HomeMy WebLinkAbout20001907.tiff HEARING CERTIFICATION DOCKET NO. 2000-37 RE: CHANGE OF ZONE #545 FROM THE A (AGRICULTURAL) ZONE DISTRICT TO A PUD (PLANNED UNIT DEVELOPMENT) ZONE DISTRICT - HARVEY AND JEAN MARKHAM A public hearing was conducted on August 9, 2000, at 10:00 a.m., with the following present: Commissioner Barbara J. Kirkmeyer, Chair Commissioner M. J. Geile, Pro-Tem Commissioner George E. Baxter - EXCUSED Commissioner Dale K. Hall Commissioner Glenn Vaad Also present: Acting Clerk to the Board, Esther Gesick County Attorney, Bruce Barker Planning Department representative, Chris Gathman Health Department representative, Pam Smith Public Works representative, Diane Houghtaling The following business was transacted: I hereby certify that pursuant to a notice dated July 17, 2000, and duly published July 20, 2000, in the South Weld Sun, a public hearing was conducted to consider the request of Harvey and Jean Markham for Change of Zone#545 from the A (Agricultural)Zone District to a PUD (Planned Unit Development) Zone District for residential (Estate) uses on 15 acres, with three acres of open space. Bruce Barker, County Attorney, made this a matter of record. Chris Gathman, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Mr. Gathman stated if approved, the site will be serviced by the Little Thompson Water District and individual septic systems, and will be zoned E (Estate)with residential uses. Mr. Gathman stated there are existing outbuildings and a residence on Lot 1, three structures are located either partially or completely within the right-of-way for Highway 56 which will be removed from the right-of-way boundaries. Mr. Gathman stated 13 referrals were sent and 11 referral agencies submitted comments or proposed Conditions of Approval. He reviewed staffs recommendation for approval as outlined in his Administrative Recommendation,marked Exhibit 2. Mr.Gathman requested Condition of Approval #3.D be amended to change the referral date from December 28, 1999,to June 21, 2000,to reflect the most recent response from CDOT, and he submitted a memorandum, marked Exhibit G, requesting Condition of Approval #4.C be amended. In response to Commissioner Geile, Mr. Gathman stated the applicant has not submitted formal covenants for the development to determine who will be responsible for maintaining and plowing the internal roads. He further stated Condition of Approval#2.B was submitted by the Department of Building Inspection and either staff or an engineer will determine the adequacy of the foundation and compaction. Responding further to Commissioner Geile, Mr. Gathman stated the proposed landscaping as detailed in the application materials appears to be adequate; however,the applicant will still be required to submit a formal Landscaping Plan in accordance with Condition of Approval #2.A.8. In response to Commissioner Vaad, Mr. Gathman stated there are several structures within the right-of-way, and Diane Houghtaling, Department of Public Works, stated there is also a silo that is within the site distance at the entrance/exit of the site. ce.' g[/ )12 (E/9) b/w 2000-1907 PL1424 HEARING CERTIFICATION - HARVEY AND JEAN MARKHAM (COZ#545) PAGE 2 Harvey Markham, applicant, stated he feels this proposal is consistent with the surrounding area, he will provide the necessary landscaping, and move any of the buildings or structures that staff feels is necessary. In response to Commissioner Vaad, Mr. Markham stated he has not measured the distance of the silo, but if it is a problem for the site distance he will remove it. Responding to Commissioner Geile, Mr. Markham stated snow removal has not yet been addressed, but he anticipates it will be a responsibility of the Homeowner's Association. He further stated they may request the road be taken by the County for maintenance. Chair Kirkmeyer commented it is not a certainty that the road will be accepted for maintenance by the County and Commissioner Geile requested the road maintenance be clearly delineated in the Covenants. No public testimony was offered concerning this matter. In response to Chair Nirkmeyer, Mr. Markham stated he has reviewed and agrees with the Conditions of Approval. In response to Commissioner Vaad, Mr. Markham stated by the time he is ready to purchase water taps, it is estimated the cost will have risen to $17,000.00 per tap. Commissioner Vaad moved to approve the request of Harvey and Jean Markham for Change of Zone #545 from the A (Agricultural) Zone District to a PUD (Planned Unit Development) Zone District for residential (Estate) uses on 15 acres, with three acres of open space, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record with changes to Conditions of Approval #3.D and #4.C as recommended by staff. The motion was seconded by Commissioner Hall, and it carried unanimously. Mr. Gathman stated this is a conceptual plan and the Final Plan will need to be reviewed by the Board. This Certification was approved on the 14th day of August 2000.
