Environmental Health Services has reviewed this proposal for a vehicle restoration home business.
The following conditions are recommended to be part of any approval:
1) All liquid and solid wastes (as defined in the Solid Wastes disposal Sites and Facilities Act,
30-20-101, C.R.S., as amended) shall be stored and removed for final disposal in a manner
that protects against surface and groundwater contamination.
2) No permanent disposal of wastes shall be permitted at this site.
3) Waste materials shall be handled, stored, and disposed in a manner that controls fugitive
dust, blowing debris, and other potential nuisance conditions.
4) The maximum permissible noise level shall not exceed the residential limit of 55 db(A) as
measured according to 25-12-102, Colorado Revised Statutes.
5) The facility shall utilize the existing septic system(G19759689).
6) All pesticides, fertilizer, and other potentially hazardous chemicals must be stored and
handled in a safe manner. Reference 25-8-205.5 Colorado Water Quality Control Act and
Rules and Regulations thereof.
7) The facility shall utilize the existing public water supply (Left Hand Water District).
8) Prior to recording the plat, the applicant shall submit a waste handling plan to the
Environmental Health Services Division of the Weld County Department of Public Health&
Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should

2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
9) The facility shall be in compliance with the Colorado Air Quality Control Commission
Regulations.

COLORADO SUBJECT: USR-1263, Tracy Wright
The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the
purview of the Weld County Zoning Ordinance Use by Special Review Standards for vehicle restoration as a home
business. Our comments and requirements are as follows:
COMMENTS:
Lot 15, Block 4 of the Carmacar Ranchettes Subdivision is the location of this Use by Special Review. This
subdivision is maintained by Weld County.
REQUIREMENTS:
Mountain View Street is a gravel street which has been dust controlled. The applicant shall utilize the existing
access with no additional accesses granted. There shall be no staging, storage, or parking of vehicles on
Mountain View Street.
The plat drawing is identifying a fence within the 80-foot right-of-way of Mountain View Street. This fence shall
be relocated because Weld County does not allow any fence structures within the right-of-way.
Storm Water Drainage: The applicant is indicating that there will no change to the storm water drainage pattern.
No additional buildings, asphalt, or improvements are being proposed so Weld County has no conflict with
drainage.

Dear Mr. Gathman:
I have reviewed the submitted material pertaining to the Use by Special Review for the restoration of
vehicles at 1906 Mountain View Street(Case Number: USR-1263, Case Name: Tracy Wright). The site is
within the boundaries of the Mountain View Fire Protection District and receives service from the District.
The Fire District is opposed to this request as proposed.
The restoration and repair of vehicles must be conducted in a building meeting the Uniform Building Code
(UBC)requirements for a Group H(Hazardous), Division 4 Occupancy. The pole barn was probably built
in accordance with the UBC for an agricultural building(Group U Occupancy- Weld County Permit#BC-
9800835) and as constructed, is not designed for the proposed use. This would constitute a "Change in
Use"for the structure which would have to be approved by the Weld County Building Department.
The painting of vehicles is considered as an "Application of Flammable Finishes" in accordance with the
Uniform Fire Code (UFC). This is a hazardous activity and must be conducted within a building meeting
the requirements of a Group H, Division 2 Occupancy or a listed spray booth. Again, the pole barn is an
inappropriate structure for this type of activity.

Repair garages are classified as an H-4 Occupancy with paint booths normally classified as H-2
Occupancies.
1. Occupancy separations shall be provided between the repair area, paint booth and any other
Occupancies as required in Table 3-B of the 1997 Uniform Building Code (UBC).
Section 302.1, Exception 1 of the UBC, states: When an approved spray booth constructed in
accordance with the Fire Code is installed, such booth need not be separated from Group B,
F, H, M or S Occupancies.
Spray booths shall be installed as required by the manufacturer or as specified by the
Mountain View Fire District.
Spray booth electrical wiring shall be according to Article 516 of the 1999 National
Electrical Code (NEC).
2. An automatic fire-extinguishing system shall be installed in Group H, Division 4 Occupancies
having a floor area of more than 3,000 square feet.
3. Either natural or artificial light shall be supplied equal to 1/10 the floor area.
4. Either natural or mechanical ventilation shall be supplied equal to 1/20 of the floor area.
5. Any devices that generate a glow, spark, or flame capable of igniting flammable vapors shall be
installed with sources of ignition at least 18 inches above the floor.
6. Any rooms containing large amount of flammables or where flammables are mixed or dispensed
may need to be in a control area. (Check with fire district for recommendations.)

7. Floors in areas where motor vehicles, boats, helicopters or airplanes are stored, repaired or
operated shall be of noncombustible, liquid-tight construction.
8. Depending on quantities of liquids that are stored, spill control may be required.
9. Distances from property lines and adjacent buildings shall be as outlined in Section 307.3 and 503
of the UBC.
10. Group 11, Division 4 Occupancies with 1,000 square feet or more shall provide two separate exits
for every portion of that Occupancy having a floor area greater than 200 square feet.
11. Plans shall be submitted to Mountain View Fire District for review.
12. Additional requirements or changes may be required when building applications or complete plans
are reviewed by the Weld County Building Inspection Department or the Mountain View Fire
District.
