Kirkmeyer, Chair Commissioner M. J. Geile, Pro-Tern Commissioner George E. Baxter Commissioner Dale K. Hall Commissioner Glenn Vaad Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Sheri Lockman Health Department representative, Trevor Jiricek Public Works representative, Diane Houghtaling The following business was transacted: I hereby certify that pursuant to a notice dated May 8, 2000, and duly published May 11 , 2000, in the South Weld Sun, a public hearing was conducted to consider the request of Robert Parsons for Change of Zone#536 from the A (Agricultural) Zone District to the E (Estate) Zone District for a f ve (5) lot Minor Subdivision. Lee Morrison, Assistant County Attorney, made this a matter of record. Sheri Lockman, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Ms. Lockman stated the site will be serviced by North Weld County Water District and individual septic systems. She gave a brief description of the location of the site and surrounding uses, and stated it is not within any Urban Growth Boundary; however, it is within the Windsor Service Area. Ms. Lockman stated the site is not designated as prime land,five referrals indicated no conflicts with the proposal, and five submitted proposed conditions. She explained Condition of Approval#1.A requires the applicant to amend Recorded Exemptions#2357 and#1243 in order to create adequate space for access, and stated a letter of concern from a surrounding property owner has been received. She stated the applicant has submitted evidence from the ditch company and William Crews indicating the concerns have been addressed. Ms. Lockman stated the applicant is requesting Condition of Approval #1.C.1 be deleted, and explained the Poudre Valley Fire District does not have a concern with eliminating the requirement because the homes are going to have fire sprinkler systems. In response to Commissioner Baxter, Ms. Lockman indicated the location of nearby residences and submitted a photo of the sign posted on the site. In response to Chair Kirkmeyer, Diane Houghtaling, Department of Public Works, stated the 1,500 block length is typically required to help keep speeds reduced; however, this is a curved road and will not likely have high speeds. Robert Parsons, applicant, stated Lot 5 is currently under construction for his personal residence, and he has worked with all of the involved agencies. In response to Commissioner Geile, Mr. Parsons stated there will be five lots ranging in size from five to eleven acres,with .9-acres of open /IL /t' fi/ lcr-) 2000-1023 FL 1413 HEARING CERTIFICATION - ROBERT PARSONS (COZ#536) PAGE 2 space and easements around the entire parameter of the development. Ms. Lockman confirmed there is not a minimum requirement for open space. Responding further to Commissioner Geile, Mr. Parsons submitted correspondence from the Department of Public Works and the Colorado Geological Survey, marked Exhibit I, which indicate the sight is well drained and a more detailed report will be submitted at the Final Plan stage. He stated the site has been engineered for culverts under the road, and there will be a 60-foot easement for water storage. Mr. Parsons further stated the property owns one share of water which is currently used to irrigate alfalfa, and the owner of Lot A has a share of North Poudre which is used for irrigation. In response to Commissioner Baxter, Mr. Parsons stated if Lots 1, 2, or 3 want to purchase water, there is a ditch to convey it to the sites. No public testimony was offered concerning this matter. In response to Chair Kirkmeyer, Mr. Parsons stated he has reviewed and agrees with the Conditions of Approval and Development Standards In response to Commissioner Hall, Mr. Parsons stated he would like Condition of Approval #1.C.1 deleted because the site is 1,525 to 1,530 feet from the main access so there is not much difference and he would like the 1,500-foot maximum block length requirement of the Department of Public Works waived. Commissioner Hall moved to approve the request of Robert Parsons for Change of Zone#536 from the A (Agricultural) Zone District to the E (Estate) Zone District for a five (5) lot Minor Subdivision based on the recommendations of the Planning staff and the Planning Commission, w th the Conditions of Approval and Development Standards as entered into the record, with the deletion of Condition of Approval #1.C.1, renumbering subsequent conditions, and delete the last three sentences of Finding #2.d referencing the 1,500-foot maximum block length. The motion was seconded by Commissioner Baxter, and it carried unanimously. This Certification was approved on the 5th day of June 2000.
