This site plan review is approved with the attached conditions:
1. Prior to recording the Site Plan Review plat, the applicant shall address the following to the
Department of Planning Services' satisfaction:
a. The plat shall be amended to delineate the following:
1) The applicant shall adhere to Offstreet Parking and Loading Requirements
per Sections 41.1.1, 42.2 and 34.5.1.3.1 of the Weld County Zoning
Ordinance, as amended. (Dept. of Planning Services)
,. 2) The applicant shall provide twenty-five (25) parking stalls for the Truck
Maintenance facility . The dimensions of the parking stalls shall adhere to
Sections 41.1.2.1 and 41.1.3 of the Weld County Zoning Ordinance, as
amended. (Dept. of Planning Services)
Further, the applicant shall provide two (2) off-street loading spaces
as required per Sections 41.2.1 and 41.2.5 of the Weld County Zoning
Ordinance, as amended. (Dept. of Planning Services)
3) The applicant shall provide wheel stops for the parking stalls per Section
41.1.2.4 of the Weld County Zoning Ordinance, as amended. One wheel
stop for every two parking stalls is acceptable. (Dept. of Planning Services)
4) The applicant shall address and adhere to the American with Disabilities Act
and ADA standards for this facility at all times. Non-ambulatory/Ambulatory
parking spaces shall be identified and shown on the plat.
Further, the applicant shall delineate the accessible route tc public
transportation from the parking area and building to WCR 4. If applicable
to your site, include sidewalk ramps at all intersections and buildings,
sidewalk rest areas for streets and driveways over five (5) percent,
accessible parking at all public buildings, and crosswalks with a maximum

vertical deflection of one-quarter inch. Please provide details and information
of how you will address these issues.
Further, the applicant shall align internal parking aisles with driveways ana
, ingress/egress gate openings. (Dept. of Planning Services, Dept. of

5) The applicant shall address the comments from Weld County Department
of Public Works, specifically addressed as follows:WCR 4 does not presently
exist west of SH 85, and it is not included in the Weld County Transportation
Plan. The lot therefore, does not have safe access to an approved public
or private street per Section 23.2.1.17 of the Weld County Zoning Ordinance
The applicant shall be required to construct a two-way paved road to SH 85
including all intersection improvements as part of this development. The
applicant should be aware that the intersection of SH 85 and WCR 4 will
eventually be reduced to a 3/4 movement per the SH 85 Access Control
Plan. (Dept. of Public Works)
6) The applicant shall screen the facility from adjacent properties per Section
41.2.1 of the Weld County Zoning Ordinance, as amended. (Dept. of
Planning Services)
7) The applicant shall provide lighting for off-street loading areas per Section
`�--� 41.2.4 of the Weld County Zoning Ordinance, as amended. The lights shall
be arranged in a manner as to not illuminate adjacent properties and to
prevent glare onto County streets and alleys. (Dept. of Planning Services)
In accordance with Section 34.5.1.2, Parking in the 1-2 Industrial zone district,
the described area ( shaded area ) shall be paved with asphaltic concrete
pavement or equal. As an interim measure, Weld County will accept a
surface, for the above described area, of asphalt millings provided the
applicant enters into an Improvements Agreement with the Weld County
Public Works Department to pave those areas within three years of the site
plan approval. (Dept. of Public Works)
.,O) The applicant shall place a typical cross-section of the parking lot on the plat
and identify the depth of base and concrete or full depth concrete according
to the Weld County Subdivision Ordinance, Sections 10.2.3 and 10.2 4..
Geometric Design Standards and Road Structures. (Dept. of Planning
Services)
10) The applicant shall place "plant material" screening to mitigate the impacts
of the facility from WCR 4. The plant material screen shall be placed
between the road right-of-way and the proposed Maintenance Facility that
fronts this road as depicted on the redlines. The buffer strip shall be a
minimum of ten (10) feet in width and run the length of the property line that
fronts WCR 4. Further, the applicant shall adhere to all landscape

requirements of Section 34.5.1.7 and Section 34.5.2.7 of the Weld County
Zoning Ordinance, as amended.
Please note, per the Weld County Zoning Ordinance, as amended, the
applicant shall provide landscaping on fifteen (15) percent of the site. In your
specific case, the site is approximately 18.6 acres (810,216 square feet)
fifteen percent of the site is 121,532 square feet. This is the total minimum
area to be landscaped. (Dept. of Planning Services)
11) The applicant shall describe the landscape maintenance plan for this area

12) Fences identified on the site plan shall be in conformance with Sections
34.5.1.6.1.1 and 34.5.1.6.2.1 of the Weld County Zoning Ordinance, as ale-td

13) The sign shall be located, and designed in accordance with the requirements
of Section 42 of the Weld County Zoning Ordinance, as amended. (Dept
of Planning Services)
14) In accordance with Section 34.5.1.8 of the Weld County Zoning Ordinance,
the applicant shall screen all trash receptacles from adjacent right-of-ways
and adjacent properties. Further, the areas shall be designed in such a
manner that will prevent scattering of trash. (Dept. of Planning Services:
) The applicant shall attempt to address the concerns and comments identified
in a referral received from the Colorado Department of Transportation
.�� (CDOT) dated February 25, 2000. (Dept. of Planning Services)
0b. ) The applicant shall include in the Landscape Plan the following information:

2) A Plant Material List specifying the Botanical and Common names of all plant
ISIS material to be installed; the size of the plant material at installation and
whether the plant material is to be containerized or B&B. (Dept. of Planning

perform maintenance and that maintenance is on-going and shall not end
upon final acceptance by the Department of Planning Services. (Dept of

c. The following notes shall be placed on the plat:
1) In accordance with the Weld County Zoning Ordinance, no land, building or
structure shall be changed in use or type of occupancy, developed, erected
constructed, reconstructed, moved or structurally altered or operated in the
commercial or industrial zone districts until a Site Plan Review has beer,
approved by the Department of Planning Services. (Dept. of Planning
Services)
2) The application does not propose any portion of the site to be leased to
another party. In the event that a portion of the building is proposed to he
leased to another party in the future, the applicant shall submit a copy of the
lease agreement and information regarding the proposed use of the leased
portion to the Weld County Attorney's office, Weld County Building
Inspection Department, and the Department of Planning Services for review.
Based upon the proposed use and/or impacts of the leased portion, the
Department of Planning Services may require a new Site Plan Review
application. (Dept. of Planning Services)
3) There shall be ho parking or staging of trucks allowed on WCR 4. (Public
Works Dept.)
4) All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites
and Facilities Act, 30-20-101, C.R.S., as amended), shall be stored and
removed for final disposal in a manner that protects against surface and
groundwater contamination. (Health Dept.)
5) No permanent disposal of wastes shall be permitted at this site. (Health
Dept.)
6) Waste materials shall be handled, stored and disposed of in a manner that
controls fugitive dust, blowing debris and other potential nuisance
conditions. (Health Dept.)
7) Fugitive dust shall be controlled on this site. (Health Dept.)
8) The maximum permissible noise level shall not exceed the industrial limit of
80 db(A), as measured according to 25-12-102, Colorado Revised Statutes.
(Health Dept.)
9) Adequate toilet facilities shall be provided for the public and employees.
(Health Dept.)
10) An individual sewage disposal system is required for the proposed facility
and shall be installed according to the Weld County Individual Sewage
Disposal Regulations. The septic system is required to be designed by a
Colorado Registered Professional Engineer according to the Weld county

Individual Sewage Disposal Regulations. (Health Dept.)
11) All pesticides, fertilizer and other potentially hazardous chemicals must be
stored and handled in a safe manner. Reference 25-8-205.5 Coloradc
Water Quality Control Act and Rules and Regulations thereof. (Health Dept )
12) The facility shall utilize the proposed private well. (Health Dept.)
13) If applicable, the applicant shall obtain a storm water discharge permit from
the Colorado Department of Public Health and Environment, Water Quality
Control Division. (Health Dept.)
14) The installation of the septic system shall comply with the Weld County
I.S.D.S. flood plain policy. (Health Dept.)
15) Maintenance of all trucks shall be preformed inside the proposed building.
(Health Dept.)
16) Landscaping materials as indicated in the approved landscape plan shall be
maintained at all times. Dead or diseased plant materials shall be replaced
with materials of similar quantity and quality at the earliest possible time
(Dept. of Planning Services)
17) All structures, including signs, on site must obtain the appropriate building
permits. (Dept. of Planning Services)
18) The site shall maintain compliance with the Weld County Zoning Ordinance
as amended at all times. (Dept. of Planning Services)
d. The applicant shall submit a plan describing any proposed on-site signage. Any
proposed sign shall adhere to Section 42.3 of the Weld County Zoning Ordinance.
All proposed signs shall apply for and receive a building permit . (Dept. of Planning
Services)
2. Prior to the release of building permits:
a) Upon approval by the Department of Planning Services, the Site Plan Review pat
shall be recorded. (Dept. of Planning Services)
b) The applicant shall submit two complete sets of blueprints to the Building
Department . (Building Department)
3. Prior to Recording the Plat:
a) The applicant shall vacate a portion of USR-905 described as the North 1/2 of the NE
6
1/4 of the NW 1/4 of Section 31, Township 1 North, Range 66 West of the 6th P.M ,
Weld County Colorado, except the East 100 feet thereof.
b) The applicant shall submit a landscape plan to the Department of Planning
Services for review and approval. Upon approval the Landscape Plan shall be
placed on the plat.
c) The applicant shall submit a waste handling plan to the Environmental Services
Division of the Weld County Health Department. The plan shall include at a
minimum, the following:
1) A list of wastes which are expected to be generated on site, including
expected volumes and types of waste generated. (Health Dept.)
2) A list of the type and volume of chemicals expected to be stored on site.
(Health Dept.)
3) The waste handler and facility where the waste will be disposed, including
the facility name, address, and phone number. (Health Dept.)
d) The applicant shall contact the Weld County Zoning Compliance Officer to inspect
the property for conformance with the Weld County Zoning Ordinance pertaining to
non-commercial junkyards. All derelict vehicles located on the property must be in
running condition with current license plates, or be screened from all adjacent
properties and public rights-of-way, or be removed from the property. All other items
considered to be a part of a noncommercial junkyard must also be removed from the
property or screened from all adjacent properties and public rights-of-way. The
property is in violation of the Weld County Zoning Ordinance. When the property has
been brought into compliance, the applicant shall submit a copy of the closure letter
indicating compliance with the Weld County Zoning Ordinance.
e) The applicant shall enter into an Improvements Agreement according to pokey
regarding collateral for improvements and post adequate collateral for parking arid
landscaping requirements. The agreement and form of collateral shall be reviewed
by County Staff and accepted by the Board of County Commissioners prior to
recording the plat.

The Department of Planning Services' received via facsimile a letter dated April 24, 2000 from
Robert and Sharon Baumgartner requesting that their property be amended out of USR 905 for
C & M Companies. This pit is known as the Platte Valley Pit. Per information provided by the
Baumgartners, the parcel in question was QuitClaim Deed to them on November 24, 1999. l he
property is located in the North half of the northeast quarter of Section 31, Township 1 North Rarge
65 West of the 6th P.M., Weld County Colorado, except the east one hundred (100) feet thereof.
I have attached a copy of this deed for your records.
The Department of Planning Services' on behalf of the Baumgartners requests that you begin the

The Department of Planning Services' has reviewed your amended Site Plan for the above named
property and have the following comments as noted. Please amend your drawings to reflect these
changes.
1.a.1 The applicant shall delineate two off-street loading parking spaces, per Section

the property for conformance with the Weld County Zoning Ordinance pertaining to
non-commercial junkyards. All derelict vehicles located on the property must be in
running condition with current license plates, or be screened from all adjacent
properties and public rights-of-way, or be removed from the property. All other items
considered to be a part of a noncommercial junkyard must also be removed from the
property or screened from all adjacent properties and public rights-of-way The
property is in violation of the Weld County Zoning Ordinance. When the property has
been brought into compliance, the applicant shall submit a copy of the closure letter
indicating compliance with the Weld County Zoning Ordinance.
3.e _ The applicant shall enter into an Improvements Agreement according to policy
regarding collateral for improvements and post adequate collateral for landscaping
requirements. The agreement and form of collateral shall be reviewed by C:,ou ity

The Department of Planning Services' was provided information in the form of a survey plat of
record, prepared by Kelly Surveying Associates, Inc. of Englewood Colorado regarding property
adjacent to the Baumgartner property. During a review of this plat, two items were noted:
First, WCR 4 was vacated per Resolution by the BCC on May 4, 1988. Later this was recorded
per Book 1195 Rec 02140669, dated May 10, 1988.
Second, staff (K. Ogle)noted an easement extending across Baumgartner's property in the
approximate location of the proposed structure presently under SPR 320 and in Bu lding
Inspection Plan Check. Staff documented building location graphically in plat prepared by Kelly
Surveying Associates, Inc.
Staff (J. Chester, K. Ogle) consulted Don Carroll regarding the non-exclusive license agreement.
From information provided, access appears to be present.
Staff notified Commissioner Vaad, outlining the situation, and later spoke with Lee Morrison,
Assistant County Attorney. From the County's perspective, this is a private easement that the
County does not enforce as it is not a part of a platted subdivision.
Ogle contacted Baumgartner via telephone and informed him of the situation regarding his pai cel
and proposed building site. Ogle provided via facsimile a copy of the recorded right-of-way
easement and site plan for easement location relative to his proposed building.
Staff on all levels, Attorney, Director of Planning, Lead Planner, Public Works, and Commissioners
have been apprized of this situation.
Early release of foundation permits only was granted by M. Daniels-Mika, and this will continued to
be extended. D. Renley and L. Dodge will provide documentation regarding the status of the
building from the Building Inspection side of planning.
From Planning, Baumgartner is continuing with the amendment of his Site Plan Review application
submittal. Comments from Staff will go out early next week.

building permit. Weld County Planning Services has determined that you must receive aporo• al
for your flood hazard development permit prior to applying for early release of your building
permit. Your flood hazard permit is in the process of being reviewed and may require some
additional information. This information is as follows:
1) The boundary of the area which is to be raised above the 100-year flood elevation. (Is it
just the building itself or will additional areas on the site be raised above the 100-year

FOR BAUMGARTNER
USE BY SPECIAL REVIEW PERMIT
The proposed project consists of constructing a 100' x 230' pre-fabricated metal building
with hard surfaced parking. The building and parking will cover approximately 2 acres of the kind
parcel. The Northeast portion of the site lies within the 100-year flood plain.
Presently the site is covered with native grasses and slopes to the South at approximate],
2 percent. The proposed building will have a concrete slab on grade floor. The finished floor
elevation will be a minimum of one-foot above the 100-year base flood elevation.
To limit the sites storm water runoff to historic amounts, a detention basin will be
constructed south of the building parking lot. The pond's outlet will meter the release flow:; to
historic rates.
The proposed construction will not create any measurable changes in the 100-year base
flood elevation and will not alter the flood plain boundaries. The controlled storm water runoff
will not have any adverse effect on downstream or adjacent property.

Dear Kim:
I am in receipt of your letter regarding the request of Robert and Sharon Baumgartner that their properly
located in the North half of the northeast quarter of Section 31, Township 1 North, Range 66 West of the
6th P.M., Weld County, Colorado, be amended out of the above-referenced USR. Aggregate Industries
successor of C & M Companies in ownership and operation under USR 905, concurs with that request.
In your letter of April 26, 2000, you requested that we begin the application process to amend out the
Baumgartner parcel, and you enclosed information and an application form for our use. In reviewing the
plats for this project, I note that the Baumgartner parcel, while included within the permit boundary, is not
within the actual limit of mining boundary. This parcel was not to be subjected to mining activity. so ils
removal does not materially affect the mining and reclamation plans. Removal of this parcel simply
reduces the acreage of the special use permit area.
Since the removal of the Baumgartner parcel essentially does not effect a major change from the plans or
development standards as shown or stated in USR 905, I would respectfully request that the Department
of Planning Services review this matter as a change subject to filing in its office, rather than an
amendment requiring approval by the County Planning Commission and the Board of County
Commissioners. Upon acceptance of this change request by the Department of Planning Services, the
Baumgartner parcel would be removed from the drawings and the revised plats delivered to Planning
Services for recording in the Weld County Clerk and Recorder's Office.

The following comments are made in response to the above noted referral. These comments and
resulting requirements are governed by the Uniform Fire Code, 1997 Edition, and other codes or
standards referenced within the Fire Code as adopted by the Board of County Commissioners, Adams
County-
I. The Fire District requires that all commercial and industrial buildings constructed., established or
moved within the District Boundaries must comply with the Rural Commercial and lndustrh l
Development Standard. A copy of the Standard is attached for reference.
2. The requirements for fire flow and the water supply capability must consider the type of
construction for the building, the size of the building, and the usage within the building.
3. Once a water system is extended along Highway 85, fire hydrants must be provided on the site
that are connected to the water system.

BRIGHTON FIRE PROTECTION DISTRICT
RURAL COMMERCIAL OR INDUSTRIAL DEVELOPMENT STANDARD
REQUIREMENTS
The following requirements are stipulated by the Uniform Fire Code, 1997 Edition, as well
as other codes and standards referenced `Jy the Fire Code. The codes and referenced
standards are as adopted by the appropriate County Commissioners.
1. A fire department access road must be provided to within 150 feet of any structure
constructed or moved within the Fire District. These roadways must include private
entrances to individual dwellings and other private structures.
2. The above noted access roads must be of an all weather construction capable of the loads
imposed by fire apparatus and must be of a 24 feet unobstructed width.
Axle Loads:
Single axle dual tires: 26,000 lbs.
Single axle single tires: 12,000 lbs.
Tandem axle dual tires: 44,000 lbs.
Note: Roads constructed to appropriate County Specifications for gravel roads meet the
above criteria.
3. Dead-end streets, lanes, and drives, (including private access roads) existing on
the above noted access roads, in excess of 150 feet in length, must be provided with turn-
around ability near the end.
4. The turning radius on any fire department access road must have a maximum 32 feet
inside radius and a minimum 50-feet outside radius.
5. All premises must be identified by address numerals, which are plainly visible from the
primary county road of access. The minimum numeral height must be 5"with a',41 stroke
and numerals must be mounted on a contrasting background.
6. An approved water supply, capable of supplying the required flow of water for fire
suppression, stipulated in the Fire Code, must be provided to all premises upon which.
facilities, buildings or portions of buildings are constructed or moved-to with-in the F ire
District. The above noted fue flow must be provided through a pressurized fire hydrant
system, individual site specific reservoirs, elevated tanks, pressure tanks, or other
approved systems. Facilities must meet the specific Fire Code flow requirements.
7. When an approved water system, capable of meeting the fire flow supply requirements is
not provided, alternative protection features for the primary structures must be provided.
Currently the Brighton Fire Protection District requires installation, in the interior,of an
NFPA and Brighton Fire Protection District approved NFPA-13 fire sprinkler system.
The approved system must be provided with an acceptable alternative water supply
installation.

8. All development plans, roadway specifications, and any planned provisions for fire
protection must be submitted to the Brighton Fire Protection District for review and
approval. Once installed, all fire protection features and roadway construction must be
inspected and approved by the Fire District. Fire protection feature performance tests
will be required.
9. All construction site plans, including building locations and separations, building
construction plans, as well as any fire sprinkler system plans must be submitted to the
Brighton Fire Protection District for consideration and approval. The District must
approve plans prior to issuance of a building permit. The Fire District must inspect fire
protection features within any structure and the District must witness performance tests
on the systems.

AIDA Requirement: All new development in Weld County must meet ADA requirements. TI-ese
requirements include an accessible route to public transportation with sidewalk ramps at all
intersections and buildings, sidewalk rest areas for streets and driveways with grades more Ilan
5 percent, accessible parking at all public buildings, and crosswalks with a maximum vertical
deflection of one-quarter inch. Please provide details of how you will address these issues.
Access: WCR 4 does not presently exist west of US 85, and it not included in the Weld 3oc my
Transportation plan. The lot therefore, does not have safe access to an approved public or prig ate
street(Zoning Ordinance 23.2.1.17). The developer shall be required to construct a two-way pa ved
road to US 85, including all intersection improvements as part of this development. The developer
should be made aware that the intersection of US85 and WCR 4 will eventually be reduced c a
3/4 movement per the US 85 Access Control Plan.

Environmental Health Services has reviewed this proposal for Baumgartner Trucking Ent, a ruckin
company. The following conditions are recommended to be part of any approval:
I) All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities
Act, 30-20-101, C.R.S., as amended) shall be stored and removed for final disposal in a
manner that protects against surface and groundwater contamination.

4) Fugitive dust shall be controlled on this site.
5) The maximum permissible noise level shall not exceed the industrial limit of 80 dB(A)

7) An individual sewage disposal system is required for the proposed facility rind ;hall be
installed according to the Weld County Individual Sewage Disposal Regulatio is. The
septic system is required to be designed by a Colorado Registered Professional E ngineer

8) All pesticides, fertilizer, and other potentially hazardous chemicals must he su red and

10) If applicable,the applicant shall obtain a storm water discharge permit from tt[e C :,iorado

ISSUANCE OF THIS PERMIT DOES NOT CONFER A WATER RIGHT
CONDf11ONS OF APPROVAL
1) This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of the
permit does not assure the applicant that no injury will occur to another vested water right or preclude another
owner of a vested water right from seeking relief in a civil court action.
2) The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCP 402-2, unless
approval of a variance has been granted by the State Board of Examiners of Water Well Construction and Pump
Installation Contractors in accordance with Rule 18.
•
3) Approved pursuant to CRS 37-92-602(3)(b)(I) and the policy of the State Engineer dated 4/9/85 for appropriation
of ground water tributary to the South Platte River system.
4) Approved as the only well on a site of 80 acres described as The E1/2 of the SW1/4 Section 30, Township 1 North,
Range 66 West, Sixth Principal Meridian.
5) The use of ground water from this well is limited to drinking and sanitary facilities as descrioed in CRS
37-92-602(1)(c), for a commercial business. Water from this well shall not be used for lawn or landscape irrigation
or for any other purpose outside the business building structure.
6) The total depth of this well shall not exceed 50 feet or the first confining clay/shale series encountere t whichever
ccmes first and which corresponds to the base of the alluvial aquifer.
7) The maximum pumping rate shall not exceed 15 GPM.
8) The maximum annual amount of ground water to be withdrawn shall not exceed 1/3 acre-fool (108,600 gallons .
9) The return flcw from the use of the well must be through an individual waste water disposal system of th
non-evaporative type where the water is returned to the same stream system in which the well is located. The
maximum consumptive use of ground water shall not exceed 10 percent.
10) A totalizing flow meter must be installed on this well and maintained in good working order. Permanent records
of all diversions must be maintained by the well owner (recorded at least annually) and submitted tc the Division
Engineer upon request.
11) This well shall be constructed not more than 200 feet from the location specified on this permit.
Note: To insure a maximum productive life of this well, perforated casing should be set through the entire
producing interval of the approved zone or aquifer indicated above.

Explanation
The property located approximately 1/8 mile west of Hwy. 85 on the south
side of W.C.R. 4 is being proposed as a trucking company to accompany
approximately 5-6 trucks and 5-6 employees. The business consist of hauling
and delivering dirt and rock from off-site locations to other off-site locations.
The existing business, Baumgartner Trucking Ent. Inc., has purchased the
property in order to build a new building to maintain the trucks and occupy a
portion of the building as a small office.
An estimated 10 truck trips per day, 5 trucks - 5 employees, are scheduled.
The truck trips may increase to approximately 20 trips, if and when, part of
the building is leased to another company. Most of the business is done off-
site and therefore, truck traffic to the shop is minimal. Trucks are empty
when in the yard. No loading of material will be performed on-site.
Maintenance of trucks will be performed inside the building.
Street access is from Hwy. 85 onto W.C.R. 4 and does not serve any
residential lots. Acceleration and deceleration lanes currently exist on Hwy.
85.
The property is zoned I-2, Industrial. It is screened from public view to the
east by an existing business between it and Hwy. 85. To the north and south
are industrial type businesses. The property abuts the So. Platte River on the
west.
Landscaping will consist of trees, shrubs and rock to be irrigated by a drip
system. No type of grass is proposed. The landscaping will be on the north
and east side of the property.
There are 20 proposed parking spaces along the east side of the property
screened by the landscaping.
