RE: APPROVAL OF RECORDED EXEMPTION NO. 729 - CALVIN DUPPER
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its
authority under Section 30-28-101 (10) (d) , CRS, as amended, did
determine at a public meeting held in the Chambers of the Board,
that a certain parcel of land, to be divided into two parcels , as
shown on the plat known as Recorded Exemption No. 729 , does not
come within the purview of the definition of the terms ,
"subdivision" and "subdivided land" , and
WHEREAS , the request for Recorded Exemption No. 729 was
submitted by Calvin Dupper for property which is located in the N4
NWa, Section 26 , Township 4 North, Range 65 West of the 6th P.M. ,
Weld County, Colorado, being more particularly described in the
plat which shall be provided by the applicant and known as Exhibit
"A" , said plat to be recorded, and
WHEREAS , this request it to divide the property into parcels
estimated to be approximately 50 acres and 30 acres, more or less ,
to allow the applicant to sell the larger parcel.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hereinabove
described parcel of land be , and hereby is , exempt from the
definition of the terms , "subdivision" and "subdivided land" .
BE IT FURTHER RESOLVED by the Board that this approval is
conditional upon the the applicant submitting a mylar plat to the
Department of Planning Services to be recorded in the office of
the Weld County Clerk and Recorder. The plat shall be drawn in
accordance with the requirements of Section 9-2C. (4) of the Weld
County Subdivision Regulations. The plat shall be submitted
within ninety (90) days from the date of approval by the Board of
County Commissioners.

The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 26th day of
December, A.D. , 1984 .

Re: Recorded Exemption #729
Dear Commissioners:
The attached application, plat and related items are in reference to a
request from Calvin Dupper for a recorded exemption. The parcel of land on
which this request is being made is described as the Ni NWT, Section 26,
T4N, R65W of the 6th P.M. , Weld County, Colorado.
The property is located five (5) miles southeast of La Salle on Weld County
Road 42. The property contains approximately 80 acres of Class I (prime) ,
IIe (prime) irrigated and VIw and IVe nonirrigated soils. The parcel of
land under consideration is the total contiguous land holdings of the
applicant.
The request is to divide the property into parcels of 50 acres and 30 acres,
more or less.
Based upon the submitted information and policies of the County, the
Department of Planning Services staff recommends the request be denied for
the following reasons:

- The request does not comply with Section 9-2 F; the
Standards and Conditions for approval of a recorded
exemption. It is the responsibility of the applicant to
demonstrate that the proposal is consistent with the
intent of the district in which the use is located.
- The subject site is located in an Agricultural Zone
District outside of a projected town growth area. The
minimum lot size in the Agricultural Zone District is
eighty (80) acres for irrigated land and one hundred sixty
(160) acres for dryland. The subdivision of an eighty
(80) acre parcel into two (2) lots is inconsistent with
efficient and orderly development in the agricultural zone
district outside of a projected town growth area.
- It is the responsibility of the applicant to demonstrate
that the proposed use will be compatible with the future
development of the surrounding area as permitted by the
existing zoning and with future development as projected
the Comprehensive Plan of the County.
- The Weld County Future Land-Use Map indicated the type of
development at the subject location is intended to remain
agricultural and the zone district is intended to remain
agricultural.
As explained on pages forty-two (42) and forty-three (43) of the
Weld County Comprehensive Plan, problems occur when agricultural
uses and residential uses are mixed together. As explained in the
Comprehensive Plan on page forty-four (44) , ". . .scattered
development in rural areas has other implications. Residential
development in rural areas necessitates an increase of public
service to that area. . ." More people in the area places additional
strain on expenditures for road maintenance, police protection, fire
protection, and education services. It has not been demonstrated
that the increased revenues generated by development will pay for
the required new facilities and services.
The creation of an additional building site through the recorded
exemption process will have little impact on the need for services;
however, if the recorded exemption becomes the norm and numerous
similar proposals are granted, the above impacts can be expected to
develop.

In this regard, the cost of County services can be reduced if
development is encouraged around existing population centers and
future town growth areas. Development in town growth areas reduces
the conflict that arises between rural and urban land-uses.

The reason for splitting up the N''zNW4 Sec. 26/T4N/R65 W is that I cannot take
care of it as farm ground, and the water has been appropriated in 1953 and has to
be developed. I cannot and do not have the money to do it.
I was able to transfer the water from the irrigation well on Sec. 27 to the well
on Sec. 26 for irrigation. The farmer that owns the property on the 80 acres
which has the well that is used for irrigating the 80 acres is willto purchase and
develop it into farm ground making one unit.
I am hoping for approval on this recorded exemption.
