Harmony Road, Fort Collins, Colorado, 80525, for property which is located in part of the Part of the East half of Section 24, Township 6 North, Range 67 West of the 6th P.M., Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded, and WHEREAS, this request is to divide the property into two parcels estimated to be approximately 16 acres for Lot A and 68.7 acres for Lot B. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land". BE IT FURTHER RESOLVED by the Board that Recorded Exemption #2578 by Boyd Meyer is, approved conditional upon the following: 1. A Weld County septic permit is required for any proposed home. The septic system shall be installed according to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations. 2. Of the existing dwellings which are located on the property to be divided, one dwelling shall be located on Lot A and the other dwelling on Lot B. No additional dwellings shall be allowed on either lot. 3. Prior to recording the plat: A. The applicant shall submit evidence to the Department of Planning Services that any existing septic system(s) meets all requirements of the Weld County Department of Public Health and Environment. The Environmental Protection Services Division of the Weld County Department of Public Health and Environment was unable to locate a septic permit for the septic system located at 12002 Weld County Road 392. The applicant shall utilize the existing access to this parcel. No additional accesses shall be granted. D. State Highway 392 is designated on the Transportation Map as a principal arterial road, which requires 75 feet of right-of-way from the centerline. The Colorado Department of Transportation has jurisdiction over all accesses to State Highways. The 75 feet of right-of-way shall be delineated on the plat. E. The applicant shall attempt to address the requirements of the Greeley Number 2 Canal as stated in a referral response received September 17, 1999. F. All approved accesses shall be shown clearly on the plat. Access to Lots A and B shall be from Weld County Road 66 by way of joint access easement across Lots A and B, which easement shall be shown clearly on the plat and dedicated on the plat for the use as shown, utilizing the language set forth in Section 11.7.1.12.5 of the Weld County Subdivision Ordinance #173. The following notes shall be placed on the plat: 1) All proposed or existing structures will meet the minimum setback and offset requirements for the zone district in which the property is located. It is the opinion of the Department of Planning Services' staff that the applicant has not shown compliance with Section 11.4.2.1 through 11.4.2.6 of the Weld County Subdivision Ordinance, as follows d. Section 11.4.2.4- Consistency with the purpose of efficient and orderly development as expressed in Section 1.3 of the Weld County Subdivision Ordinance. 1) Section 1.3.1 -Assisting orderly and integrated development. This Recorded Exemption will create two lots that are considered "island lots." That is, the lots do not have a boundary that is contiguous with the nearest county road or, in this case, State Highway 392. On August 9, 1999, Department of Planning Staff recommended "denial" for a recorded exemption (RE- 2503), for Mr. Ed Orr, on land that is adjacent to the site owned by Mr. Boyd Meyer. Department of Planning Staff is recommending denial of RE-2578 because of concerns with this application that are similar to those posed by RE-2503. 2) Section 1.3.7 - Safeguarding the interests of the public, the homeowner, and the subdivider. This application does not take into account the interests of the future owners who will be responsible for acquiring any utilities that do not currently exist on the site. Additionally, there are not adequate provisions for the continued maintenance and upkeep of the access road. 2000-0136 Should the Board of County Commissioners approve this request, the Department of Planning Services' staff recommends the following conditions be attached:. 1. The following notes shall be placed on the plat: 1) All proposed or existing structures will or do meet the minimum setback and offset requirements for the zone district in which the property is located. (Ordinance 210) 8) RIGHT TO FARM COVENANT Weld County is one of the most productive agricultural counties in the United States. The rural areas of Weld County may be open and spacious, but they are intensively used for agriculture. Persons moving into a rural area must recognize there are drawbacks, including conflicts with longstanding agricultural practices and a lower level of services than in town. Agricultural users of the land should not be expected to change their long-established agricultural practices to accommodate the intrusions of urban users into a rural area. Well run agricultural activities will generate off-site impacts, including noise from tractors and equipment; dust from animal pens, field work, harvest, and gravel roads; odor from animal confinement, silage, and manure; smoke from ditch burning; flies and mosquitoes; the use of pesticides and fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs cannot simply be moved "out of the way" of residential development without threatening the efficient delivery of irrigation to fields which is essential to farm production. Weld County covers a land area of over 4,000 square miles in size (twice the State of Delaware) with more than 3,700 miles of state and county roads outside of municipalities. The sheer magnitude of the area to be served stretches available resources. Law enforcement is based on responses to complaints more than on patrols of the county and the distances which must be traveled may delay all emergency responses, including law enforcement, ambulance, and fire. Fire protection is usually provided by volunteers who must leave their jobs and families to respond to emergencies. County gravel roads, no matter how often they are bladed, will not provide the same kind of surface expected from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may not be cleared for several days after a major snowstorm. Snow removal for roads within subdivisions are of the lowest priority for public works or may be the private responsibility of the homeowners. Services in rural areas, in many cases, will not be equivalent to municipal services. Children are exposed to different hazards in the county than in an urban or suburban setting. Farm equipment and oil field equipment, ponds and irrigation ditches, electrical power for pumps and center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs, and livestock present real threats to children. Controlling children's activities is important, not only for their safety, but also for the protection of the farmer's livelihood. 3. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty (60) days from the date of approval by the Department of Planning Services. The applicant shall be responsible for paying the recording fees. 4. The City of Greeley Planning staff has reviewed the application for a recorded exemption from Boyd Meyer, located south of and adjacent to Highway 392 and approximately 1 mile west of Weld County Road 27 and wish to forward the following comments. Resolution 7, 1985 by the City of Greeley Planning Commission gave administrative review authority to the Greeley Planning staff for review of recorded exemptions (RE). The resolution indicates we cannot recommend approval on any application where the overall gross density exceeds one dwelling unit per 20 acres outside of the 2010 growth ring. Since this application creates two lots through the exemption process on a 82.2 acre parcel, we can recommend approval of the request based on Resolution 7. The Greeley Public Works Department noted a reservation of a minimum of 50' of right-of-way from the centerline of Highway 392 would be appropriate to facilitate future development of this area if the proposal is approved. The recorded exemption will result in two parcels: 16 acre Lot A and 66.2 acre Lot B. The subject property is located within the Town's Community Influence Area and is depicted as part Very Low Density Single Family Residential and part Community Separator on the Town's Land Use Plan map. The Windsor Comprehensive Plan states that the Very Low Density Single Family Residential land use depiction provides for "...single- family residential detached homes at very low densities at a maximum density of one dwelling unit per acre." The Plan also states that Community Separators provide for areas of open space which "...generally have little or no development, with the exception of agricultural activities...". No new building sites will be created as this recorded exemption separates two existing residences. The application materials indicate that both lots will continue to be used for residential and agricultural purposes. Therefore, the proposed recorded exemption is consistent with the Town's Land Use Plan map. The subject property is not included on the Town's Circulation and Transportation Plan Map, however, it appears that both proposed parcels will utilize an existing access onto State Highway 392. The applicant is also proposing an amended recorded exemption (AmRE- 1870). This being the case, staff recommends approval of this recorded exemption subject to the following requirements: 1. All Colorado Department of Transportation requirements, including access permit review and right-of-way dedication, shall be satisfied. 2. Meyer to establish two residential lots on the south side of the canal of The New Cache La Poudre Irrigating Company. The major concern of the canal company is access . There has always been very good access in this area. The access is restricted by an existing building at this time . It would be more desirable if the access were unobstructed. In the west lot, west of the brick home, The New Cache La Poudre Irrigating Company has a headgate and weir . Access to the headgate and weir must be unobstructed. As we have noted numerous times , it would better serve the canal company and future property owners if the canal access were designated as an outlot . At the very least , the canal access should be clearly noted and labeled on the plat including the measuring weir . The plans as they are currently drawn do not clearly present the intent. The existence of the canal access is not addressed on the plat , much less the extent of the access . It is our opinion that the plat needs to clearly set forth the impact of the canal access on the property for the protection of future property owners and the canal company. The New Cache La Poudre Irrigating Company supports neighboring land owners right to put their property to the most beneficial use . We believe it is the responsibility of the planning department to insure that the development of such property is done in such a way that the canal access is secure and future property owners are well aware of the extent of encumbrances upon the property.
