HomeMy WebLinkAbout20000441.tiff RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO FEBRUARY 16, 2000 TAPE #2000-06 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Centennial Center, Greeley, Colorado, February 16, 2000, at the hour of 9:00 a.m. ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Barbara J. Kirkmeyer, Chair Commissioner M. J. Geile, Pro-Tem Commissioner George E. Baxter Commissioner Dale K. Hall Commissioner Glenn Vaad Also present: County Attorney, Bruce T. Barker Acting Clerk to the Board, Esther E. Gesick Director of Finance and Administration, Donald D. Warden MINUTES: Commissioner Hall moved to approve the minutes of the Board of County Commissioners meeting of February 14, 2000, as printed. Commissioner Vaad seconded the motion, and it carried unanimously. ADDITIONS TO AGENDA: There were no additions to the agenda. CONSENT AGENDA: Commissioner Baxter moved to approve the consent agenda as printed. Commissioner Geile seconded the motion, and it carried unanimously. PRESENTATIONS: RECOGNITION OF SERVICES -AREA AGENCY ON AGING ADVISORY BOARD, JUDY YAMAGUCHI, MARY FOX, AND MARY ELLEN FAULES: Chair Kirkmeyer read the certificate recognizing Judy Yamaguchi for four years of service on the Area Agency on Aging Advisory Board. Chair Kirkmeyer also read the certificates recognizing Mary Fox and Mary Ellen Faules,who were not present, for their services. RECOGNITION OF SERVICES - NORTH COLORADO MEDICAL CENTER BOARD OF TRUSTEES, DON CUMMINS: Chair Kirkmeyer read the certificate into the record recognizing Don Cummins, who was not present, for six years of service on the North Colorado Medical Center Board of Trustees. COMMISSIONER COORDINATOR REPORTS: There were no Commissioner Coordinator Reports. ale 4 2000-0441 //+�-r" BC0016 PUBLIC INPUT: Norman Nash, Weld County resident, stated previously the Board declined to join in a petition in favor of the Cherry Avenue Annexation petition; however, the developer is now proposing the Balsam Village Second and Cherrywood Annexations. Mr. Nash presented a petition, marked Exhibit A, signed by 72 surrounding property owners opposed to the development and he asked that the Board take a public position of opposition to this development. Mr. Nash stated the neighborhood is almost unanimously opposed to the proposal; he submitted an aerial photograph of the area, marked Exhibit B; and explained the current annexation proposal. Mr. Nash presented a map, marked Exhibit C, showing the Balsam Village Second and Cherrywood Annexations and explained a portion of the Balsam Village Second Annexation will be attached to East 20th Street to achieve 1/6 contiguity with the city limits. Mr. Nash stated the City of Greeley is proposing that East 20th Street be widened from the existing 20 feet to 70 feet, which will impact the adjacent property owners. Mr. Nash submitted four photographs, marked Exhibit D, showing a person standing on various properties indicating approximately where the new curb and gutter will be placed if the annexation is approved. He stated the developer initially proposed 325-400 units consisting of single family units and duplexes,which is high-density and not compatible with the area. Mr. Nash stated the area between the Balsam Village Second Annexation and Cherrywood Annexation is part of Weld County and is not likely to be annexed, which will be almost completely surrounded by the City. Mr. Nash reiterated that it would be helpful if the County would take a public stand opposing this proposal, and stated the City Planning Commission will meet on February 22, 2000,to receive public input, and the City Council will make a decision on April 4, 2000. In response to Commissioner Hall, Mr. Nash stated he and more surrounding property owners plan to attend the City Planning Commission and City Council meetings. In response to Chair Kirkmeyer, Mr. Nash gave his name, address, and phone number for the record. Mr. Nash stated the City is attempting to annex all of East 20th Street and widen it. Mark Peterson, St. Vrain Sanitation District manager, stated he is available to answer any questions regarding the intentions,capabilities,and policies of the District in relation to the RiverDance Development. WARRANTS: Donald Warden, Director of Finance and Administration, presented the following warrants for approval by the Board: All Funds $132,174.75 Commissioner Hall moved to approve the warrants as presented by Mr. Warden. Commissioner Baxter seconded the motion, which carried unanimously. BIDS: PRESENT BODY FOR 3-TON LUBE TRUCK BID - MOTOR POOL: Mr. Pat Persichino, Director of General Services, presented the four bids received. Said bids will be considered for approval on Wednesday, March 1, 2000. APPROVE OFFICE SUPPLIES BID-PRINTING AND SUPPLY DEPARTMENT: Mr. Persichino stated the Printing and Supply Department recommends approval of the low bids from Quill Corporation, Nelson Office Supply, Corporate Express, and Bratton's Office City for various items as indicated in a memorandum dated February 8, 2000, from Edna Mata, Copy/Supply/Mail Supervisor. Commissioner Baxter moved to approve said bid as recommended by staff. Seconded by Commissioner Geile, the motion carried unanimously. NEW BUSINESS: CONSIDER APPOINTMENTS AND REAPPOINTMENTS TO LONG TERM CARE BIO-ETHICS COMMITTEE:Commissioner Hall moved to appoint Kerrie Cargill-Hitchcock,Judi DeVore, Kathy Gardner, Ann Lundquist, and Stephanie McCune to the Long Term Care Bio-Ethics Committee, with their terms to expire January 1, 2003; appoint James Utzinger and Elizabeth Schwicker to said committee, with their Minutes, February 16, 2000 2000-0441 Page 2 BC0016 terms to expire January 1, 2001; appoint Jayne Southard, Cherrie Thornton, and Bonnie Wacker to said committee, with their terms to expire January 1, 2002; and reappoint Milberrn Goetz and Charles Connell to said board, with their terms to expire January 1, 2003. Seconded by Commissioner Geile, the motion carried unanimously. PLANNING: CONSIDER IMPROVEMENTS AGREEMENT ACCORDING TO POLICY REGARDING COLLATERAL FOR IMPROVEMENTS, ACCEPT COLLATERAL, AND AUTHORIZE CHAIR TO SIGN - T.S. SKYWAY, LLC, THE SKYWAY COMMERCIAL CENTER, SPR #314: Monica Mika, Director of Planning Services, stated Site Plan Review#314 was approved by staff on January 7, 2000. The Improvements Agreement According to Policy Regarding Collateral for Improvements, and Irrevocable Letter of Credit#383, in the amount of $223,911.00, have been reviewed by the Departments of Planning Services, Public Works, Public Health and Environment, and the County Attorney's Office, all of which recommend approval. Commissioner Vaad moved to approve said agreement, accept said collateral, and authorize the Chair to sign. Seconded by Commissioner Baxter, the motion carried unanimously. CONSIDER DECISION REGARDING CHANGE OF ZONE #528 FROM A (AGRICULTURAL) ZONE DISTRICT TO PUD (PLANNED UNIT DEVELOPMENT) DISTRICT FOR 600-800 LOTS WITH RESIDENTIAL AND COMMERCIAL USES, SIEGRIST COMPANIES, C/O TUTTLE APPLEGATE, INC. (FROM 01/26/2000): Chair Kirkmeyer stated this is not a public hearing, and ascertained Commissioner Baxter reviewed the tape of the hearing held on January 26, 2000. She stated the motion was made to deny the application of Siegrist Companies, do Tuttle Applegate,for Change of Zone#528. Commissioner Baxter stated he carefully listened to the tapes, and he understands the issues and answers given during the hearing. He also stated he had a copy of the Hearing Certification available which gave the comments from the other Commissioners, and verified he has not discussed the case with anyone, nor does anyone know his decision. Commissioner Baxter stated that, although the development is very well planned and in a beautiful area, he has some concerns. He commented that his main concerns include the extreme density of the development, which is between 4.3 units per acre to 8 units per acre. Comparing this development to a Minor Subdivision next to a municipality, it would be equal to approving 100 Minor Subdivisions, or 150 additional units, and he cited UBG.Goal 2, regarding concentrating urban development in the Mixed Use Development Area and providing an official designation between future urban and non-urban uses as reasons for his decision. Commissioner Baxter commented on the magnitude of the development and huge amount of investment for the property owner/developer, stating property rights are important, as well as the ability of individuals to use their property as they desire. However, PUD.Goal 3 and R.Policy 3 require adequate public services and facilities be available with efficient and cost-effective delivery to the proposed development. Commissioner Baxter stated this development would have a huge impact on agriculture, which the Board strives to preserve, and even though prime farmland is not being taken out of production,the purchase of the large quantity of raw water would force the price of water up and make it unavailable for agricultural uses. He also stated concerns regarding the large number of sewer system taps, and having the appearance of pushing for expansion of the St. Vrain facilities. He stated surrounding farm uses would be partially protected by the Right to Farm Covenant, but the high density would create even bigger problems and exacerbate urban/non-urban problems. He further stated the Department of Public Work issues, which would be diminished through monies generated with impact fees; however, issues would remain regarding State Highway 66 and the 1-25 Frontage Road, and the impact on the school district. He explained although the required formula amount is paid, the total taxes and state money would only cover the operating expenses of the schools, and with nothing set aside to build more schools, a bond issue would be required in the future, considering as many as 600 students would be added from the development. Commissioner Baxter stated the Comprehensive Plan requires the Board to look at the location, but also at the impact and magnitude of the development; and the impact to the County for dollars in the law enforcement area. Therefore, Commissioner Baxter stated he is in favor of the motion to deny. Chair Kirkmeyer declared the motion Minutes, February 16, 2000 2000-0441 Page 3 BC0016 passed on a vote of three to two, with Commissioners Hall, Baxter, and Kirkmeyer in favor, and Commissioners Geile and Vaad opposed. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the consent agenda. No Ordinances were approved. We have lived in this community for only a year. However, we have grown to love our neighborhood and all of the qualities it offers . It is a peaceful area and our five acres provide space for recreation and our livestock. The neighborhood is small enough to enjoy knowing our neighbors yet large enough for all of us to have some elbow room. Our concerns regarding this annexation are countless . Our property extends to the center line of East 20th Street. Prospective Cherrywood, which is soon to follow the annexation, is almost certainly going to require widening East 20th. This would eliminate nearly half of our corral , four large trees which have been standing since 1946 , a row of lilac bushes, and require moving our irrigation ditches underground. Part of the charm of our property lies within the things listed. As previously mentioned, our corral stands very close to the road. Excess roadway traffic and sidewalk traffic present a safety concern for our horses and the passersby. The prospective Cherrywood will place nine houses on our fenceline. Our hay crop is dormant during winter months and our horses will be turned out to pasture graze. A down fence, however cause, could place loose livestock in a residential area. The liability involved is scary to think about. After attending a PTA meeting at East Memorial Elementary in the fall , I became aware of how the growth of surrounding areas is already affecting our school district. They have changed boundaries to absorb some of the overflow. Unfortunately, they are still over capacity. If the proposal was to build homes on three to five acre parcels of land, not creating the necessity to widen East 20th or the expectation of several too many children in our already overcrowded school district, our neighborhood could still exist as it is . A quiet, safe environment with room to stretch your arms . The prospective Cherrywood is just not compatible. It would mean jumping from city homes to country homes to city homes . It seems so haphazard. Our request to you is to decline the proposal at hand until a better thought out plan is presented. I currently own the property located at 1308 E 20 Street and am opposed to this annexation. I feel that the proposed development is not compatible with the present community and surrounding area. Currently the properties include agricultural and small acreage's, with animal and farming activities. The proposed development is to include homes designated to have the highest price in the 130's with the majority being less than that. A development of this sort will weight this area rather than balance housing values. Low income and low priced housing already exists between First Avenue and Cherry, there are trailer parks, Migrant Housing, low income apartments and new low range houses in the subdivisions surrounding East Memorial School. Annexation would bring increased traffic, noise and light pollution and decreased safety on the roads as well as a probable decrease in property value. As a property owner I object to the cost of adjusting my property for roadways and easements. My property will remain outside of the city limits but as I understand it I will have to pay to adjust my property if the road were to be widened when annexed into the city. I purchased this property because it provided a safe country atmosphere with quiet surroundings annexation would drastically change this setting. I urge you to consider the position of property owners in the area who have chosen not only a home but a lifestyle as well. Greeley is growing and I understand the need for moderate housing but I also understand the need for open space and agriculture in this community. Growth in Greeley has mushroomed in the last two to three years. Expansion is in all directions. Annexations and subdivisions in the area between First Avenue and Cherry Avenue and between 2oth Street and 24th Street have occurred in the last year and one half with incredible speed. The area around East Memorial School has quickly changed, with the large increase in single family "affordable" homes absorbing open land and farms. Up to this point it seems that the progression of building, though fast and impacting, is "natural", in the sense that one is connected to another and fitting to the setting. Present attempts to extend the subdivisions, however, are bringing about serious questions involving legal intent, flagpoling and hopscotch planning and concerning neighborhood compatibility and diversity. There is question as to whether or not such action is reasonable and orderly.. This fall there was request for annexation of Cherry Ave. in order to connect Cherrywood to the city for development. It was deemed a flagpole annexation and turned down. The present annexation request is a response to that refusal. Using creative engineering and a tortured view of the law, the developer claims it now is not a flag pole annexation. Although legal description , as it has been described, is not deemed flag poling, the visual, graphic picture actually looks like a flagpole! Balsam Village appears as a base, 20th Street the pole , and Cherrywood quite a ways down the street is the flag. In order for the subdivision to extend to the "flag", 20th Street has to be annexed and the long term, established residents all along the "pole" imposed upon, twenty five feet of their front yards and property becoming disposable. The intent of the law in reference appears to be to prohibit such destructive expansion, not support it. Reasonable and orderly growth is part of city planning guidelines. There are many questions concerning these issues around this annexation proposal. First is hopscotch building orderly? Does orderly growth include considerations of density, balance and diversity in a community? Does orderly growth include recognition and respect for established communities that are directly impacted by that growth? Does orderly and reasonable growth include concern for public works, schools, safety and environmental issues? Presently East Memorial School is surrounded by new subdivisions, all high density"affordable" home communities, there are three trailer parks, subsidized apartments, migrant apartments and three more large areas of ground cleared and OK'd for high density single family homes and modulars. A true need for these types of homes is being met. The need for expansion of high density home subdivisions in the area is at question. It would seem more reasonable to have a variety of homes available, for example, the extension of small acreages. Variety can find itself through thoughtful awareness of the need for balance and diversity in all areas of Grtptjeliminating " pockets" that draw lines between people. In recognizing that need, finding a way that growth can be positive and compatible with existing communities should be given precedence. Without that precedence progress is more like throwing last years "Velveteen Rabbit" in the trash to make room for the new one. We are all of value. It is diverse in age, income, ethnic background, vocation and space. The community is caring and integrated. It has been here growing and sharing for many years. New members are just as important as old...and old just as important as new. Shouldn't city planning consider such an example as valuable? Communities should have a working relationship with developers, rather than having development happen to them. It does feel invasive. It is frightening. My husband and I bought our house 20 years ago. It was built in 1905, truly a homestead house. The trees around our house were established then as well. The farmer had no thought of subdivisions at the time. We have revived a wonderful piece of Grr/. heritage. Our house is our home, it has memories and feelings in its walls.. Imagine waking up to find the front yard gone, the wise old trees and all the life they hold cut down with a road full of traffic in its place. Imagine all of this happening without choice. I know this has happened to people, is happening to people, but is it right action? Is it reasonable and orderly city growth? Is it really legal? The proposed annexation does not seem to be thoughtful, orderly or reasonable. The annexation is questionable legally. The annexation does not take into account diversity and compatibility with present residents. The annexation does not take the present residents into account. We moved to Cherry Ave. because of the rural setting the east had to offer. We paid the higher price for a home on a small acreage because we love living in the rural areas. I feel that this is an illegal annexation and that Cherrywood is not a compatible project for this area. Annexation would bring increased noise,traffic, and decreased safety that our family enjoys in this area. We enjoy country atmosphere,close community friendships and support systems in a quiet and safe environment. We have a wonderful community out here. There is no reason to bring the city into our community. My other concern, being a mother of 3 school age children, is the over crowding that this project will cause for East Memorial. I attend the monthly meetings at this school and know the problems we,as parents and teachers,are faced with,with just Balsam going in. East Memorial is only 45 students shy of being over crowded now. What will happen with over 300 more homes in this area? I have live in this house since 1944. 100- year-old cottonwood trees surround our house. There is a row of these trees along the front of the property. There is also an irrigation ditch along the front. The tree are home to many varieties of birds that nest in them, including screech owls, goldfinches, downy woodpeckers, and many others. The high-density subdivisions that surround East Memorial School are changing the area from small acreage's to houses with no room for even a pen of rabbits. If the Cherrywood subdivision is annexed it will cause a great increase in traffic on East 20th St. and many result in widening it. This would result in destroying many of our old trees, and destroy the wild life that lives in them. It would also destroy our irrigation system and take much of the shade from the south side of the yard. I would like to see the present country atmosphere preserved. The people who live in this area are here because they wanted to get away from mass population living. The rural setting gives them the quieter life where they can have some livestock and a garden on acreage. There is already enough of the lower income housing between 1st Ave and Cherry Ave, including trailer parks, low cost housing, migrant housing and low income apartments. I find it increasingly difficult to contain my anger and frus- tration over the fact that a handful of people who don ' t live in this area have the power by the simple stroke of a pen to forever alter a community with diverse interest by increasing the traffic on 20th Street a hundredfold, by obviously impact- ing East Elementary School , the only elementary school in this area , and forever destroying a way of life for an entire com- munity . TO WHOM IT MAY CONCERN: MY NAME IS NANCY STITT. My husband,Ron and I own a home at 1223 East 20th St.We have lived at this address for 11 years. We purchased the home because it was out of town and in a smaller community. Like myself and my husband,I am sure the same is to be said for other neighbors. The proposal to build a housing development nearby would mean the end of that small community. They are proposing to come down E20th St,which is ludicrous to say the least,we are all going to lose our front yards,for what,so we can have a new housing development? We like most of our neighbors are in the age group that we plan on staying in our present homes,why is it someone can come in,tear up our yards,disturb the whole area? What rights as homeowners do we have? If we wanted high volume traffic,crowded neighborhoods we would have chose to live elsewhere. Has anyone stopped to realize the value of our homes are going to decrease,or does anyone care?I am curious as to finding the need for this housing development,you can drive down East 20th St now and see housing developments that have vacancies with weeds growing half as high as the houses,what is the need to build more? Aside from the stated reasons above you must look at the issue of education.East Memorial school is already overcrowded and adding another development would make this problem larger,I would hope that someone would stop to take that into consideration. At what profit do you make a decision to impact education, property values,lifestyles,noise and pollution? It is very important to us as a community to be able to remain small,and close knit with open spaces surrounding us,and to retain a quiet and safe community for generations to come. Apparently the "creative surveying"is legal, but I oppose this type of surveying to accomplish the developers goal. The residents have enjoyed a life style conducive to country living, agricultural and small acreages. The residents and families at this time can ride bikes, walk, ride horses, have their 4-H projects, and enjoy our present life style.This will end if this development is approved. Our area is overweighted with"affordable housing"and there is still acres to be developed. The Miller Farm, the land on 24th St. to Cherry Ave. (modulars), Balsam Village 2n° addition - 30 acres and 10 acres east of the Meadow mobile home park. We have 425 mobile homes from 20th St. to 24th St., migrant housing, low income, Delta apartments and etc. We have the School District 6 school buses in this area and it was indicated they moved because of air pollution in the City of Greeley. My understanding is when the airport is completed the planes will be flying over Fern Ave. either coming in or taking off. This is another negative for our area. During the informational meeting a question was asked concerning over-crowding of the school. The answer was"this is not the issue and the school district would need to address this". I disagree with this statement, as everyone should be concerned on this issue. To sum up my objections, it will be difficult to live with 300 plus homes and the mini-mart being proposed. I hope you will consider what this annexation will do to our current residents, many who have lived here for many, many years. You are also aware of the overwhelming opposition to this. We have tried to objectively analyze all the ramifications of these annexations and we respectfully ask that you take into consideration the following: 1. We have lived at 1125 E. 20th Street since 1986 and we received absolutely no notification of these proposed annexations. It is our understanding that the developer is required to provide the City with a list of property owners and the City then notifies us of pending development issues. We asked to see the developer's list and our names were not on the list. 2. This past fall we also purchased 1121 and 1123 E. 20th Street and, again, received no notification of any pending annexations at either of those addresses. 3. We are basically 'farm kids' and we purchased our home because of the quiet, 'rural' setting. 4. The Balsam Village Second Annexation seems logical and definitely borders the Greeley City Limits and we have no problem with that annexation, although it would have been nice to have been notified prior to the development of that area 5. We are hard-pressed to understand how the Cherrywood Annexation could fit into our 'rural' neighborhood. 6. We are also hard-pressed to understand how the Cherrywood boundaries could be considered 'contiguous' to the Greeley city limits. 7. We question how using 20 Street to make Cherrywood 'contiguous' will affect our front yard and our quiet neighborhood. Is that even legal?? 8. We are very concerned about the increase in traffic on East 20"' Street that would surely result if Cherrywood were annexed as the developer has proposed with 282 dwellings. If the average home has 2.5 residents that results in an influx of 705 people onto about 100 acres! 9. East 20th Street is a narrow two-lane street that is not suitable for the volume of traffic the Cherrywood annexation would likely generate. 10. We would not be opposed to the development if single family dwellings on 2 or 3 acre sites were proposed. 11. We see in the developer's plan lots of houses and very little green space. Areas for parks and schools should be high priorities. 12. Linn Grove Cemetery could also be adversely affected by increased area traffic. We would hope that Linn Grove never becomes the nightmare that Sunset Memorial Gardens has become. We recently went to a funeral at FEB 17 '00 09:42AM WELD COUNTY DIST 6 P.2/2 Sunset and the noise from traffic zooming by made it impossible to hear most of the minister's words. Not very comforting for grieving families. We hear all over the state about careful planning for growth and we realize that growth will eventually come our way but we respectfully ask you to study this proposed annexation and plan carefully to preserve the established nature of our neighborhood.
