HomeMy WebLinkAbout20001877 RESOLUTION RE: GRANT MOBILE HOME PERMIT, ZPMH #2201 - FAY AND BETTY MAVITY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, on the 7th day of August 2000, considered the request of Fay and Betty Mavity, 15165 Mary Avenue, Fort Lupton, Colorado 80621, fora mobile home located at 15205 Mary Avenue, Aristocrat Ranchettes, to be used as a Medical Hardship, and WHEREAS, said mobile home is to be occupied in the A (Agricultural) Zone District on a parcel of land being more particularly described as follows: Lot 8, Block 30, Aristocrat Ranchettes, Second Filing; located in Section 27, Township 2 North, Range 66 West of the 6th P.M., Weld County, Colorado WHEREAS, the Board of County Commissioners, having heard all of the testimony, finds that said request should be granted subject to the following conditions: 1. The applicant shall apply for a building permit for the mobile home prior to locating the mobile home on the property. 2. Prior to the occupancy of the mobile home, the mobile home shall he connected to an approved septic system and a legal water supply. 3. The mobile home shall meet the minimum setback and offset requirements for the A (Agricultural) Zone District. 4. The mobile home shall not be occupied until such time that the applicant has complied with Conditions 1 through 3 as stated above. 5. The applicant shall remove from the site, the mobile home currently being used for an accessory structure. Such removal shall occur within 90 days of the approval of the Weld County Board of Commissioners. 6. In accordance with Section 43.2.4.3 of the Weld County Zoning Ordinance, all zoning permits for mobile homes for use during a medical hardship are temporary and are subject to review annually on the anniversary of the original permit's issuance. The applicant shall submit documentation to the Department of Planning Services by August 1st of each year describing the status of the medical hardship, and the persons caring for the applicant. This permit shall terminate once the medical hardship ceases to exist, at which time the applicant shall have thirty (30) days to remove the mobile home from the property. 2000-1877 e: • NI RU f/L PL1430 ZPMH #2201 - FAY AND BETTY MAVITY PAGE 2 7. Harold Street within Aristocrat Ranchettes is designated on the Transportation Plan Map as a subdivision gravel road, which requires a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of setback in the Weld County Zoning Ordinance (Ordinance 89), the required setback is measured from the future right-of-way line. 8. The temporary access shall be placed in such a location to have adequate sight distance in both directions and not below the crest of a hill or where physical obstructions are present. 9. Derelict manufactured (mobile) home: a manufactured (mobile) home that is partially or totally damaged by fire, earthquake, wind, or other natural causes, or is in a state of general dilapidation, deterioration, or decay resulting from improper lack of maintenance, vandalism, or infestation with vermin or rodents. Any such derelict manufactured (mobile) home shall be returned to and maintained in the condition as originally established on site and as inspected by the Weld County Building Inspection Department, or it shall be removed from the site. 10. Noncommercial junkyard: An area where any waste, junk, or used or secord hand materials are stored or handled, including, but not limited to scrap iron and other metals, paper, rags, rubber tires, building materials, and bottles. A noncommercial junkyard may also include the storage or keeping of derelict vehicles. The noncommercial junkyard shall be totally enclosed within a building or structure or visually screened from all adjacent properties and public rights-of- way. 11. Pursuant to Ordinance #169-A, if noxious weeds exist on the property, or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds. 12. The applicant shall maintain compliance with section 43.2.4 of the Weld County Zoning Ordinance at all times. Lupton, CO 80621 REQUEST: This is a request for a Mobile Home to be used as a Temporary Use During a Medical Hardship. LEGAL DESCRIPTION: Lot 8, Block 30, Aristocrat Ranchettes, located in Section 27,T2N, R66W of the 6th P.M., Weld County, Colorado. PARCEL NUMBER: 1309 27 219005 PARCEL SIZE: 1 acre ZONE DISTRICT: Agricultural WATER SOURCE: Cistern SEWER SOURCE: Septic system The Department of Planning Services' staff has reviewed this request and recommends that this request be denied based on the following concerns: 1 It is the opinion of the Department of Planning Services' staff that the applicant has not shown compliance with Section 43.2.4 of the Weld County Zoning Ordinance, as follows: a. Section 43.2.4.1.1 A medical hardship exists in which the person to be living in the MOBILE HOME requires the supervision and care of those persons residing in the principal DWELLING UNIT on the property(or the reverse). Documentation of the medical hardship shall be established in a letter from the subject's medical doctor or other evidence deemed suitable by the Department of Planning Services. The letter shall be submitted as a part of the zoning permit application and shall verify that the subject is physically impaired and requires full-time care. Although there is a letter from a Doctor stating that Jackie Gorman has a medical condition, there has been inconsistencies on who will be caring for Jackie Gorman. The Doctor's letter's indicates that Betty Mavity will be caring for Ms. Gorman, as she has been, not the occupant of the mobile home under consideration. b. Section 43.2.4.1.2 There is no reasonable alternative available to the applicant for the care of a person who needs medical supervision. There is reasonable alternative care available according to information provided in the application. It has been indicated that for the past four years Ms. Gorman has lived beside her mother and father Fay and Betty Mavity who have cared for her. The Department of Planning does not feel there is justification to move another mobile home onto the site to care for Ms. Gorman. 2000-1877 c. Section 43.2.4.1.3 Adequate water and sewage disposal facilities are available to the mobile home. The Department of Planning Services has concerns that a cistern is not an adequate water supply for the second mobile home. Aristocrat Water has indicated that you can have one service connection upon one acre lot and more than one connection shall not be allowed. Therefore, water will not become available for two homes. Should the Board of County Commissioners approve this request, the Department of Planning Services' staff recommends the following conditions be attached: 1. The applicant shall apply for a building permit for the mobile home prior to locating the mobile home on the property. 2. Prior to the occupancy of the mobile home, the mobile home shall be connected to an approved septic system and a legal water supply. 3. The mobile home shall meet the minimum setback and offset requirements for the Agricultural zone district. 4. The mobile home shall not be occupied until such time that the applicant has complied with Conditions 1 through 3 as stated above. 5. The applicant shall apply for and received approval of a zoning permit for the mobile home currently being used for an accessory structure on the site, and apply for a building permit if approved. The applicant also shall apply for the appropriate building permits for the two shed's currently located on the property. 6. The applicant shall submit documentation to the Department of Planning Services by August 1st of each year describing the status of the medical hardship, and the persons caring for the applicant. This permit is temporary and shall terminate once the medical hardship ceases to exist,at which time the applicant shall have thirty(30) days to remove the mobile home from the property. 7. Pursuant to the definition of SETBACK in the Weld County Zoning Ordinance(Ordinance 89),the required setback is measured from the future right-of-way line. 8. The temporary access shall be placed in such a location to have adequate sight distance in both directions and not below the crest of a hill or where physical obstructions are present. 9. If a drainage culvert is required, a 15-inch corrugated metal pipe is the County's minimum size requirement. If the applicant chooses to place a larger culvert, please contact the Public Works Department to adequately size your culvert. 10. In accordance with Section 43.2.4.3 of the Weld County Zoning Ordinance, all zoning permits for mobile homes for use during a medical hardship are temporary and are subject to review annually on the anniversary of the original permit's issuance. Any permit for a medical hardship use shall automatically expire,and the mobile home shall be removed upon cessation of the medical hardship or at any such time as the mobile home is used for other than the permitted use. 11. In accordance with Weld County Ordinance No. 172, upon availability of water from the Aristocrat Ranchette Water Project or any other community water supply,the Weld County Health Department will not renew the cistern permit. At this time, the applicant shall obtain water from that water system. 12. Dear Applicants: The Department of Planning Staff met on July 14, 2000, to discuss your Zoning Permit for a Mobile Home to be used for a Medical Hardship. We do have some concerns and are denying the application at this time as it does not meet the intent of Section 43.2.4. The letter from the doctor is not specific enough and there are some inconsistencies with the application. The property also has a zoning violation and a possible building violation currently that will be addressed through our code compliance. If you wish to appeal this decision,you have the option of going before the Board of County Commissioners. Mary Bridgewater, moved shortly after and Bobbie Gleason continued living there renting from us. She Intended to move the following year. She Just moved May 1996.
