RESOLUTION OF RECOMMENDATION TO THE BOARD OF COUNTY COMMISSIONERS
Moved by Arlan Marrs that the following resolution be introduced for passage by the Weld County Planning
Commission. Be it resolved by the Weld County Planning Commission that the application for

REQUEST: A Site Specific Development Plan and a Special Review Permit for a business permitted
as a use by right in the Commercial Zone District(Vehicle Service and Repair Shop)jr the
Agricultural Zone District.
LEGAL DESCRIPTION: SE4 SE4 SE4 Section 30, Township 3 North, Range 65 West of the 6th
P.M , Weld County, CO
LOCATION: North of and adjacent to WCR 28 Section Line; east of and adjacent to WCR 39
be recommended unfavorably to the Board of County Commissioners for the following reasons:
1. The submitted materials are not in compliance with the application requirements of Section 24 7 of
the Weld County Zoning Ordinance.
2. It is the opinion of the Planning Commission that the applicant has not shown compliance with
Section 24.3 of the Weld County Zoning Ordinance, as follows:
a. Section 24.3.1.1 --That the proposal is not consistent with the Weld County Comprehensive
Plan.The proposal is for a USR to allow vehicle service and repair on part of the applicant's
property. The applicant expects to park no more than ten (10) automobiles and other
assorted vehicles on site per day. Vehicles will be stored on site adjacent to the building.
There will be employees on site to make repairs to the vehicles. Per the application,there
will be no one living on the premises.
A.Goal 3 state"discourage urban scale residential,commercial,and industrial development
which is not located adjacent to existing incorporated municipalities. The facility is located
outside of the urban growth boundary area for both Fort Lupton and Hudson, the nearest
communities. Further, P.Goal 2 requires adequate facilities and services to assure the
health,safety,and general welfare of the present and future residents of Weld Courty. The
applicant has not provided documentation stating that adequate water service in terms of
quality, quantity, and dependability is available to the site for fire suppression and for daily
use. The applicant has submitted a Commercial Well Permit application stating the well will
have a maximum pumping rate of 15 gallons per minute. The Platteville/ Gilcrest Fire
Protection District is requiring evidence of 1500 gallons per minute at 20 pounds per square
inch for a period of two hours sustained for this site.
b. Section 24.3.1.2 --The proposal is not consistent with the intent of the Agricultural Zone
District.Section 31.1 of the Weld County Zoning Ordinance states"Agriculture in thecounty
is considered a valuable resource which must be protected from adverse impacts resulting
from uncontrolled and undirected business, industrial and residential land uses."Planning
staff concurs that an adverse impact will result from locating the business at the proposed
site.

c. Section 24.3.1.3 --The vehicle service and repair shop would not be compatible with the
existing surrounding land uses.The surrounding properties are zoned for agricultural uses.
The surrounding property is very rural in nature with limited homes. Fire suppression of this
facility will be a major concern with no water on site and with a fire district response time of
approximately fifteen (15) minutes.
d. Section 24.3.1.4 --The vehicle service and repair shop is incompatible with the rural and
uses. Without adequate water for fire suppression, the proposed facility fails to meet the
minimum standard for fire protection, and fails to provide adequate provision for the
protection of the health, safety and welfare of the inhabitants of the neighborhood and hte
County.
e. Section 24.3.1.7--Adequate provisions for the protection of health, safety, and welfare of
the inhabitants of the neighborhood and County cannot be attained by Development
Standards and Conditions of Approval. The facility does not have water.
This recommendation is based, in part, upon a review of the application materials submitted by the
applicant, other relevant information regarding the request, and responses from referral entities

The Chair declared the resolution passed and ordered that a certified copy be forwarded with the file of this
case to the Board of County Commissioner's for further proceedings.
