HomeMy WebLinkAbout20002035.tiff HEARING CERTIFICATION DOCKET NO. 2000-41 RE: SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT#1277 FORAN AGRICULTURAL SERVICE ESTABLISHMENT(MIXING,BLENDING,STORAGE, AND WHOLESALE OF HERBAL PRODUCTS) IN THE A (AGRICULTURAL) ZONE DISTRICT - EARTH BALANCE, INC. A public hearing was conducted on September 6, 2000, at 10:00 a.m., with the following present: Commissioner Barbara J. Kirkmeyer, Chair Commissioner M. J. Geile, Pro-Tem Commissioner George E. Baxter Commissioner Dale K. Hall Commissioner Glenn Vaad Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Robert Anderson The following business was transacted: I hereby certify that pursuant to a notice dated August 21, 2000, and duly published August 24, 2000, in the South Weld Sun, a public hearing was conducted to consider the request of Earth Balance, Inc., for a Site Specific Development Plan and Use by Special Review Permit#1277 for an Agricultural Service Establishment(mixing,blending,storage,and wholesale of herbal products) in the A (Agricultural)Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Robert Anderson, Department of Planning Services,stated the applicant has requested this matter be continued to September 20, 2000, at 10:00 a.m., because they are not able to attend today's hearing. He stated a representative for the applicant is present to answer any questions. Wilma Andrews represented the applicant and explained her sister previously owned the business; however,following her death,the application has been managed by Anita Comer who was not able to attend today. Ms. Andrews stated she is authorized to answer on behalf of the applicant; however, she would like to request a continuance if the Board has any concerns regarding the application. Commissioner Hall stated he would be willing to proceed with the hearing and then continue the matter if the representative is unable to answer questions. In response to Chair Kirkkmeyer, Mr.Anderson stated he did speak with the applicant who indicated she agrees with the Conditions of Approval and Development Standards as recommended by the Planning Commission. Ms. Andrews added that she was given authority to accept the Conditions of Approval and Development Standards on the applicant's behalf. The Board decided to proceed with the hearing. Mr. Anderson gave a brief description of the location of the site, which has one improvement and some landscaping. He stated there are no apparent zoning violations, proof of adequate water and sewer has been provided, and the referral agencies indicated no concerns or proposed conditions of approval. Mr. Anderson stated this case was referred to the Planning Services staff by the Zoning Compliance Officer because this is an existing use which did not previously have a permit. 2000-2035 CO IL ��z �Cp Pa) PL1431 HEARING CERTIFICATION - EARTH BALANCE, INC. (USR#1277) PAGE 2 In response to Commissioner Baxter, Mr. Anderson stated it appears the applicant simply was not aware of the need for a permit. Responding to Commissioner Geile, Mr. Anderson started Anita Corner is the principal representative for Earth Balance, Inc. Mr. Morrison stated Ms. Corner is the executer of the estate, and Flora Wadsworth was the property owner. In response to Chair Kirkmeyer, Ms. Andrews stated she and the applicant have reviewed and agree with the Conditions of Approval and Development Standards. Responding to Commissioners Geile and Baxter, Ms. Andrews stated Nancy Fox is no longer involved in this application, and the application was submitted under the corporation's name in care of Anita Comer. No public testimony was offered concerning this matter. Commissioner Vaad moved to approve the request of Earth Balance, Inc., for a Site Soecific Development Plan and Use by Special Review Permit #1277 for an Agricultural Service Establishment (mixing, blending, storage, and wholesale of herbal products) in the A(Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Baxter, and it carried unanimously. This Certification was approved on the 11th day of September 2000.
