MONIES, INC., DBA EL RODEO NIGHT CLUB WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a request to modify Conditions B and E on the Tavern Liquor license held by J. Montes, Inc., dba El Rodeo Night Club, 3101 Highway 119, Longmont, Colorado 80504-9543, for the sale of malt, vinous and spirituous liquors for consumption by the drink on the premises only, and WHEREAS, a hearing before the Board was held on the 25th day of September , 2000, at which time the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of J. Montes, Inc., dba El Rodeo Night Club, and the recommendations of the County Attorney and, having been fully informed, finds that this request shall be approved, and the Conditions shall be modified to read as follows: B. That at least two security guards shall be present inside the premises at all times, after 8:00 p.m., when alcoholic beverages are being sold or served. At least one security guard shall be posted in the parking lot of the premises between the hours of 10:00 p.m. and 2:30 a.m. on those nights when the Tavern is open for the sale of alcoholic beverages. The applicant shall provide to the Weld County Sheriff's Office and the Clerk to the Board's Office, on an ongoing basis, within thirty (30) days after hire or employment, copies of certificates of training for all such security guards and copies of certificates permitting all armed security guards to carry weapons. E. That the tavern shall only sell alcoholic beverages during those times as allowed by statute and/or regulation. You made the request by letter dated August 24, 2000. As usual,the Board's meeting will take place in the first floor meeting room at the Centennial Center Building, 915 Tenth Street, Greeley, Colorado. Enclosed is a copy of a Memorandum which I sent to Mr. Kim Fliethman of the Weld County Sheriff's Office dated September 5, 2000. I heard from Deputy Genova of the Weld County Sheriff's Office regarding my Memorandum. I believe he has no objection to the change for the start time for security from 6 p.m. to 8 p. m. and for the open times being extended to all week. It is my understanding the Deputy Genova will be present at the Monday meeting to discuss your request. His letter addresses the licensing restrictions at the El Rodeo Night Club. As you can see, Mr. Carr is asking to have the security guard requirement changed from starting at 8:00 p.m., rather than upon opening at 6:00 p.m. Second, Ms. Montes wishes to be open the entire week without the restriction of being open only Thursday through Sunday. Attached is a copy of the Resolution which placed these restrictions. Please let me know by Friday, September 8, 2000, as to whether you have any objections and or comments regarding these requested changes. I hope to have the Board of County Commissioners consider Mr. Carr's request on Wednesday, September 13, 2000. Weld County Attorney 910 10th Street Greeley, CO 80631 Re: El Rodeo Night Club License Restrictions Dear Bruce: As we discussed at the renewal hearing on Monday, August 21, 2000, Jeanette Montes would like to eliminate one of the restrictions on her license and modify a second restriction. The first restriction involves the security guard requirement. Ms. Montes is not opposed to maintaining security, as required by the condition, but would like to change the start time until 8 p.m. rather than upon opening at 6 p.m. During the first few hours of operation, she typically has very few customers and as a result, she is actually losing money because the security personnel costs are greater than the gross receipts during that time period. Secondly, there is currently a restriction on the premises only being open Thursday through Sunday. If Ms. Montes wants to be open on a holiday, she must first notify the sheriffs department. Although Ms. Montes does not intend to be open 100% of the time, she would like the opportunity to be open when she deems it appropriate, which is no different from any other licensee. As a result, we would ask that that particular condition be removed from the license. It is my understanding you would like to get input from the sheriffs department concerning this request and I would ask that you do so as soon as possible.
