A public hearing was conducted on November 1, 2000, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated October 16, 2000, and duly published October 19,
2000, in the South Weld Sun,a public hearing was conducted to consider the request of Lambland,
Inc., dba A-1 Organics, for a Site Specific Development Plan and Use by Special Review Permit
#1285 for a Solid Waste Disposal Site and Composting Facility in the A(Agricultural)Zone District.
Lee Morrison,Assistant County Attorney, made this a matter of record. Julie Chester, Department
of Planning Services, presented a brief summary of the proposal and entered the favorable
recommendation of the Planning Commission into the record as written. Ms. Chester gave a brief
description of the location of the site, and stated thirteen referral agencies responded favorably or
proposed Conditions of Approval. Ms. Chester stated the Patina Oil and Gas Corporation
submitted a letter,dated September 13,2000,expressing concerns which will be addressed by the
Conditions of Approval and Development Standards. Ms. Chester stated staff recommends this
proposal be approved for reasons as indicated in the Administrative Review. She further stated
a Certificate of Designation is necessary for this proposal; however, Section 45.4 of the Zoning
Ordinance requires notice of a Certificate of Designation be posted at the Clerk to the Board's
Office and on the site at least thirty days prior to the hearing, therefore, the Certificate of
Designation will be considered on December4,2000. Ms. Chester stated the Department of Public
Works is requesting the last line of Condition of Approval #3.A be deleted as indicated in Exhibit
E. In response to Commissioner Geile, Ms. Chester explained the Colorado Department of Public
Health and Environment has conditionally approved the Certificate of Designation, with the
understanding that the Use by Special Review Permit must first be approved by the local authority.
Chair Kirkmeyer suggested Condition of Approval #2 be deleted and the text be included as part
of the Board's findings. Responding to Chair Kirkmeyer, Ms. Chester reiterated State statute

requires the notice for a Certificate of Designation be posted and published at least thirty days prior
to the hearing; however, this hearing was pre-advertised, which conflicted with that requirement.
Don Carroll, Department of Public Works, stated he needs more information from applicant
regarding the truck traffic amounts and classification prior to finalizing the terms of an
Improvements Agreement. Responding to Commissioner Geile, Mr. Carroll stated there will be a
total of three improvements agreements related to this site. There is an agreement with Coors
Energy which upgraded and paved the road. The second agreement is with Waste Services which
is not currently operating; however, the agreement is in place to add two inches of overlay to the
road once they begin operations. The third agreement will be with A-1 Organics once he receives
the necessary information. Responding further to Commissioner Geile, Mr. Carroll stated Coors
has approximately six to eight trucks per day using the road. In response to Commissioner Baxter,
Mr. Carroll stated he is waiting to receive the information from A-1 Organics to determine its impact,
and then he will determine the effect to the existing agreements. Responding to Commissioner
Geile, Mr. Carroll stated the road is currently paved and in good condition. He further stated the
road has been slurry sealed and stripped, and it is maintained by the County from 1-76 for 2.5
miles, and then it is a private road to the site. Mr. Carroll submitted photographs of the road,
marked Exhibit F. Trevor Jiricek, Weld County Department of Public Health and Environment,
stated they have been working with the applicant to address staff concerns and he has no further
comments.
In response to Commissioner Vaad, Robert Yost, applicant's representative, stated feed stock is
the raw material brought in for composting and they add bulk materials. He further stated they
have been using the same procedure as Harvest Quest at the 66 Facility at this site for the past
two or three months through a pilot program. He further stated the procedure was included in the
Odor Abatement Plan and has successfully helped to control odors. Responding further to
Commissioner Vaad, Mr. Yost stated Harvest Quest has been able to produce materials within 28
days; however, their minimum will average 60-90 days. Responding to Chair Kirkmeyer, Mr. Yost
stated he has reviewed and agrees with the Conditions of Approval and Development Standards,
and he is also in agreement with the discussion regarding the road issues.
No public testimony was offered concerning this matter.
Commissioner Hall moved to approve the request of Lambland, Inc., dba A-1 Organics, for a Site
Specific Development Plan and Use by Special Review Permit#1285 for a Solid Waste Disposal
Site and Composting Facility in the A (Agricultural) Zone District, based on the recommendations
of the Planning staff and the Planning Commission, with the Conditions of Approval and
Development Standards as entered into the record, and to delete the last sentence of Condition
of Approval#3.A. The motion was seconded by Commissioner Vaad who expressed appreciation
to the applicant for working with the situation at the Highway 66 Facility. Commissioners Hall and
Vaad agreed to amend the motion to delete Condition#2 and move the text to be included as part
of the Board's Findings. The motion carried unanimously.
