WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution dated June 4, 1997, the Board did approve the application of Zeek Properties, Ltd., c/o Landmark Engineering, Ltd., 14504 1-25 Frontage Road, Longmont, Colorado 80504, for a Site Specific Development Plan and Planned Unit Development (PUD) Final Plan, S #422, on the following described read estate, to-wit: Part of the NW1/4 of Section 23, Township 3 North, Range 68 West of the 6th P.M., Weld County, Colorado WHEREAS, by Resolution on July 30, 1997, the Board of County Commissioners did approve a Subdivision On-Site Improvements Agreement (Privately Maintained Roads) with Zeek Partnership, Ltd., concerning the above described property, and WHEREAS, pursuant to said Improvements Agreement, a Deed of Trust for Lots 4 and 5, Block 1, Amended Plat of Rademacher Business Park Final PUD, was submitted to secure the obligations of the applicant, in the amount of $602,350.00, and WHEREAS, after inspection and on the recommendation of the Departments of Public Works and Planning Services, it has been determined by the Board that the collateral being held by Weld County is no longer necessary to secure said Subdivision On-Site Improvements Agreement (Privately Maintained Roads), and NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Deed of Trust for Lots 4 and 5, Block 1, Amended Plat of Rademacher Business Park Final PUD, be, and hereby is, canceled and released. Chester, Lead Planner SUBJECT: Release of Collateral r S- Rademacher Business Park The Department of Planning Services and Department of Public Works is recommending the total release of collateral for on-site improvements for the above referenced case number. A memo from Don Carroll, dated October 14, 1998 indicated that all the collateral should be released, except for 15% for a period of one year, if no repairs were needed. The property is located east of and adjacent to the 1-25 Frontage Road,just north of Highway 66 and the Sekich Business Park. The Improvements Agreement was accepted and approved by the Board of County Commissioners on June 4, 1997. The form of collateral for the on-site improvements is a Deed of Trust for Lots 4 and 5, Block 1, Amended Plat of Rademacher Business Park Final P.U.D. The property has been inspected by the Department of Planning Services and Public Works and it has been determined that all requirements of the Improvements Agreement, for on-site improvements, have been met. Williamson, Zeek Properties has requested release of collateral on the 1-25 Business Park. During our site inspection one year ago, it was determined that all transportation items were complete. At that time, Weld County Public Works recommended that 15% of the paving item be retained for a period of one year. As of January 24, 2000, no repairs were warranted and I am recommending the 15% be released. Please advise as to what additional information you may need, or if we can meet with you on site to provide further information. Moisture-Density tests are available to you. As directed. we also had called Mr. Jim Brewer of your staff to make him aware of the status of the project prior to beginning final subgrade preparations, and again prior to beginning paving operations. He may have taken Moisture-Density tests to confirm subgrade conditions at that time.
