HomeMy WebLinkAbout20001894.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST PATRICIA STYSKAL FOR VIOLATION OF THE WELD COUNTY BUILDING AND ZONING ORDINANCE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Patricia Styskal, VI #0000089, and VI #0000185 is allegedly in violation of the Weld County Building and Zoning Ordinance, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 8th day of August, 2000, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Patricia Styskal, property owner, was present at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until October 8, 2000, to allow adequate time for the property owners to bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. When I mentioned that the R.V. looked new, she started rambeling about her attorney handling some law suit regarding a ditch company. Then when I asked her the attorney's name (so I could mail him a copy of the violation as well), she couldn't remember his name. Then she said that she was only temporarly living in the R.V.. When I asked her a general time frame, she couldn't give me an answer. There is a primary dwelling unit (house) 2.) A R.V. out back (the owner lives in) 3.) A Camper/Trailer on the South side (hooked up to at least electric) The owner in the R.V. stated that she was temporarly living there. She changed her stories several times (see Description Section dated 05/24/00). 07/24/2000 By: BJS Action: INSP Comments: Upon a visual inspection of the property the following notations and events took place: I met Ms. Styskal and her son on the site. Ms. Styskal stated that she had removed all connections to the R.V. except for the electric because she had food in the refridgerator. She stated that the R.V. would be completely unhooked within a week (at the most 1 week). She then took me into the second dwelling unit (original complaint 3 dwelling units). She stated that even though the structure appeared to be a converted garage into a house that it was indeed a house partially converted into a garage. She stated that the building had been their since 1965 making it a "Nonconforming Use". I informed her that I would check with the Assessor's Office to see how the taxes had been paid. She then quickly back-tracked and stated that she was sure the Assessor's records would be incorrect. Then one of them stated that the previous owners used the structure as a "dog kennel" then they converted it into an "office". She stated that she did not realize that she needed any sort of permits to remodel any of the inside. She stated that she would be living in the remodeled garage until her tenants moved out of the house. She still wants to keep the garage/secondary dwelling unit for renting purposes. I informed her of her hearing date in front of the Beard of County Commissioners on August 8, 2000 @ 10:00 a.m. and gave her directions on how to get there.. 1 wrote the hearing date down for her and told her that she would also be receiving a letter certified in the mail shortly with more specifics. It has come to our attention that the second housing unit on your property is in violation of Weld County Codes and that it will need to be vacated and a building permit issued to meet Code. As such, we are writing to inform you that we will continue to bill for two units until such time as we receive written notice that the second unit has been vacated. In addition, under the Town's codes, we require separate water and sewer taps and service lines be installed to each habitable building on a site. Consequently, should a Weld County building permit be issued for the second residential unit, we will require that new water and sewer taps be installed to the second building prior to occupancy. In addition, in reviewing the record of past billings, the Town historically billed for water and sewer at the out of town rates until last September when the water rate was erroneously changed to the in-town rate ($20.00/mo). In addition, in reviewing the record of past billings, the Town historically billed for water and sewer at the out of town rates until last September when the water rate was erroneously changed to the in-town rate ($20.00/mo). It has come to our attention that the second housing unit on your property is in violation of Weld County Codes and that it will need to be vacated and a building permit issued to meet Code. As such, we are writing to inform you that we will continue to bill for two units until such time as we receive written notice that the second unit has been vacated. In addition, under the Town's codes, we require separate water and sewer taps and service lines be installed to each habitable building on a site. Consequently, should a Weld County building permit be issued for the second residential unit we will require that new water and sewer taps be installed to the second building prior to occupancy.
