RE : APPROVAL OF RECORDED EXEMPTION NO. 527 - VERNON AND ALICE
SPAYD
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , it has been determined by the Board of County
Commissioners at a public meeting held on the 23rd day of
December, 1981 in the Chambers of the Board, that the division
into two parcels of land, as shown on the plat known as
Recorded Exemption No. 527 , being the property of Vernon and
Alice Spayd, described as part of the North half, Section 21 ,
Township 1 North, Range 65 West of the 6th P.M. , Weld County,
Colorado, being more particularly described as follows :
All that part of the North half (Nz) of Section 21,
T1N, R65W of the 6th P.M. , in Weld County,
Colorado, lying East of the Easterly right-of-way
line of Highway I-76 frontage road, being more
particularly described as follows :
Beginning at a point on the North line of
Section 21 from whence the Northwest corner of
said Section 21 bears 589°12 ' 49"W, 2634 . 90 feet
and with all other bearings contained herein
relative thereto; thence N89°12 ' 49"E , 2663 . 73
feet to the Northeast corner of said Section 21;
thence Sl°09 ' 26"E, 2644. 94 feet to the East Quarter
corner of said Section 21; thence Westerly, 4694. 79
feet along the South line of said N1, Section 21;
thence along the Easterly right-of-way line of
Highway I-76 frontage road the following courses
and distances :
N31°50 ' 49"E , 73. 00 feet; thence N34°42 ' 34"E ,
2200 . 00 feet; thence N41°53 ' 19"E, 1028 . 50 feet
to a point on the South right-of-way line of
County Road No. 8 ;

Beginning; thus described tract of land containing
226. 004 acres more or lesss.
TOGETHER WITH AND SUBJECT TO all easements and rights-
of-way which exist or are of public record.
does not come within the purview of the definition of the
terms, "subdivision" and "subdivided land" pursuant to its
authority under Section 30-28-101 (10) (d) , CRS 1973 , as amended.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners that the hereinabove described parcel of land
owned by Vernon and Alice Spayd be, and hereby is, exempt from

the definition of the terms "subdivision" and "subdivided land" .
The above and foregoing Resolution was, on motion duly
made and seconded, adopted by the following vote on the 23rd
day of December, A.D. , 1981.

Re: Recorded Exemption #527
Dear Commissioners:
The attached application, plat and related items are in reference to a
request by Vernon and Alice Spayd for a recorded exemption. The parcel
of land under consideration is described as part of the N1, Section 21,
T1N, R65W of the 6th P.M. , Weld County, Colorado. This property is
located east of Interstate 76 and south of Weld County Road 8, Approximately
2 miles southwest of the town of Hudson. The property contains 226.004
acres of Class II, III, IV and VI irrigated soils and Class IV and VI
nonirriated soils in the Agricultural Zone District. There are two
existing residences on the parcel. The recorded exemption would split
the applicants two dwellings and improvements (Lot A) from the farm
(Lot B) . This would allow the applicant to sell the farm to their son,
who will continue with the farming operation. The applicant would continue
living on Lot "A".
Based upon the information submitted and the adopted policies in the County,
the Department of Planning Services staff recommends the request be approved
for the following reasons:
1. The proposed split conforms with the recorded exemption clause
and the Weld County Comprehensive Plan;
2. The use will be compatible with surrounding agricultural uses;
3. The request will allow agricultural and related uses to be the
predominant land use, and the residential density will not
exceed the limit as defined in the Weld County Zoning Ordinance;
4. The request complies with the provisions of Section 9-4A of the
Weld County Subdivision Regulations.

Gentlemen:
We have reviewed the Vernon and Alice Spayd request for a Recorded Exemption,
and we have the following comments.
The legal description and the property map identify the proposed east
right-of-way line for Interstate 76. An eight-acre parcel of land has yet
to be acquired from the Spayd's before this will become the actual right-
of-way line. A description of this parcel is available in the District IV
Right-of-Way Office.
