RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST ADOLFO, HORTENCIA, JORGE, AND LUZ MUNOZ FOR
VIOLATION OF THE WELD COUNTY BUILDING AND ZONING ORDINANCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Adolfo, Hortencia, Jorge, and Luz Munoz, VI#9900312, are allegedly in
violation of the Weld County Building and Zoning Ordinance, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 19th day of September, 2000, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,
and
WHEREAS, Adolfo, Hortencia, Jorge, and Luz Munoz were not present or represented
at said hearing, although all parties were notified of said hearing by Department of Planning
Services staff, and
WHEREAS, the Board deems it advisable to bring legal action against those individuals
as hereinabove named to correct said violation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Weld County Attorney be, and hereby is, authorized to
proceed with legal action against Adolfo, Hortencia, Jorge, and Luz Munoz to remedy the
violations of the Weld County Building and Zoning Ordinances, and any other persons
occupying the properties, any persons claiming an interest in the properties, and any persons
acting in active concert with the identified parties.

The Department of Planning Services has scheduled the following violations to be considered at the
September 19, 2000,hearing beginning at 10:00 a.m. The Department of Planning Services is requesting
that the Board review the individual cases and determine whether or not to authorize legal action to remedy
the violations.

unit and we have had reports of people utilizing the derelict mobile home as well.

CASE SUMMARY
September 9, 1998 A warning letter was sent to Mr. Munoz from T. Swain of the Weld County Environmental
Health Department for burning on the property.
October25, 1999 Initial complaint came in fora mobile home without appropriate permits and too many animals
October 25, 1999 Initial inspection was conducted. V.Brown spoke to the son regarding the mobile home and
animals on the property. The son stated that there was no permit for the mobile home.
October 26, 1999 A 10 day letter was sent out by V. Brown.
October 27, 1999 V.Brown spoke to Mr. Munoz regarding the mobile home and derelict vehicles. Mobile
home was given to Mr. Munoz and there was no intention for it to be used as a residence.
He was also informed about the number of animals on the property. He stated he would be
going into the office to apply for the appropriate mobile home permit.
November 02, 1999 Mr. Munoz came into the office to apply for the mobile home permit. He was informed to
send in a letter to the Planning Department regarding his medical hardship.
November 05, 1999 Mr. Munoz came into the office with the letter explaining the reason for the medical
hardship. Letter dated November 4. 1999.
November 15, 1999 Another letter was received from Mr. Munoz explaining use of the land.
March 03, 2000 Mr. Munoz applied for a Certificate of Compliance for the mobile home-approved.
March 04,2000 Mr. Munoz applied for a mobile home permit.
June 13,2000 A violation was issued for the Non-Commercial Junkyard and a Derelict Mobile Home.
July 27,2000 Permit PR-0030065 was issued for the mobile home.
August 15,2000 Received a letter from Affordable County Homes,Inc.regarding some health concerns with
the property and explaining various issues.
August 21, 2000 E-mail sent to T. Swain regarding the violation. No additional complaints.
August 30, 2000 A letter was received from Inspector G. Carroll regarding his findings on the proerty.
August 30, 2000 Certified Letter was sent out by B. Salzman to schedule violation for September 19, 2000
BOCC Hearing.

Dear Mr. Munoz:
The property referenced above remains in violation of the Weld County Zoning Ordinance. I have scheduled
a meeting with the Board of County Commissioners on September 19, 2000, at 10:00 a.m., to consider the
violations occurring on the property. The above mentioned property is in violation of the following Section(s)
of the Weld County Zoning Ordinance:
31.2.1 "One(1)single family dwelling unit and auxiliary quarter per legal lot."
31.2.2"One(1)single family dwelling unit and auxiliary quarters on a parcel of land created under the provisions of Section 11
of the Weld County Subdivision Ordinance."
31.3.9"Noncommercial Junkyard"consisting of 8+ derelict vehicles,1 derelict mobile home,appliances,wood,tires,buckets,
and various other miscellaneous debris.
To bring your property into compliance with the Weld County Zoning Ordinance:
The Noncommercial Junkyard must be removed or screened from all adjacent properties and public rights-of-way. The derelict mobile
home must be removed. Also,there is a shed on the East side of the property that appears to be inhabited. This shed will need
to be vacated as a dwelling unit.
Your property is also currently in violation of the following Section(s) of the Weld County Building Code
Ordinance:
20.10.1 Section 1001 shall be amended to read as follows:Any building or portion thereof;including any dwelling unit,guest
room or suite of rooms,or the premises on which the same is located,and mobile home,manufactured home or factory built home
in which there exists any of the following listed conditions to an extent that endangers the life,limb,health,property,safety or
welfare of the public or the current or future occupants thereof shall be deemed and hereby is declared to be a substandard
building. All substandard buildings,structures,or appendages are considered to be a violation of this code and shall be abated
by repair,rehabilitation,demolition or removal. As an alternative,the building official,may institute any other appropriate action
to prevent,restrain,correct or abate the violation.
To bring the property into compliance with the Weld County Building Code Ordinance:
The derelict mobile home(mobile home#1)must be abated by repair,rehabilitation,demolition or removal. A picture of the derelict
mobile home is attached. The"Accessory to the Farm"mobile home(mobile home#2)must have all of its inspections completed
by January 23,2001. The shed on the East end of the property,must be vacated as a dwelling unit even if temporary. The shed is
not approved for any overnight occupancy.
If you need to have an interpreter present, please contact me at least one week in advance.
This meeting will take place in the County Commissioners'Hearing Room, First Floor, Weld County Centennial
Center, 915 10th Street, Greeley, Colorado. It is recommended that you or a representative be in attendance to
answer any questions the Board of County Commissioners might have about the violations.
The Department of Planning Services' staff will be recommending that the Board of County Commissioners
authorize the County Attorney to proceed with legal action to remedy the violation. Our records indicate that
you were made aware of the nature of the violation, the action necessary to correct the violation, and that you
were given sufficient time to remedy the violation. If you have any questions concerning this matter, please call
me.

To Whom It May Concern
On 08/29/00 I went by the Jorge Munoz property at 26797 Hwy 392 to do an on-site inspection. My
specific interest was to determine if people were living in the old house to the East(Eastern-most building
on the property).
I spoke with Mrs. Munoz at approximately 11:45 AM. I asked her if anyone was living in the above
described building. She informed me that her brothers occasionally do when there is company. She also
told me there was a TV in the home. There is a power line to the building.
I asked her permission to go out to look at the building. It was locked and did not have visual access, so I
could not verify any other furniture or the actual availability of live electricity.
Mr. Munoz came out by the building but I could not communicate with him as he seemed to speak very
little English.
In addition to the building there was a lot of trash around the property. Item not functional or serving any
purpose.

As per the 1997 UBC 107.4 "Applications for which no permit is issued within 180 days following the date
of application shall expire by limitation The building official may extend the time for action by the
applicant."
If you wish to extend the above listed application, please contact our office within the next 5 working days

accomplish your intent regarding this application.

I have a case that I am taking to Violation Hearings on September 19, 2000. One of the letters in my file
from a surrounding property owner alleges that they have turned this compliant in to both of our
departments already with no outcome. I wanted to have all of my ducks in a row for the BOCC. This
individual alleges that Mr. Munoz is burning stuff all the time. I have enclosed a picture for your file as well
(please see attached picture dated August 21, 2000). If you would like a copy of the letter from the

I. ALLEGED FINDINGS OF FACT
This letter constitutes a formal "Warning Letter" as a follow-up to the August 31, 1998 inspection of your
property located at 26797 Highway 392 in Weld County, Colorado conducted by Troy Swain a duly
delegated representitive of the Colorado Department of Public Health and Environment,Air Pollution
Control Division.
During the Division's August 31, 1998 inspection it was determined that an illegal open burn was
conducted. A File search was made at the Weld County Health Department. No burn permit was issued.

II. PROVISION OF LAW ALLEGED TO HAVE BEEN VIOLATED
The open burning was conducted at 26797 Highway 392 in Weld County, Colorado in violation of Section
25-7-123(2)(a), C.R.S., and Air Quality Control Commission Regulation No. 1, Section II.C.1., which
provides in part:
"...No person shall burn or allow the burning of rubbish, wastepaper, wood or
other flammable material on any open premises or on any public street, alley,
or other land adjacent to such premises, unless an open burning permit is first
obtained from the Division."
III. STANDARD PENALTY PROVISION FOR THE VIOLATION AS ALLEGED
Section 25-7-123(3)(b)provides that any person failing to comply with Section 25-7-123(2)(a), for
commercial purposes, shall be subject to a penalty of not more than$10,000.00 per day for each day of
violation. Section 25-7-123(3)(a), C.R.S.,provides that any person failing to comply with Section 25-7-
123(2)(a), for noncommercial purposes, shall be subject to a penalty of not more than$100.00 per day for
each day of violation. In addition, Section 25-7-115(5) requires the Division to determine whether a
noncompliance penalty is applicable. If a noncompliance penalty is found to be applicable, such penalty
generally must be assessed for any period of violation from the date of issuance of this notice until the date
on which the emission source is brought into compliance. The amount of noncompliance penalty is
calculated in accordance with the provision of Section 25-7-115(5)(b), C.R.S.
IV. EFFECTIVE DATE OF NOTICE
This Warning Letter shall become effective upon receipt.

I am writing to share my objections related to the above request. My objections and concerns are as
follows:
1. The original home with 8 acres that was sold separately from the rest of this property,is a
filthy discussing pigsty_ I don't know how many people live there. There are 2 houses and 2
trailer houses on the property now,with someone living in them all.The property is cluttered
with trash and`filth. How did they get these trailer houses on this 8 acres I would like to
know. There is every kind of animal you can think of on these 8 acres. They are shooting
guns all the time. They are constantly burning,I don't know what,maybe it's dead animals or
the remains from all the slaughtering they do,but the stench is awful. Last weekend I
couldn't go outside because I would get sick to my stomach. We have complained to the
Health Department and the Planning Department with no action taken. If this development is
allowed I can foresee the rest of these acreages looking the same way.
2. What arc they going to do for watcr? The water system out here will riot tolerate the addition
of more homes. There already is a shortage of water in many of the existing homes in the
arca. They cannot run the washing machine and flush the toilet at the same time.
3. This was a valuable farm. When is the world going to wise up and stop destroying fanning
land? So another farm goes under. Without any water and no irrigation water these 10 acre
lots will go up in weeds. The country living will be diminished and the lots will be nothing
but an eyesore,just like the one mentioned above. In this agricultural area it will make weed
control even more challenging. I will be even more irritated if these 10 acre tracks receive
irrigation water to water nothing. We are having a terrible time getting irrigation water to
water our crops.
4. 1 am also concerned about the addition of more cars entering and exiting their residents on to
Highway 392. This highway is posted at 65 miles per hour and there are so many accidents
on this road already. We don't need 7 additional homes entering onto 392.
5. I moved out here 5 years ago to farm and to get away from people. I guarantee I do not want
these homes just across the creek from me. Please don't allow this to happen.

1 am writing to share my concern regarding the property owners' plan to spilt farm ground to create a sub division
that will only benefit the current property owners. My husband and I currently own a 12-acre piece of property that
was split off of an original homestead in the Gill area many years ago. When this was done the owners removed the
water rights from the property and made it impossible to access water for any future owners to maintain the property
with. The problem we are currently dealing with is the fact that we live in the desert and can not count on enough
rainfall to keep anything except weeds alive on the place. I understand that Affordable Country Homes, Inc. plans
to break the acreage into ten acre lots and we know from experience that ten acres can not be kept nice and green
with anything growing on it unless there is water. I also understand that the water situation in our area will not
tolerate that many new homes drawing on the supply from Lucerne without affecting everyone in the area. Without
some form of irrigation and residents that plan to actually irrigate their lots our current quality of"Country Living"
will be diminished as the lots with the weeds will create an eye sore in our agricultural environment and make our
weed control job even more challenging.
My husband and I have tried to seed our 10 acre pasture with dry land grass and the wind blew it away for two
seasons wasting much time and money. We planted wheat for ground cover and to control the weeds, but without
water even the wheat struggled to grow. We have tried to gain the support from the neighbors we have to access the
head gate so we can get water to our place, but none are interested in this and water is so limited any way that there
is no guarantee we would have any to purchase! We have considered simply applying for a PUD change of Zone
and splitting the property to make a profit because the property is useless this way, but how fair is this to our current
neighbors? Everyone we know who lives in the area hates to see all these farms split up for residential purposes
even thought we understand that money is the driving force, but is it what is best for the area? Those of us who
want to live outside of town are currently feeling like we are living in the middle of town and need to improve our
places, split them, make some cash,and move despite all the hard effort to create our dream home.
The other issue of concern us that iris impossible to get any one to address the management of land in,our area
without fear of retaliation from the:property owners who apparently have their own concept of property ownership
and land use. I have made many attempts to contact the Division of Planning to address concerns regarding the first
piece of property that Affordable Country Homes,Inc. sold off after their purchase from the original owner. The
borne is located very close to the road on SH 392 and the new owners have moved two mobile homes onto the place
since moving in and they have been very creative about their utilization of recycled materials. As a neighbor I have
many concerns about the permits they have including sewage issues. The trash created'atth'is site is affecting the
surrounding;neighbors-as it is blowing across thefield and getting hung-,up on fences and landing in our yards.
Neighbors have witnessed inhumanepractices,including tlie•tyingandadragging of live pigs around the yard at high
rates of speed. A litter of eartagged pigs was dumped into one of the water ditches and was traced back to this
residence. During special occasionsguns are fired off into the air and illegal airborne fireworks are also used. It
appears that these owners have more livestock on the property than is permitted,yet despite being on the road where
everyone can see these problems no.one has put a stop to any of it My reason for pointing all of this,out is simply
to give an example of what is occurring in our neighborhood currently and why we have.many concerns about this-
companies.plan to continue altering our neighborhood.

I ADOLFO MUNOZ AND FAMILY ARE REQUESTING THE PERMISSION TO PARK A
MOBILE HOME TRAILER ON OUR PROPERTY.
I ADOLFO HAVE NOT BEEN WORKING FOR OVER A YEAR DUE TO MEDICAL
REASONS. FIRST OF ALL, THE TENDONS IN BOTH OF MY HANDS ARE FAILING
AND DO NOT FUNCTION WELL ANYMORE NOT ABLE TO LIFT OR PULL HEAVY
OBJECTS. I HAD BEEN SEEING DOCTORS AND SPECIALISTS, FOR THIS. BUT
BECAUSE OF FINANCIAL REASONS, HAVEN'T GONE BACK TO THE DOCTOR.
I'VE ALSO HAD SURGERY ON MY RIGHT SHOULDER AND NOT I CAN'T RAISE MY

RUNNING A FARM. I'VE HAD SURGERY FOR AN ULCER AND WITH A 6 INCH SCAR
ACROSS MY STOMACH, I'M STILL EXPERIENCING PAIN AND GASSES. THIS ALSO
MAKES IT DIFFICULT TO DO NORMAL DAY TO DAY WORK THAT MAY INCLUDE
LIFTING.
FROM ABOUT 5 YEARS BACK, I'VE BEEN GETTING A SKIN DISCOLORATION. THE
DOCTORS HAVE SAID THAT IT IS CAUSED BY NERVES. AT ONE TIME I WAS
TAKING PILLS AND USED CREAM FOR THIS. IT'S BEEN ABOUT A YEAR AND A
HALF NOW THAT I'VE NOT BEEN TREATED FOR THIS, ALSO BECAUSE OF
FINANCIAL REASONS. BECAUSE OF THE DISCOLORATION, I CAN'T WORK
OUTSIDE IN THE SUN. WHEN I DO, MY SKIN BURNS AND BLISTERS. THIS HAS
ALSO AFFECTED BY VISION.
THE REASON WE'RE ASKING TO KEEP THE MOBILE HOME ON THE PROPERTY IS
SO THAT MY DAUGHTER CAN LIVE IN IT. SHE WILL BE THE PERSON TO HELP ME
RUN THE FARM. INCLUDING FEEDING THE ANIMALS, DRIVING TRUCKS AND
TRACTORS WHEN NEEDED. SHE WILL ALSO HELP US TAKE CARE OF YOUNGER
SIBLINGS WHEN THEY COME HOME FROM SCHOOL. THIS WOULD BE A GREAT
HELP TO OUR FAMILY.
PLEASE TAKE IN TO CONSIDERATION THE MEDICAL NECESSITIES FOR HAVING
THIS MOBILE HOME.

10-27-99 SPOKE TO MR MUNOZ RE:MOBILE HOME & DERELICT VEH.
HE SAID THAT HE DID NOT HAVE INTENTIONS TO USE THE MOBILE
HOME AS A RESIDENCE. THE M/H WAS GIVEN TO HIM AND IS AWARE
THAT HE NEEDS A PERMIT IN ORDER TO HAVE IT ON HIS PROPERTY.
HE WILL BE COMING TO PICK UP AN APPLICATION. HES ALSO AWARE
THAT HES ONLY ALLOWED A CERTAIN AMOUNT OF ANIMALS ON HIS
PROPERTY. ACCORDING TO MR MUNOZ, THERE IS LESS AMOUNT OF
ANIMALS THAN WHAT WAS NOTED BY HIS SON. REGARDING THE
DERELICT VEH. HE SAID THAT THEY DID REMOVE 1 CAR YESTERDAY
AND ARE PLANNING ON TAKING THE OTHERS TO THE JUNK YARD. I
DID ADVISE THEM TO SCREEN THE VEH. THAT ARE NOT RUNNING.
11/2/99 MR & MRS MUNOZ CAME INTO THE OFFICE TO TALK ABOUT
THE PERMIT NEEDED FOR THE M/H. MR MUNOZ HAS BEEN DISABLED
FROM HIM HIS HANDS AND HAS BEEN OUT OF WORK FOR ABOUT THE
PAST YEAR. HE IS INTERESTED IN KEEPING THE M/H ON HIS PROP.
WENDY AND I TOLD HIM TO WRITE US A LETTER EXPLAINING HIS
MEDICAL HARDSHIP. HE WILL SUBMIT A LETTER BY THUR

1/19/00 MR MUNOZ CALLED TODAY, SAID THAT HE HAS BEEN TRYING
TO CONTACT A GENTLEMAN AT THE HOUSING AUTHORITY. HE HAS
CALLED SEVERAL TIMES AND HAS BEEN UNABLE TO REACH HIM. MR
MUNOZ HAS ALSO BEEN WAITING FOR A RETURN PHONE CALL AND NOT
RECEIVED IT. I WILL EXTEND FOR MORE TIME.
