RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST JOHN AND MARY HAITHCOAT FOR VIOLATION OF THE
WELD COUNTY BUILDING ORDINANCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, John and Mary Haithcoat, VI #9900260, are allegedly in violation of the
Weld County Building Code Ordinance, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 11th day of July, 2000, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Mary Haithcoat, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to continue said
violation to September 12, 2000, to allow adequate time for the final inspections to be
completed on the temporary mobile home permit, and for a request for extension to be
administratively processed.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that said violation be, and hereby is, continued to September 12, 2000,
to allow adequate time for the property owner to bring the subject property into compliance.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 11th day of July, A.D., 2000.

March 24, 2000 Contact was made w/Mr. Haithcoat and an extension was requested to complete
primary housing structure and remove mobile home prior to end of May.
March 24, 2000 Extension letter was sent to have Mobile Home removed from property or completed
inspections before May 31, 2000.
June 23, 2000 Contact was made w/Mr. Haithcoat and mentioned that this case was scheduled for
a hearing with the Board of County Commissioners.

Dear Mr. Haithcoat:
The property located at 38565 WCR 43 remains in violation of the Weld County Building Code Ordinance. I
have scheduled a meeting with the Board of County Commissioners for July 11, 2000 , at 10:00 a.m. to consider
the violation occurring on the property. This meeting will take place in the County Commissioners'Hearing
Room, first floor, Weld County Centennial Center, 915 Tenth Street, Greeley, Colorado. It is recommended
that you and/or a representative be in attendance to answer any questions the Board of County Commissioners
might have about the violation. This would be a prime opportunity for you explain all issues regarding this
violation. If you can contact me prior to the hearing and take care of this matter, we will not proceed with the
hearing. If no contact is made, all plans will continue with the hearing.
The Department of Planning Services' staff will be recommending that the Board of County Commissioners
authorize the County Attorney to proceed with legal action to remedy the violation if you and/or a
representative are not available. Our records indicate that you were made aware of the nature of the violation,
the action necessary to correct the violation, and that you were given sufficient time to remedy the violation. If
you have any questions concerning this matter, please call me.

Dear Mr. Haithcoat:
I am writing in response to your request for an extension to have the mobile home inspections completed
or to have the mobile home removed from the property prior the May 31, 2000. If all inspections are not
completed or if the mobile home is not removed, the violation will be scheduled for a hearing with the
Board of County Commissioners, and possibly referred to the County Attorney's office for legal action. I
hope that this extension will give you sufficient time to complete all necessary inspections and get the
final approval. If you encounter any problems prior to the extension date, please give me a call to keep
me updated and I will assist you in any way that I can.
The inspection(s)needing to be completed is (are):
Final approval to include the certificate of occupancy and all other inspections required to get the final
inspections completed.
It is not necessary for you to contact me personally to schedule the inspection(s) when ready. Our 24

may schedule the inspection(s) for the next working day. Please make reference to your name,building

The building official has determined that the above described property is in violation of Sections 20.8.1,
20.8.2.2, 20.8.2.4, 20.8.4 20.8.6, 50.5.3, 60.5.2 and 70.3.4 of the Weld County Building Ordinance.
Setbacks,blocking,tie-downs, skirting landing& steps, final electrical, final plumbing and final approval.
The Weld County Building Ordinance requires that all manufactured home permits be completed within
180 days after the permit is issued. Permit PR-9830064 expired May 1, 1999.
It is the intention of this office to assist and cooperate with you without imposing undue hardships;
however,we have no discretion in this matter. If you fail to correct this violation by September 17, 1999,
it will be scheduled for a hearing before the Board of County Commissioners to consider whether to refer
this violation to the County Attorney's office for legal action.
