Subsequent to your visit I met with Green Acres Nursery in Golden (our tree supplier) regarding the timing necessary to replace the trees. We have made arrangements to replace them, but cannot complete the replacement by the end of September due to supplier issues. Green Acres cannot have the trees delivered and planted before the 3rd week of October. As you are aware,we are in the process of obtaining a permit to open a facility northeast of Keenesburg. The process is proceeding and we are hopeful that we will be before the County Commissioners by the end of November. If approved, it is our intent to close down the Highway 66 operation and concentrate on operations at Keenesburg and our other facilities. Considering this intent and the current pressure on Highway 66 facility that surrounding urban sprawl has created,we would like to request permission to delay the replanting of the tree's until we know the decision on our Keenesburg application. This request is reasonable in our opinion for two basic reasons: 1. If Keenesburg is approved, and Highway 66 is closed down, we would be removing the trees from Highway 66 anyway by July of 2001. If the Keenesburg facility is not approved, or if it appears that approval will be substantially delayed,we would follow through on our original commitment to have the trees replaced. 2. Even if planted now, the tree's will be in a dormant condition until spring of 2000. When I originally discussed replacing the trees with Trevor last spring we discussed the possibility of moving the Highway 66 operation and the fact that it would not be logical to plant the trees if we were moving. The only thing that has changed from that conversation is the timing of the potential approval from Weld County. Now we are anticipating approval by the end of November. The hearing date has been moved back due to necessary advertising times and vacation schedules at the state level. Please consider our request and let me know as soon as possible the department's opinion on it.
