Signe / -2/0 Date: RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION #2911 - MARRS LAND AND CATTLE, LLP WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10)(d), C.R.S., did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption #2911, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land", and WHEREAS, the request for Recorded Exemption #2911 was submitted by Marrs Land and Cattle, LLP, do Barry L. A Weld County septic permit is required for the proposed home, and its septic system shall be installed according to the Weld County Individual Sewage Disposal System (ISDS) regulations. 2. Prior to recording the plat: A. All approved accesses shall be clearly shown on the plat. The applicant shall contact the Weld County Department of Public Works to determine if a culvert is necessary at any approved road access point. If a drainage culvert is required, a 15-inch Corrugated Metal Pipe (CMP) is Weld County's minimum size. If the applicant chooses to place a larger culvert he shall contact the Weld County Department of Public Works to adequately size the culvert. 1) In accordance with Weld County Ordinance No. 180, Lot B shall be granted one residential access. Lot A shall use the existing residential access and agricultural/oil and gas/ditch road access points necessary for agricultural operations as no additional accesses shall be granted. B. Weld County Road 21 is designated on the Weld County Transportation Plan map as a local gravel road, which requires 60 feet of right-of-way at full build out. There is presently 60 feet of right-of-way. A total of 30 feet from the centerline of Weld County Road 21 shall be delineated right-of- way on the plat. This road is maintained by Weld County. C. Weld County Road 6 is designated on the Weld County Transportation Plan Map as a Collector status road, which requires 80 feet of right-of- way at full build out. There is presently 60 feet of right-of-way. A total of 40 feet from the centerline of Weld County Road 6 shall be delineated on the plat as right-of-way reservation for future expansion of Weld County Road 6. This road is maintained by Weld County. D. Along with the drawbacks come the incentives which attract urban dwellers to relocate to rural area: open views, spaciousness, wildlife, lack of city noise and congestion, and the rural atmosphere and way of life. Without neighboring farms, those features which attract urban dwellers to rural Weld County would quickly be gone forever. Agricultural users of the land should not be expected to change their long- established agricultural practices to accommodate the intrusions of urban users into a rural area. Well run agricultural activities will generate off-site impacts, including noise from tractors and equipment; slow-moving farm vehicles on rural roads; dust from animal pens, field work, harvest, and gravel roads; odor from animal confinement, silage, and manure; smoke from ditch burning; flies and mosquitoes; and the use of pesticides and fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs cannot simply be moved out of the way of residential development without threatening the efficient delivery of irrigation to fields which is essential to farm production. Section 35-3.5-102,C. R. S., provides that an agricultural operation shall not be found to be a public or private nuisance if the agricultural operation alleged to be a nuisance employs methods or practices that are commonly or reasonably associated with agricultural production. Weld County covers a land area of over 4,000 square miles in size (twice the State of Delaware)with more than 3,700 miles of state and county roads outside of municipalities. The sheer magnitude of the area to be served stretches available resources. Law enforcement is based on responses to complaints more than on patrols of the county and the distances which must be traveled may delay all emergency responses, including law enforcement, ambulance, and fire. Fire protection is usually provided by volunteers who must leave their jobs and families to respond to emergencies. County gravel roads, no matter how often they are bladed, will not provide the same kind of surface expected from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may not be cleared for several days after a major snowstorm. Snow removal for roads within subdivisions are of the lowest priority for public works or may be the private responsibility of the homeowners. Services in rural areas, in many cases, will not be equivalent to municipal services. Rural dwellers must, by necessity, be more self- sufficient that urban dwellers. Children are exposed to different hazards in the county than in an urban or suburban setting. Farm equipment and oil field equipment, ponds and irrigation ditches, electrical power for pumps and center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs, and livestock present real threats to children. Controlling children's activities is important, not only for their safety, but also for the protection of the farmer's livelihood. Parents are responsible for their children. 3. A well will be requested on the other Part B of this RE, once a home is built and all county permits obtained.. Irrigation Water There are presently 6 shares of Brantncr Ditch water(30 acre/ft per share) which will be divided as follows: 4 shares for the Part A (larger parcel with house and outbuildings on it ) and 2 shares for Part B (smaller parcel). 2.Sewer/Septic systems----Presently a septic system is in place and working well. A copy of the septic system that is on the larger parcel ....Part A, is attached to this report. Regards Part B a septic system will be requested once a house is built on the smaller part...Part B .The Health Dept for Weld County has been notified and will inspect the existing septic in near future, we were told. Permits and inspections by the Health Dept and Building Dept will be obtained in the future , for a new home ....once the owners decided to build. 3 Use of Property Presently the property is being rented(home/garage) to elderly couple who will be moving back home to Missouri. Several old outbuildings are on the property, used to store hay, farm machinery, and such items. The Brentner Ditch goes through the property (via an easement) on the East side, South side and Northwest side of property(see Map). The property is being farmed (Alfalfa/corn)presently via a contract and there are no cattle/horses on the property. There are a few oil production facilities on the property at present. (see Map). The driveways and the roads entering/exiting to the property are actively being used daily (see Map). #.The main reason for the recorded exemption is that the property may be utilized as an 85. 1 acre farm or horse/cattle ranch with the house and outbuildings on it, and with existing entry/exit driveway= while the remaining 34.9 acres may become a productive mini-farm, with another house and necessary outbuildings on it. There are 4 brothers who are owners of the property and they desire to have this type of division, which they believe will result in a much more productive usage of the land v.s. the present usage. The smaller acreage ( 34. 9 ac) may become a very productive ' organic' farm , while the larger acreage may become a conventional farm, or productive cattle/horse ranch. It is presently Ag farming. 5. The location of the new lot (smaller parcel) will be at the corner of WCR 21 and WCR 6 and will go north to the boundary line (present boundary line) and East to new boundary line....being 34.9 acres in size. 6.There arc no unique characteristics (physical)on the site presently, with the exception of the Ranch house and the outbuildings, and the oil facilities. 7_To the best of my knowledge, the present structures do meet minimum setback and offset requirements for the Ag Zone District where it is located. Likewise, any new structures will meet similar demands. 8.We arc not willing to place a conservation easement on the property. 9.A building envelope will be designated on the smaller parcel, in the future, when a home will be built. I0.As best as we understand, the proposal is consistent with the Weld County Comprehensive Plan. We have a total of 120 acres that we own and wish only to separate into two lots----one being 85.1 acres and the other being only 34.9 acres for a new home. We have checked with the officials of Ft. Lupton and Brighton and were told that the property is outside of their future developmental plans (til 2020). 11. The proposed usage will be compatible with existing surrounding land uses----as it is primarily Ag land, having farming/livestock usage on the larger parcel ( 85.1 acres)and Ag land usage for the smaller parcel ( 34.9 ac)where the new home will be located as a Mini-farm(possibly Organic Fami). 12.To the best of our knowledge, this proposal is consistent with the intent of the district it is located within, as expressed in the Weld County Zoning Ordinance, as amended and in the Weld County Comprehensive Plan. It is agricultural and will be remaining same, even on the smaller parcel (34.9 ac); which will have 2 shares of Irrigation water very adequate to water crops ; while the larger parcel (85.1 ac)will be Ag also and will have 4 shares of Irrigation water(over 120 acre ft) that will be very adequate to provide water to any crops for this parcel. 13. The Shingle loam has severe limitations for septic systems because of its shallow depth to rock. The Shingle loam has moderate limitations for houses without basements because of its shrink-swell capacity and shallow depth to rock. The Shingle loam has severe limitations for houses with basements because of its shallow depth to rock. PRIME FARMLANDS: All of the land in the smaller parcel is prime farmland. Development on this parcel will remove prime farmland from production. SOIL EROSION POTENTIAL: Most of the soils covered by this application are considered highly erodible and should be protected. The only soil not considered highly erodible is the Weld loam along the Brantner Ditch. Construction on highly erodible soil should be planned so as to disturb as little soil as possible and measures should be taken to prevent soil movement offsite. Any areas that are disturbed should be stabilized with perennial vegetation, gravel, or pavement once construction is complete.
