Morrison Planning Department Representative, James Mayerl The following business was transacted: I hereby -certify that pursuant to a notice dated July 25, 1984, and duly published duly 26 and August 16, 1984, in the La Salle Leader, a public hearing was conducted to consider the application of C & M Ready Mix Concrete Company for a Change of Zone, from A (Agricultural) to I-2 (Industrial Two) for property described as Part of the _E1/2 SWa, Section 30, and Part of the EY NW4j Section 31, all in Township 1 North, Range 66 West of the 6th P.M. , Weld County, Colorado. The Morrison, Assistant County Attorney, stated that the applicant could request continuance to a date when all Comnissionerswould be present. Verna Bldg, resource planner for C _& M Ready Mix Concrete Company, stated that she wished to proceed with this hearing today. Mr. Morrison read this request into the record. Jim Mayerl, Planning Department representative, read the favorable recommendation of the Planning Commission, along with the four recommended conditions, into the record. Ms. Sigg then presented the request of the applicant and exhibited a large map showing the parcels being considered. Ms. Sigg requested that the recommended Conditions 3 and 4 be amended to eliminate reference to the Colorado Geological Survey. Discussion was held concerning this request. The aggregate resource evaluation indicates that 15 percent of the de- posit is coarse aggregate. These terrace deposits are Broadway Alluvium which is composed of sand. We concur with the resource evaluations con- clusion that these deposits are uneconomic at this time. We have no objection to this rezoning. We do have several recommendations concerning the development of this site. The seasonally shallow groundwater levels will require special foundation and utility designs. We recommend that building foundations 'be designed by qualified engineering personnel . If large fill sections -are proposed, we recommend that fill placement also be supervised by qualified engineering personnel . The rezoning application indicates that on-lot wells and septic systems may be used on these sites. The shallow groundwater levels and porous -sand and gravels in this area will preclude the use of standard on-lot septic systems. It may not be feasable to use on-lot leach fields in some locations. We recommend that an alternate method of sewage disposal , such as holding tanks or portable facilities be used for these sites. As mentioned in the application, the Central Colorado Water Conservancy District currently has an easement through the site for six augmentation wells and a concrete-lined delivery system to the South Platte River for operation in our plan of augmentation. The system was installed in 1974 and has been used annually since that time. Our concerns, naturally, would focus on any interference to our operation from the proposed change in land use. Future gravel mining operations in this area could seriously reduce the amount of water available to our wells. Mitigation would have to occur under this situation. Also, access -to our wells and ditch, currently from Highway 85 near our well #3 on the -east, and from Weld County Road #6 on the north, must be maintained. I have visited with Verna Sigg, o₹ C & M Ready Mix, and these concerns were discussed at length. We look forward to working closely with C & M so that we can reach an equitable solution to any potential problems. Commissioners -RECORDED: Deputy DATE: - -9 - 2 of 2 Statement that Proposed Rezoning is Consistent with Changing Conditions in the Area: Although the existing zoning on _this site is agriculture, the soils are described by the Soil Conservation Service as being poorly drained and subject to flooding. These soils cannot be used for crop Troduction without being drained. Such soils are usually capable of supporting rangeland and some wildlife. Obviously, this area is too small to be used for rangeland, and adjacent industrial uses and traffic on U.S. Highway 85 will -prevent use of the site by wildlife. On this particular site, the area for which rezoning is requested has been excluded from the flood plain by the construction of a dike-like barrier. The barrier was -built by the Mancini Feed Lot personnel during their cattle feeding operation on the site. The barrier has -been an effective control of the -flood waters, and has teen designated as the f loodway line by the Federal Emergency Management Agency (FEMA) . In practice, the groundwater nears the surface during peak runoff periods each spring. as noted in the soils report by -Empire Laboratories (Appendix B) , the area has been partially filled _with concrete -rubble, sand, gravel, and shale. For agricultural purposes, the parcel is unuseable, not only because of the swampy nature of the soils and the fill which has teen placed thereon, but also because it is isolated by the dike-barrier on the west and :by industrial zoning and development on the east. Sand and gravel mining west of the dike-barrier will probably eventually occur, which swill completely isolate this parcel and -make agricultural use totally impractical. The logically appropriate use of this parcel is industrial. -industrial zoning exists adjacent to the property as spell as in the surrounding area as shown on the vicinity map. - 10 - Statement Demonstrating How the Uses Will Be Compatible with Surrounding Uses As shown on -the vicinity map, much of the surrounding area is now zoned I-3. It is anticipated that future uses in the area will include outisde storage or possibly some manufacturing and warehousing, but with limited employees. Such uses are consistent with the existing uses in the area, i.e. , C&M's _concrete batching plant, Mobile Premix's concrete batching plant, and Rocky Mountain Ready-Mix's concrete batching plant. Several nil companies and oil related industries use the existing industrial zoning for storage and equipment repair and maintenance. - 11 - Availability of Water and Proposed Sewage Treatment The shape of this particular parcel, the existing soils conditions, and its seperation from the existing I-3 ground by the road (located beneath the present zoning line along the entire easterly boundary of the parcel) will greatly limit its uses. It is anticipated that when developed, this property will simply be added to the existing 1-3 ground and split into four lots (see sketch attached) . The area will require more fill before practical use can be made of it. Considerable filling has occurred over the past several years, and once filling is -completed, the parcel will most likely be used for parking or outside storage. If developed as anticipated, no construction of buildings or septic systems will likely occur on this property. As a result, the rezoning of this strip will generate no additional water or sewer demands. If, however, development of structures becomes desireable, severe soils limitations must be overcome. The soils limitations are described in the following section of this report. If such were to occur, water will be provided by shallow wells tributary to the South Platte. Sewage disposal would be handled by septic systems. An irrigation well owned by the applicant will undergo a change in use and change in point of diversion to provide water demands should this parcel require water service. The irrigation well is adjudicated to irrigate 28 acres and is currently augmented by Central Colorado Water Conservancy Dis- trict for 56 acre-feet, the estimated consumptive use of crops grown under this well. A copy of the well adjudication (amended, to show accurage location of the well and the land it irrigated) and the well registration are shown in Appendix A. It is anticipated the consumptive use of the well water when - 12 - used for irrigation will exceed the demands for water generated both on this property and the property to the south for which C&M is also seeking rezoning. Consequently, this well will be more than adequate to meet the needs of the industrial users. In terms of building site development, these soils are rated -as -severe be- cause of the flooding nature of the soils (see table, page 17) . The geotechnical investigations performed by Empire Laboratories indicate that foundations must be constructed on undisturbed soil. Dear Members: The subject parcels of land, approximately 32 acres total, are a part of a 180-acre tract adjoining the Platte River between Weld County Road 4 and Weld County Road 6. The property was purchased in 1979 with the intention of developing the high ground into industrial use(s) and mining the low ground for sand. Included in the purchase was an additional 35 acre parcel on the east side of Highway 85 which has been an active sand mine since 1955. The estimated quantities do not consider any set back requirements, environmental preservation areas, utility easements or similar exclusions. Most sand and gravel operators would not consider mining a deposit containing less than 30% coarse aggregate because of the excess fines and waste material that is produced. The economic feasibility of mining this aggregate deposit is hampered by several factors: 1. The market demand has been, and will continue to be, for the coarse aggregate materials. 2. This deposit contains a relatively small percentage of coarse aggregate, and fine aggregate is readily available at locations much closer to the major market. 3. The costs to develop and produce the aggregate from this deposit would exceed the sales revenue at projected market prices. The subject property (32 acres) represents approximately 20% of the total aggregate deposit available at this location. The aggregate contained in the deposit is too fine to be economically mined under current market conditions. There is a vast quantity of similar aggregate available in the general area should market conditions change sufficiently to warrant extraction. It is my opinion that the mineral resource contained within the subject property does not meet the definition of a "Commercial Mineral Deposit" as defined in 34-1-302-1 CRS, 1973. Rezoning of the subject property, and elimination of the 2.3 million tons of aggregate material contained therein, would not hinder future availability of similar aggregate materials for the citizens of Weld County. The investigation was carried out by • means of test borings and laboratory testing of samples obtained from these borings. SITE INVESTIGATION The field investigation, carried out on May 4, 1984 consisted of drilling, logging, and sampling eleven (11 ) test borings. The locations of the test borings are shown on the Test Boring Location Plan included in Appendix A of this report. Boring logs prepared from the field logs are also presented in Appendix A. These logs illustrate the soils encountered, depth of sampling, and elevations of subsurface groundwater at the time of the investigation. All borings were advanced with a four-inch diameter, continuous- type, power-flight auger. The test borings were drilled to depths of three (3) to fifteen (15) feet. The drilling operations were performed under the supervision of a geotechnical engineer from Empire Laboratories, Inc. , who made a continuous visual inspection of the soils encountered. SITE LOCATION AND DESCRIPTION This investigation was performed on two (2) sites located on the west side of Highway 85 north of Brighton, Colorado. (1 ) The north site is a relatively level open site covered with concrete rubble, sand, gravel and shale fill . This site lies west of the C & M Concrete Batch Plant. This site exhibits poor drainage. The south site is a relatively level area west of the Mobile Premix Concrete Batch plant. A fenced oil equipment storage area exists in the center of this site. The remainder of the site is grass and -weed covered. This property exhibits poor drainage. LABORATORY TESTS AND EXAMINATIONS Laboratory testing and examination were performed on samples obtained from the test borings in order to determine the physical characteristics of the soils encountered. Moisture contents, -dry unit weights, unconfined compressive strengths and swelling potentials were determined. A summary of the test results is included in Appendix B. • SOIL AND GROllNDWATER CONDITIONS The soil profile at these sites consists of strata of materials arranged in different combinations. In order of increasing depth, they are as follows: (1 ) Topsoil : The south site is overlain by a layer of silty topsoil approximately six (6) inches thick. The upper three (3) to lour (4) inches of topsoil has been penetrated :y root growth and organic matter and should not be used as backfill or foundation bearing. (2) Fill : The north site is overlain by approximately two (2) feet of sand and gravel fill containing rubble. This -material should not be used beneath proposed buildings or pavement. (3) Silty Clay: Brown silty clay extends from beneath the topsoil at the south site to the underlying sand and gravel strata (2) at -depths of one (1 ) to fivE (-5) feet. This strata Exhibits moderate bearing characteristics. (4) Sandy Silty _Clay: Black or Crown sandy silty clay exists beneath the fill at the north site and -extends to the under:- lying sand and gravel strata at depths of four (4) to seven (7) feet. -This strata exhibits low tearing characteristics and poor _percolation characteristics. (5) Sand & Gravel : Tan silty sand and fine gravel extends from beneath the clay strata on bath sites to the depths Explored. This strata exhibits low to moderate bearing characteristics and good percolation characteristics. (6) Groundwater: At the time of our investigation, free ground- water was encountered at depths of six and one-half (63 ) to eight (-8) feet on the south site and one and -one-half (13) feet to two and one-hall (24) feet on the -north site. Water levels in this area are subject to change due to seasonal variations -and irrigation demands. RECOMMENDATIONS AND DISCUSSION It is our understanding that light industrial buildings will be constructed on this site. We further understand that septic systems will be required. Foundations Based on the proposed structures and the soil conditions encountered at the site, it is recommended that the structures be supported by conventional spread and/or strip footings placed on the original un- disturbed soil . All exterior footings should be placed a minimum depth of thirty (30) inches below grade for frost protection. When founded (3) at this level foundations at the north site may be designed for a maximum allowable soil bearing pressure of one thousand (1 ,000) to two thousand (2,000) pounds per square foot (dead load plus maximum live load. ) Foundations at the south site may be designed for a maximum allowable soil bearing pressure of two thousand (2,000) to three thousand (3,000) pounds per square foot (dead load plus maximum live load. ) Foundations on this site placed on the upper stiff clay strata should be designed for a minimum dead load pressure of five hundred (500) to one thousand (1 ,000) pounds per square foot to counteract swelling pressures which will develop if the subsoils become wetted. These bearing pressures are based on preliminary test data. Slabs on Grade The natural soil at these sites are adequate for supporting normal slab on grade construction. The fill containing rubble which exists on the north site should be removed from areas of proposed buildings and pavement prior to earth work. Septic Systems One (1 ) preliminary percolation test was performed on the north site and three (3) preliminary percolation tests were performed on the south site. An average percolation rate of one hundred and twenty (120) minutes per inch was recorded on the north site. Percolation rates of six (6) , six (6) and fifteen (15) minutes per inch were recorded on the south site. Subsurface water levels on the north site ranged from two (2) to five (5) feet and ranged from six and one-half (61 ) to eight (8) feet on the south site. Based on the preliminary percolation tests and existing water levels it is our opinion that engineered septic systems will be required on the north site. The need fnr engineered septic systems on the south site will depend primarily on the water level in the area of the proposed leach fields. (4) GENERAL COMMENTS It should be noted that this was a preliminary investigation and that the bearing capacities recommended in this report are based on preliminary -tests. Due to variations in soil conditions it is recom- mended that additional test borings be made prior to construction. Samples obtained from these test borings should be subjected to testing and inspection in the laboratory to provide a sound basis for determining the physical properties and bearing capacities of the soils encountered. APPENDIX C. Suggested Specifications for Placement of Compacted Earth Fill and/or Backfills. GENERAL A soils engineer shall be on-site to provide continuous observation during filling and grading operations and shall be the owner's repre- sentative to inspect placement of all compacted fill and/or backfill on the project. The soils engineer shall approve all earth materials prior to their use, the methods of placing, and the degree of compaction obtained. MATERIALS Soils used for all compacted fill and backfill shall be approved by the soils engineer prior to their use. The upper two (2) feet of compacted earth backfill placed adjacent to exterior foundation walls shall be an impervious, nonexpansive material . No material , including rock, having a maximum dimension greater than six inches shall be placed in any fill . Any fill containing rock should be carefully mixed to avoid nesting and creation of voids. In no case shall frozen material be used as a fill and/or backfill material . PREPARATION OF SUBGRADE -All topsoil , vegetation (including trees and brush), timber, debris , rubbish, and other unsuitable material shall be removed to a depth satisfactory to the soils engineer and disposed of by suitable means before beginning preparation of the subgrade. The subgrade surface of the area to be filled shall be scarified a minimum depth of s.ix inches, moistened as necessary, and compacted in a manner specified below for the subsequent layers of fill . Fill shall not be placed on frozen or muddy ground. C-2 PLACING FILL No sod, brush, frozen or thawing material , or other unsuitable material shall be placed in the fill , and no fill shall be placed during unfavorable weather conditions. All clods shall be broken into small pieces, and distribution of material in the fill shall be such as to preclude the formation of lenses of material differing from the surrounding material . The materials shall be delivered to and spread on the fill surface in a manner which will result in a uniformly compacted fill . Each layer shall be thoroughly blade mixed during spreading to insure uniformity of material and moisture in each layer. Prior to compacting, each layer shall have a maximum thickness of eight inches, and its upper surface shall be approximately horizontal . Each successive 6" to 8" lift of fill being placed on slopes or hillsides should be benched into the existing slopes, providing good bond between the fill and existing ground. MOISTURE CONTROL While being compacted, the fill material in each layer shall as nearly as practical contain the amount of moisture required for optimum compaction or as specified, and the moisture shall be uniform throughout the fill . The contractor may be required to add necessary moisture to the fill material and to uniformly mix the water with the fill material if, in the opinion of the soils engineer, it is not possible to obtain uniform moisture content by adding water on the fill surface. If, in the opinion of the soils engineer, the material proposed for use in the compacted fill is too wet to permit adequate compaction, it shall be dried in an acceptable manner prior to placement and compaction. COMPACTION When an acceptable, uniform moisture content is obtained, each layer shall be compacted by a method acceptable to the soils engineer and as specified in the foregoing report as determined by applicable standards. Compaction shall be performed by rolling with approved tamping rollers, C pneumatic-tired rollers, three-wheel power rollers, vibratory compactors , or other approved equipment well-suited to the soil being compacted. If a sheepfoot roller is used, it shall be provided with cleaner bars attached in a manner which will prevent the accumulation of material between the tamper feet. The rollers should be designed so that effective weight can be increased. MOISTURE-DENSITY DETERMINATION Samples of representative fill materials to be placed shall be furnished by the contractor to the soils engineer for determination of maximum density and optimum moisture or percent of Relative Density for these materials. Tests for this determination will be made using methods conforming to requirements of ASTM D 698, ASTM D 1557, or ASTM D 2049. Copies of the results of these tests will be furnished to the owner, the project engineer, and the contractor. These test results shall be the basis of control for all compaction effort. DENSITY TESTS The density and moisture content of each layer of compacted fill will be determined by the soils engineer in accordance with ASTM D 1556, ASTM D 2167, or ASTM D 2922. Any material found not to comply with the minimum specified density shall be recompacted until the required density is obtained. Sufficient density tests shall be made and submitted to support the soils engineer' s recommendations. The results of density tests will also be furnished to the owner, the project engineer, and the contractor by the soils engineer.
