HomeMy WebLinkAbout20003190.tiff RESOLUTION 4141 RE: APPROVE VACATION OF SPECIAL USE PERMIT#349 - HEITMAN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution dated April 5, 1978, the Board did approve Special Use Permit#349 for a Hog Operation for Ronald Heitman on the following described real estate, to- wit: E1/2 NW1/4 of Section 27, Township 1 North, Range 66 West of the 6th P.M., Weld County, Colorado WHEREAS, the Board has received a request from the current owners, K. Dean and Patricia M. Heitman, 15422 Weld County Road 6, Fort Lupton, Colorado 80621, to vacate said Special Use Permit#349, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations of the Department of Planning Services staff and all of the exhibits and evidence presented in this matter and, having been fully informed, deems it advisable to approve said vacation. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that Special Use Permit#349 be, and hereby is, vacated. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 18th day of December, A.D., 2000. Dean and Patricia M. Heitman. Mr. And Mrs. Heitman are requesting that SUP-349 be vacated since hogs are no longer raised on the property. Background information: Legal Description: E2 NW4 of Section 27, Ti N, R66W of the 6th P.M., Weld County, CO. Location: South of and adjacent to Weld County Road 6 and 1/2 mile east of Weld County Road 31 - 3/4 of a mile north of Brighton SUP-349: SUP-349 was for a hog operation for 800 head of hogs. Mr. and Mrs. Heitman recently applied for a Recorded Exemption on the property. Because the Special Use Permit is no longer active, the Department of Planning Services required the vacation of SUP-349 as a condition of approval.
