Vehicle Sales Yard Lot 12, Block 2 Rademacher Business Park PUD Collateral for K & C RV, Inc. Ogle provided Morrison with documentation on August 4, 2000, from John G. Canny, attorney for the applicant, specific to this project outlinging K& C RV, Inc., intentions. Letter is dated August 2, 2000. Ogle spoke with Don Carroll, Department of Public Works regarding the Collateral for Improvements for the above referenced site. Ogle noted that applicant's representative is willing to set aside ten thousand dollars ($10,000.00)for landscape improvements but no monies for the on-site grading, paving, drainage and retention facilities. Carroll is concerned with setting this precedence. Ogle and Carroll are seeking legal advice on how to proceed with the applicant's request of providing monies only for landscaping and not addressing the other elements of the site. In other words, if they never build the lot , the use would not occur. This argument might not apply to the drainage facilities since they are accessory to the use of the lot. I was surprised that it went through with the entire collateral instead of just the landscaping as I expected them to propose to the Board only the landscaping but I saw no problem since it was greater collateral than expected. I would not oppose them asking for an amendment to reduce the collateral by the amount of the paving and grading. The drainage is less clear cut and Don's concerns should be highlighted to the Board Bottom line is-the Board is the entity empowered to make this kind of decision and Staff needs to highlight the issues that are outside the normal procedures. I have spoken with Lee Morrison,at the Weld County Attorney's Office, and he agrees that it makes sense to have the agreement cover only the landscaping because (a) of the conditions of paragraph 5(a)the Site Plan Review document dated February 7, 2000, and(b)because the paving is not meant to be a public improvement,but rather a private improvement, and the County's policy doesn't require collateralizing private improvements. In other words, no collateral is required for the K& C RV, Inc. service building, which is being erected on the adjacent property. Therefore, it doesn't make sense that the paving, which is equivalent to the building in this frame of reference, should be collateralized. In other words, if they never build the lot , the use would not occur. This argument might not apply to the drainage facilities since they are accessory to the use of the lot. I was surprised that it went through with the entire collateral instead of just the landscaping as I expected them to propose to the Board only the landscaping but I saw no problem since it was greater collateral than expected. I would not oppose them asking for an amendment to reduce the collateral by the amount of the paving and grading. The drainage is less clear cut and Don's concerns should be highlighted to the Board Bottom line is- the Board is the entity empowered to make this kind of decision and Staff needs to highlight the issues that are outside the normal procedures. Unbeknownst to me Ken Williamson had signed the copy of the proposed agreement which had been provided to him by his engineer, J.L. Walter back in February. If you will recall you and I talked after that about the requirement of collateral for the whole amount of the project, i.e. $271.565. My client's position was and remains that the only public improvements requested by the county are the additional landscaping and that is the only amount which should be collateralized. To that end I have prepared an Agreement to that effect that has been saved on my computer. In the meantime, however, you may recall I called and talked to you about this subject and told you that my client was postponing, for the time being, the project and wished to put the file on hold. In addition at your suggestion I talked to Mr. Morris at the county attorney's office and he agreed with our position and the next day John Yarberry, Vice President of Norwest bank in Boulder prepared and delivered a $10,000 letter of credit, a copy of which is enclosed. Finally, my client has decided to proceed with the project and that is reflected on the new Exhibit "13" on the newly printed out form of the Agreement which I had redrafted. As you should be aware, a building permit has already been issued for this project and my client has indicated that he is intending to proceed with the project next month. If you have any continuing problems with this please let me know, otherwise we will assume that the matter is now resolved and expect to receive back from you a signed copy of the Landscaping Improvement Agreement.
