RE:! APPROVE THREE TEMPORARY CONSTRUCTION EASEMENTS AND TWO
AGREEMENTS CONCERNING PURCHASE OF RIGHT-OF-WAY FROM ADJACENT
PROPERTY OWNERS FOR COUNTY LINE BRIDGE PROJECT (BRIDGE #13184A)
AND AUTHORIZE CHAIR TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with three Temporary Construction
Easements concerning permission to enter property for replacement of Bridge #13/84A
between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, on behalf of the Department of Public Works, and the
following parties with terms and conditions being as stated in said easements:
1) Timothy and Lisa Brough
2) Kenneth and Sue Kerchenfaut
3) Eugene Schneider
WHEREAS, after review, the Board deems it advisable to approve said easements,
copies of which are attached hereto and incorporated herein by reference, and
WHEREAS, the Board has been presented with two Agreement Concerning Purchase
of Right-of-Way for said project between the County of Weld, State of Colorado, by and through
the Board of County Commissioners of Weld County, on behalf of the Department of Public
Works, and the following parties with terms and conditions being as stated in said agreements:
1) Kenneth and Sue Kerchenfaut
2) Eugene Schneider
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the three Temporary Construction Easements and two
Agreements Concerning Purchase of Right-of-Way between the County of Weld, State of
Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the
Public Works Department, and the above mentioned parties, be and hereby are, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said easements and agreements.

Enclosed please find agreements and easements signed by Weld County property owners adjacent to our bridge
replacement project(PN 226)on Weld County Road 13 (Larimer County Road 901). These are in the format
used by Weld County, and we would request approval by the Weld County Board of County Commissioners.
Please return one signed copy of each.
Larimer County will be responsible for all compensation paid to the property owners, and for assuring that all of
the conditions described in the agreements are fulfilled. The completed Deeds of Dedication will be sent to you
for acceptance and recording in about June. We appreciate Weld County's participation and assistance in this
project. Please call me at 498-5715 if you have questions.

TEMPORARY CONSTRUCTION EASEMENT

KNOW ALL MEN BY THESE PRESENTS: That KENNETH J. KERCHENFAUT
AND SUE K. KERCHENFAUT, OWNERS IN JOINT TENANCY, Grantor, whose legal
address is 41490 WCR 13, Fort Collins, Colorado, 80524, in consideration of one hundred and
fifty (5150)DOLLARS, and other good and valuable consideration, does hereby grant, bargain, sell
and convey to THE COUNTY OF WELD, a body corporate and politic of the State of
Colorado, by and through it's Board of County Commissioners, Grantee, a Temporary Easement
for use during construction of road and bridge improvements, together with all rights and privileges
as are necessary or incidental to the reasonable and proper use of such easement in and to, over,
under and across the tract of land described as follows:
See attached Exhibit "A", hereby made a part of the contract.
1. Said Temporary Easement shall commence on October 1, 2000, and shall expire and
be no further force or effect on May 1, 2001.
2. During the term of this Temporary Easement, Grantor shall not erect or construct, or
allow to be erected or constructed, any building or other structure which may interfere with Grantee's
full enjoyment of the rights hereunder.
3. As a condition of the granting of this Temporary Easement the Grantee covenants and
agrees to restore said lands, landscaping, fences, or other improvements to a level comparable to
their originals condition and to pay Grantor the cost to reimburse any loss to growing crops resulting
from the construction contemplated herein.
4. The parties hereto agree that neither has made or authorized any agreement with
respect to the subject matter of this instrument other than expressly set forth herein and no oral
representation, promise, or consideration different from the terms or employees, hereto.
5. Grantor warrants that it has full and lawful authority to make the grant hereinabove
contained, and promises and agrees to defend Grantee in the exercise of its rights hereunder against
airy defect in Owner's rights to make the grant hereinabove contained.
6. Whenever used herein, the singular number shall include the plural, the plural the
singular; and the use of any gender shall be applicable to all genders. All of the covenant, aerein
contained shall be binding upon and insure to the benefit of the parties hereto, their respective
personal representatives, successors and assigns.

9r, TEMPORARY CONSTRUCTION EASEMENT
KNOW ALL MEN BY THESE PRESENTS: That EUGENE F. SCHNEIDER, Grantor,
whose legal address is 41632 WCR 13, Fort Collins, Colorado 80524, in consideration of one
hundred and fifty ($150.00) DOLLARS, in hand paid, and other good and valuable consideration,
does hereby grant, bargain, sell and convey to THE COUNTY OF WELD, a body corporate and
politic of the State of Colorado, by and through it's Board of County Commissioners, Grantee,
a Temporary Easement for use during construction of road and bridge improvements, together with
all rights and privileges as are necessary or incidental to the reasonable and proper use o` such
easement in and to, over, under and across the tract of land described as follows:
See attached Exhibit "A", hereby made a part of the contract.
1. Said Temporary Easement shall commence on October 1, 2000, and shall expire and
be no further force or effect on May 31, 2001.
2. During the term of this Temporary Easement, Grantor shall not erect or construct, or
allow to be erected or constructed, any building or other structure which may interfere with Grantee's
full enjoyment of the rights hereunder.
3. As a condition of the granting of this Temporary Easement the Grantee covenants and
agrees to restore said lands, landscaping, fences, or other improvements to a level comparable to
their original condition and to pay Grantor the cost to reimburse any loss to growing crops resulting
from the construction contemplated herein.
4. The parties hereto agree that neither has made or authorized any agreement with
respect to the subject matter of this instrument other than expressly set forth herein and re oral
representation, promise, or consideration different from the terms or employees, hereto.
5. Grantor warrants that it has full and lawful authority to make the grant hereinabove
contained, and promises and agrees to defend Grantee in the exercise of its rights hereunder i. ainst
any defect in Owner's rights to make the grant hereinabove contained.
6. Whenever used herein, the singular number shall include the plural, the plural the
singular; and the use of any gender shall be applicable to all genders. All of the covenants herein
contained shall be binding upon and insure to the benefit of the parties hereto, their respective
personal representatives, successors and assigns.

COUNTY, COLORADO
TIES AGREEMENT is made this -3151— day of , 2000 by and
between Eugene F. Schneider,whose address is 41632 WCR 13, Fort ollins, CO 80524, hereinafter
referred to as "Owner," anti the County of Weld, a body corporate and politic of the State of
Colorado, by and through its Board of County Commissioners, hereinafter referred to as "County."
WITNESSETI I:
WHEREAS, County finds it necessary to rebuild and improve Weld County Road WCR;/
13 , which is Lorimer County Project No. 226, and
WHEREAS, Owners own the property described in the attached Exhibit "A", herein tiler
referred to collectively as "Right-of-Way" and
WHEREAS, County needs the Right-of-Way in order to complete said rebuilding and
improvement project, and
WHEREAS, said rebuilding and improvement project involves the construction of fudge,
and
WIIEREAS, Owners wish to cooperate with County in said road improvement.
NOW, TI1EREFORE, the parties herein agree as follows:
1. Owners agree to sell and County agrees to purchase the Right-of-Way shown and/or
described on Exhibit "A", attached hereto and hereinafter referred to herein u.t :he
"Right-of-Way" for the sum of one hundred ($100.00) dollars.
2. Owners agree to grant the Right-of-Way to County by Deed of Dedication, let and
clear of all encumbrances.
3. County agrees to pay the costs of title insurance and recording fees, if necessa as
determined by County.
4. The parties hereby agree that neither has made or authorized any agreement with
respect to the subject matter of this instrument other than expressly set forth herein,
and no oral representation, promise, or consideration different from the terms 1wHit
contained shall be binding on either party, or its agents or employees, hereto. I hi
Agreement embodies all agreements between the parties hereto and there trr� no
promises, terms, conditions, or obligations referring to the subject matter who I of

5. Although the date of the transfer of the Right-of-Way shall be the date of the delivt2r
of the documents of conveyance, it is c:pressly agreed by the 1mrties hereto that nlon
execution of this Agreement by County and Owners, County, its contractors, agents,
employees, and all others deemed necessary by County shall have the irrevoc able
right to possess and use all of the Right-of-Way for the purpose of said rebuildim;
and improvement project.
6. Owner warrants that he/she is the owner of the Right-of-Way and will defend t
thereto against all claims.

7. General taxes for the 2000 for the Right-of-Way shall be apportioned to the dare of
delivery of the deed based on the most recent levy and the most recent assessment.
Owner represent and warrants that all general taxes levied prior to such year have
been paid in full by Owner.
8. Other: Latimer County shall install CDOT Standard four-strand barbed wire I•ince
with metal posts along the property line from the existing loading chute south to the
Schneider property line. At owner's request I.arimerCounty will install up to two
16' wire gates in the new fence section.
IT IS MUTUALLY AGREED that the terms and conditions of this Agreement shall extend
to and be binding upon the heirs, executors, administrators, successors, and assigns of the respective
parties hereto.

WHEREAS, County needs the Right-of-Way in order to complete said rebuilding and
improvement project, and
WHEREAS, said rebuilding and improvement project involves the construction of a bridge,

WHEREAS, Owners wish to cooperate with County in said road improvement.
NOW, THEREFORE, the parties herein agree as follows:
1 . Owners agree to sell and County agrees to purchase the Right-of-Way described on
Exhibit "A", attached hereto and hereinafter referred to herein as the "Right-of-'Jr ay"
for the sum of two hundred and forty ($240.00) dollars.
2. Owners agree to grant the Right-of-Way to County by Deed of Dedication, tree and
clear of all encumbrances.
3. County agrees to pay the costs of title insurance and recording fees, if necessary as
determined by County.
4. The parties hereby agree that neither has made or authorized any agreement with
respect to the subject matter of this instrument other than expressly set forth herein,
and no oral representation, promise, or consideration different from the terms herein
contained shall be binding on either party, or its agents or employees, hereto. 'I his
Agreement embodies all agreements between the parties hereto and there we no
promises, terms, conditions, or obligations referring to the subject matter whereof
other than as contained herein.
