RE: APPROVAL OF AGREEMENT BETWEEN WELD COUNTY AND THE BUREAU OF
LAND MANAGEMENT, U. S. DEPARTMENT OF INTERIOR
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Bureau of Land Management, U. S. Department
of Interior, will furnish and install one cattle guard on County
Road 87 near Riverside Reservoir, and
WHEREAS, an agreement between Weld County and the Bureau
of Land Management, U. S . Department of Interior, for said
cattle guard installation has been presented to the Board of
County Commissioners for approval, and
WHEREAS, the Board has studied said agreement and deems
it advisable to approve the same. .
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the agreement between
Weld County and the Bureau of Land Management, U. S. Department
of Interior concerning the installation of a cattle guard be,
and hereby is , approved.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 18th day of
May, A.D. , 1981.

AGREEMENT BETWEEN COUNTY OF
WELD AND THE
BUREAU OF LAND MANAGEMENT
U.S. DEPARTMENT OF INTERIOR
THIS AGREEMENT, made and entered into this 13ay of May , 1981,
by and between the COUNTY OF WELD, hereinafter designated the "County"
and the Manager, Canon City District Office, Bureau of Land Management,
U.S. Department of the Interior, hereinafter designated as "Bureau".
WHEREAS, the Bureau will furnish and install one cattle guard on County
road Number 87, near Riverside Reservoir;
WHEREAS, the County has the responsibility, the necessary equipment and
experienced personnel to perform maintenance and repair of the County roads:
WHEREAS, it is to the advantage of the Bureau to capitalize on the
experience of the County and its facilities for maintenance and to use
only one source for labor and equipment and to incur the least overall expense;
now therefore,
IT IS AGREED by and between the Bureau and the County as follows:
1. The Bureau will furnish and install one (8' x 24') cattle guard
with end sections at the site shown on the attached map. After
the installation is approved and accepted by the County, the
cattleguard installation shall become the property of
the County.
2. The County, subject to availability of funds, shall maintain
the cattle guard in serviceable condition, along with its
routine maintenance of the County road.
3. The County will accept full liability for maintenance and
repair of the cattle guard.
4. Maintenance will be continued as long as the cattle guard can
be maintained in a serviceable condition or until the Bureau has
no further need for the cattle guard to control livestock use.
5. The Bureau's obligation to furnish and install the cattle guard with
end sections is contigent upon the availability of appropriated funds.
