RE-1J School District H. Petition for Annexation 1. Project Description This annexation impact report has been prepared pursuant to Section 31-12-108.5 Colorado Revised Statutes. 1986 Repl. Vol. The location of the Range View Estates Annexation is on the northwest corner of Weld County Road 7 (WCR 7) and Weld County Road 32 (WCR 32), Section 16, Township 3 North, Range 68 West, Weld County, Colorado (see Exhibit A). The area to be annexed includes 166.77 acres of agricultural land of which 5.34 acres are road rights-of-way (Exhibit B). Through this annexation, 2,624 feet of Weld County Road 7 and 1,252 feet of Weld County Road 32 will be incorporated into the Town of Mead. Currently, 1,412 feet of WCR 32 (on the southeast corner of the property) is within the Town of Mead through the Ochsner Annexation. In conjunction with the proposed annexation, the zoning is anticipated to change from the Weld County Agricultural zone district to the Town of Mead's Planned Unit Development district. The existing land use pattern for the area surrounding the property consists of agricultural and single family residential (see Exhibit C). As illustrated in the Comprehensive Plan's Land Use Map, the existing agricultural lands will be replaced mainly with residential development(see Exhibit D). The subject property is illustrated under the Land Use Map as predominately Low Density Residential with a land area density ratio of I dwelling unit on 1 to 2.4 acres of lot area. The proposed development plan (Exhibit E) reflects this land use, thus complying with the Mead Area Comprehensive Plan. IL Municipal Services Municipal services for the Range View Estates Annexation will be provided by the following agencies: Electricity: United Power Natural Gas: Public Service Company Ridge View Estates Annexation Page 1 of 5 Telephone: US West Water: Little Thompson Water District Sewer: Town of Mead Fire: Mountain View Fire Protection District Police: Weld County Sheriff's Department Access to the site will be from existing county roads. The site is bounded on the east by WCR 7, which is a 2-lane paved road with gravel shoulders situated in a 60-foot right-of- way. WCR 32, runs east-west along the southern boundary of the site. This is a 2-lane gravel road in a 60-foot right-of-way. Roadside surface ditches drain both roads. Potable water will be supplied to the site by Little Thompson Water District (LTWD). LTWD has a 6-inch main running along WCR 32, located approximately 12 feet north of the road centerline, and an 8-inch main running along WCR 7, located east of the traveled portion of the road. The Northern Colorado Water Conservancy District (NCWCD) also has a large main along an east-west alignment adjacent to the southern boundary of the site, but this main is not available as a source of water to the development. The NCWCD main is a 27-inch diameter trunk main, located approximately along the centerline of a 50-foot easement that straddles the southern boundary of the site and extends 35 feet into the site, north of the WCR 32 road right-of-way. Sanitary sewer infrastructure is not currently located in the vicinity of the site. The nearest potential point of connection to the Town of Mead sanitary sewer system would be near the intersection of WCR 7 and WCR 34., approximately one-half mile north of the northern boundary of the site. It is understood, however, that the existing mains from the potential tie-in point to the waste water treatment plant (WWTP)have insufficient capacity to carry the additional flows that would be generated by the proposed development. Therefore, any connection to the 'Town of Mead system would require installation of a new main throughout the entire distance from the site to the WWTP. Ridge View Estates Annexation Page 2 of 5 The Town of Mead would prefer that new developments be connected to the central sanitary sewer system, but there are currently no promulgated regulations requiring such connections. In addition, notwithstanding a State Statute requiring that residential developments within 400 feel of a municipal sewer system be connected to that system, the Town has not adopted a policy that would mandate connection of existing residences. except in the event of a septic system failure or other public health threat. The Town has no specific plans of its own to extend the existing sanitary sewer collection network. Rather, it will continue to rely on individual developers to construct appropriate extensions to serve their respective developments, and the Town will facilitate recovery of over-sizing costs from future developers who subsequently connect into the system extension. The Town provides no guarantee of cost recovery, however. Financing of individual extensions of and/or improvements to the existing municipal services will he primarily the responsibility of the property owner/developer. through appropriate agreements with and financing/completion guarantees provided to the Town. Additional finding for provision or upgrading of municipal services provided by the Town will he financed through impact fees, taxes, charges and/or special improvement districts, if necessary. Electric power is available to the proposed development from the existing overhead grid maintained by United Power. Electric lines are currently in place along the east side of WCR 7 and the south side of WCR 32. The power available in this area is 12,470 volt, 3- phase. Natural gas is available to the site via a number of pipelines, of various sizes and operating pressures, maintained by Public Service Company (PSCO) in the vicinity of the site. Service to the site would most likely be provided from a 2-inch distribution main running east-west in an easement adjacent to the southern boundary of WCR 32. A similar low-pressure distribution line is also located in an easement adjacent to the cast boundary of WCR 7. PSCO also maintains an intermediate-pressure line near the western boundary of the WCR 7 right-of-way, and high-pressure lines near the southern boundary of the WCR 32 road right-of-way and in an easement adjacent to the western boundary of WCR 7. Telephone service to the site will be provided by US West, which maintains underground lines along the west side of WCR 7 and the south side of WCR 32. All access to the property will comply with the Town's Access Code. Ill. Special Districts The area proposed to be annexed is within the following districts: • St. Vrain Valley School District RE-1J • Little Thompson Water District • Mountain View Fire Protection District IV. School District Impact A referral was sent to the St. Vrain Valley School District RE-1J regarding this annexation and the proposed land uses. Attached, as Exhibit G, is a copy of the School District's response, calculation of number of students and related information. V. Annexation Agreement Although all of the details of an annexation agreement between the Town of Mead and the applicant have not been negotiated, the Town of Mead's standard annexation agreement is attached as Exhibit H. This development will impact all levels of schools in the current attendance area. In addition, there are other approved developments in these attendance areas which would, together with this proposal, have a significant cumulative impact on these schools. - As the volume of development increases in this area, the District is becoming extremely concerned about our ability to provide the same quality education for these new students that we are providing students in other areas of the District due to increasingly overcrowded school facilities. While development fees for capital — construction are not provided for, the implementation of the land dedication/cash in-lieu ordinance by the Town requires residential projects to donate land with the adjacent infrastructure or pay an equivalent cash-in-lieu fee based on the student yield of the development. It is desirable and necessary that the territory described be annexed to the Town of Mead. 2. The requirements of C.R.S. sections 31-12-104 and 31-12-105, as amended, exist or have been met in that: a. Not less than one-sixth of the perimeter of the area proposed to be annexed is contiguous with the Town of Mead or will be contiguous with the Town of Mead within such time as required by 31-12-104. b. A community of interest exists between the area proposed to be annexed and the Town of Mead. c. The area proposed to be annexed is urban or will be urbanized in the near future. d. The area proposed to be annexed is integrated with or is capable of being integrated with the Town of Mead. e. No land within the boundary of the territory proposed to be annexed which is held in identical ownership, whether consisting of one tract or parcel of real estate or two or more contiguous tracts or parcels of real estate, has been divided into separate parts or parcels without the written consent of the landowner or landowners thereof, unless such tracts or parcels were separated by a dedicated street, road or other public way. f. No land within the boundary of the area proposed to be annexed which is held in identical ownership, comprises twenty acres or more, and which, together with the buildings and improvements situated thereon has an assessed value in excess of two hundred thousand dollars ($200,000.00)for ad valorem tax purposes for the year next preceding the annexation, has been included within the area proposed to be annexed without the written consent of the landowner or landowners. — PETITION.ANX October 26,1995 1 g. No annexation proceedings have been commenced for any portion of the territory proposed to be annexed for the annexation of such territory to another municipality. h. The annexation of the territory proposed to be annexed will not result in the detachment of area from any school district. i. The annexation of the territory proposed to be annexed will not have the effect of extending the boundary of the Town of Mead more than three miles in any direction from any point of the boundary of the Town of Mead in any one year. j. Prior to completion of the annexation of the territory proposed to be annexed, the Town of Mead will have in place a plan for that area, which generally describes the proposed: Location, character, and extent of streets, subways, bridges, waterways, waterfronts, parkways, playgrounds, squares, parks, aviation fields, other public ways, grounds, open spaces, public utilities, and terminals for water, light, sanitation, transportation, and power to be provided by the Town of Mead; and the proposed land uses for the area; such plan to be updated at least once annually. k. In establishing the boundary of the territory proposed to be annexed, if a portion of a platted street or alley is to be annexed, the entire width of the street or alley has been included within the territory to be annexed. The Town of Mead will not deny reasonable access to any landowners, owners of any easement, or the owners of any franchise adjoining any platted street or alley which is to be annexed to the Town of Mead but is not bounded on both sides by the Town of Mead. 3. The owners of more than fifty percent of the area proposed to be annexed, exclusive of dedicated streets and alleys, have signed this petition and hereby petition for annexation of such territory. 4. Accompanying this petition are four copies of an annexation map containing the information following: a. A written legal description of the boundaries of the area proposed to be annexed; b. A map showing the boundary or the area proposed to be annexed, said map prepared and containing the seal of a registered engineer; c.
