved turn-around. Our most recent traffic counts for this section of road are as follows: Larimer County Road 904—North of Larimer County Rd 10: rc 1 (ADT=Average Daily Traffic) 90 92/22 -- (YR=Year count was taken) 100 95/21' 1'F' ; (WK=Calendar week subject year) 190: :. 98/21 90 (%=Percentage Increase or Decrease-) This section of LCR 904/WCR 1 is functionally classified as a Minor Collector,which in Larimer County requires a 100 ft right of way. We ask that the applicant be required to dedicate any additional ROW on the east half of the road to satisfy the half right of way requirements of 50 ft. We request that the applicant be required to provide a Preliminary Traffic Impact Study for this development. The study must address what, if any, transportation improvements are or will be needed to handle the projected traffic caused by this project. I assume that Weld County has requirements similar to ours but if not, the applicant should refer to Appendix F, section F.6, of the Larimer County Road Manual for the specific information required in the study. We were a little confused by the"Vicinity and Land Use Map"that we received regarding the pavement type. There is a callout that says that WCR 1 is `currently not paved' but another callout that says 'edge of pavement'. Our records indicate that this section is not paved so we request that the applicant provide a Paving Threshold Study per Appendix F, sections F.4 and F.5, of the Larimer County Road Manual. The findings of the study will indicate whether or not the roadway surfacing requirements found in section 8.1.5 of the Larimer County Land Use Code are met. Per section 8.1.5 of the Larimer County Land Use Code, paving is required if the cumulative traffic volume exceeds the maximum capacity for gravel roads, which is defined as an average daily traffic (ADT) of 400 for treated gravel roads and 200 for untreated gravel roads in rural areas. Based on the ADT numbers that were collected by Larimer County in 1998 for CR 904, and the increased trips on CR 904 from the proposed 5 lots,the ADT will exceed 200 trips per day. If the road is currently untreated, we ask that the applicant be required to pave that CR 904. We request that the applicant be required to provide detailed location and site distance information for the proposed access with the preliminary submittal. Any existing accesses within 700 ft of the proposed access should also be shown. It is my understanding that any access construction on LCR 901/WCR 1 or work in the County right-of-way,will require an Access or Utility Permit from this office. Access information and permits can be obtained by contacting our office at(970)498-5700. Drainage and erosion control should be addressed in a Drainage/Erosion Control Plan and Report. The Town's preliminary land use plan shows the Schultz property outside the growth management area. The Town of Berthoud is generally opposed to upzoning(rezoning to a higher residential density) in the area surrounding Berthoud and for this property in particular for the following reasons: 1. The Town has adopted a density transfer fee, whereby the intent is to transfer residential density from the surrounding agricultural community to the Town. Upzoning this property is generally in conflict with the goal of this transfer program, which is to lower the residential density in the area. 2. It is possible that the Town of Berthoud may expand into this area sometime in the long-range horizon. Large lot development as proposed generally inhibits potential future urban level density. Thus this proposal would be in conflict with possible urban expansion. The Town is generally not opposed to uses and subdivisions allowed by the existing zoning. The Department has received and reviewed preliminary percolation test results for the proposed development. Percolation tests were conducted by Landmark Engineering on December 10, 1999. Based on the test results it appears that each septic system will require an engineer design due to poor percolation. Percolation rates ranged between 60 minutes per inch and 480 minutes per inch. The Department had noted in sketch plan comments that not more than 25% of the subdivision can have evapotranspiration septic system. However, there are several alternatives to a *total* evapotranspiration system (where all effluent is expected to evaporate, with no consideration to any absorption capabilities) that can be designed for the property. Alternatives include 1) a low pressure drip system (small amount of effluent is spread over a large area at a dosed rate), 2) a combination absorption and evapotranspiration system (a calculated portion of the effluent is expected to be absorbed and the difference is expected to evaporate) or 3) a water balance system (similar to a combination system except that annual precipitation and evaporation rates are calculated for the area as well as absorption rates of the soil.) Although the soil exhibits poor characteristics for percolation, with the proposed lot sizes there is room for primary and secondary absorption fields, and alternatives to a *total* evaporative system that can meet Section 6.1(C). Primary and secondary septic system envelopes were requested on the sketch plan comments. Those envelopes were not designated on the Change of Zone map. Therefore, the following conditions are recommended to be part of any approval: 1. A Weld County Septic Permit is required for each proposed septic system and shall be installed according to the Weld County Individual Sewage Disposal System Regulations. Each septic system shall be designed for site-specific conditions, including but not limited to maximum seasonal high groundwater, poor soils, and shallow bedrock. 2. This minor subdivision shall utilize Little Thompson Water District. 3. The applicant shall delineate on the plat an area for septic system replacement envelopes. Primary and secondary septic system envelopes shall be designated on each lot. Each envelope must meet minimum current setbacks as specified in the Weld County Individual Sewage Disposal System Regulations. 4. Language for the preservation and/or protection of the second absorption field envelope shall be placed in the development covenants. The covenants should state that activities such as landscaping (i.e. planting of trees and shrubs) and construction (i.e. auxiliary structures, dirt mounds, etc.) are expressly prohibited in the designated absorption field site. 5. In the event that 5 or more acres are disturbed during the construction and development of this site, the applicant shall obtain a storm water discharge permit from the Water Quality Control Division of the Colorado Department of Public Health and the Environment. Please note: The Weld County Department of Public Health & Environment, Environmental Health Services recommends alternative strategies regarding water conservation and waste minimization. Considerations such as xeriscaping, low flow water fixtures, backyard composting and recycling are a few options available to home owners.
