HomeMy WebLinkAbout20002807 MINUTES OF THE WELD COUNTY UTILITIES ADVISORY COMMITTEE A regular meeting of the Weld County Utilities Coordinating Advisory Committee was held or Thursday, October 26,2000.at 10:00 a.m.,in the Conference Room of the Weld County Planning Department at 1555 N. 17th Avenue, Greeley, Colorado. CASE NUMBER: S-554 PLANNER: Monica Daniels-Mika APPLICANT: Ryan Carlson / Idaho Creek Subdivision REQUEST: Planned Unit Development Final Plat located in the Mixed Use Development Area LEGAL DESCRIPTION. NW4 NE4 of Section 10, T2N, R68W of the 6th P.M., Weld County, Colorado. LOCATION: Approximately 1/8 mile east of WCR 7 and 1/8 mile south of State Hwy 119. Monica Daniels-Mika, Planner, noted that Gary Sandau had called with his recommendations for the plat, concerned with the lack of easements along the front and back of the tracts, but that the fire hydrants would be acceptable. Ms. Daniels-Mika noted that the Department of Planning Services recommends that the utility easements be continued along the tracts. Monica further noted that the "typical utility design" is rot typical of all the lots as some have a 7'easement,some a ti easement,and some even have a 2'easement. Ms. Daniels-Mika noted that the subdivision is not in conformance with the subdivision regulations, but acceptance of the deviation would be up to the Utility Board. Don Carroll and Doug Dalton discussed whether or not the deviation would be appropriate for this subdivision. Todd Cartwright of Manhard Consulting noted that all the tracts are utility and drainage easements. Don Carroll asked the applicant to identify why they feel this subdivision should be allowed to deviate from the requirements Mr. Cartwright noted that this is designed with a more urban idea, closer to the density found in urban areas. Mr. Cartwright also noted that the subdivision can not accommodate the larger easements, that these tend to be dry utilities and the width is typical of the urban design. Don Carroll asked if the proposed homes would be modular or stick-built. Mr.Carlson noted that the homes will be stick-built. Cody Wooldridge asked if all the utility providers had signed off on the utility plan, specifically Left hand Water. Mr. Cartwright noted that they had spoken with all the utilities and that Left Hand Water would only be along the road, not using the 5' or 7' utility lines. Don Magnuson asked what the plans were for the ditch through the property. Mr. Carlson noted that they have a signed agreement with the ditch company,that there will be a trail along the ditch with an easement as well. Monica Daniels-Mika noted that the applicant may want to add a note concerning this to the utility plan. Don Carroll noted that this is not uncommon, as long as the manholes and water valves are up to the asphalt grade. Cody Wooldridge noted that Central Weld water would not be comfortable with the easements as they are noted, but as Left Hand is providing service and has signed off on the plan, he could not argue with the provisions. Monica Daniels-Mika noted that a past subdivision, Longview, has deviated from the established utility size standards, but further noted that this subdivision only slightly deviated from the established standards and that Longview is zoned R-5 vs. the R-1 zoning of Idaho Creek. Cody Wooldridge noted that he is wary of approving the drastic changes, as this may be seen as a precedent for future subdivisions. Monica noted that if the utility providers would only need 5' of utility easement, why has the request been for -..0 feet? Doug Dalton noted that if the Utility Board decided to deviate from the regulations for the zone,they should note the reasons on the signature block. Cody Wooldridge noted that this does go against the requirements, but that if all the providers were to sign off on the plat their agreement with the utility easement dimensions,they could approve with that condition. Don Carroll moved to approve provided the following conditions are placed on the plat to be recorded: 1. The typical utility design shall be eliminated from the final plat. 2. The Rural Ditch shall be delineated with a 30'foot easement and identified on the Utility Plan. 3. Tract noted as defined on page one of the revised utility plan(dated 10-16-00)shall be noted on tie plat. 4. A 15'defined utility easement shall be delineated on the plat around the perimeter of the entire site, Tract N, Block 14, Lot 1, Tract L 5. All space within tracts A-K and M shall be identified as utility corridors. 6. The open space adjacent to WCR 7.5 and Lot 26-9 of Block 2 shall be identified as a tract and oe used as a utility corridor. 7. To approve the utility easements of 7'backyard, 5'side yards, and 10'front yard with the condition that all utility providers providing service to this site shall approved the above referenced deviation from Section 10.6 of the Weld County Subdivision Ordinance. Cody Wooldridge seconded the motion. The vote was four in favor, one in opposition. Don Carroll noted that he voted against this proposal as it does not follow the requirements of the county. CASE NUMBER: S-578 PLANNER: Anne Best Johnson APPLICANT: Donald LaFaver REQUEST: Lighthouse Cove Final Plat for 8 Residential Lots LEGAL: Lot B of RE-2330, located in part of the N2 NE4 of Section 16, Township 2 North, Range 68 West of the 6th P.M., Weld County, Colorado. LOCATION: One mile south of SH 119 and west of and adjacent to WCR 7 Anne Best Johnson,Planner, presented Case S-578 and noted that Gary Sandau had noted a concern with only one easement between the lots, noted that the usual requirement is for 10'on each side of the lot line. Chuck Miles, Representative of the applicant, stated that this application is Phase two of this subdivision, noting that the first phase was ten lots on the north side of the lake. Jon Deshayes, representative for the applicant, noted that St. Vrain has a place to sign off on the cover sheet. Cody Wooldridge noted that all utilities listed should have a place to sign off. Mr. Wooldridge also noted that the lot lines should have a 10' utility easement on each side of the lot line, but a deviation could be allowed on the lake side. Mr. Deshayes noted that the idea was to keep as little change in the Idaho Creek area. Don Carroll noted that they did not have to use the entire easement if they had worked with the utilities,they just needed to place the easement there in case of a future need. Mr. Deshayes noted that this would be acceptable. Don Carroll asked what setbacks were required from Idaho Creek. Mr. Deshayes noted that the applicant has a Flood Hazard Development Permit which allows them a maximum of 200' of disturbance for Idaho Creek. Cody Wooldridge noted that the 15' easement in the front should be noted as a utility easement Don Carroll moved to approved the plat with the addition of a sign off block for all utilities, a note allowing deviation from the required 15' easement at the back of the lots by the lake, a 10'utility easement on bot'i sides of the lots lines,and identification of the 15'easement as being an utility easement. Cody Wooldridge seconded the motion. Motion carried unanimously. CASE NUMBER: S-562 PLANNER: Anne Best Johnson APPLICANT: Katherine Oliver/ Meadow Vale Phase II REQUEST: Planned Unit Development Final Plat LEGAL DESCRIPTION: Part of the SW4 of Section 4, T2N, R68W LOCATION: North of and adjacent to State Hwy 119; east of and adjacent to WCR 5.5. For a more precise location, see legal. Anne Best Johnson,Planner,presented Case S-562,and noted that Gary Sandau had called with concerns about the legend noting where the fire hydrants were, also noting that he wanted to know where the 10' easements on either side of the lot lines. Floyd Oliver, Applicant, noted that the phone and cable come in through the back easements and the gas and electric come in through the front easements, and stated that he did not see a reason for the 10' easements on either side of the lot lines. Cody Wooldridge explained that this fulfills the requirements of the Subdivision Ordinance, also noting that future utilities may need the access in the future. Mr. Oliver noted that he would still like the side lot easements waived. Al Trujillo noted that power companies sometimes need the easements for street lights. Mr. Oliver noted he still would not like to have the easements along the lot lines. Discussion followed concerning the possibility of changing the easements,as well as if the easement noted for Left Hand was an exclusive easement. Cody Wooldridge moved to approved the plat with the following additions to the Conditions of Approval- Fire Hydrants shall be added to applicable plat legends. 2. All sites designated as "Open Space"shall also serve as drainage and utility easements. An note shall be placed on the plat to this effect. 3. Utility Board granted a variance to not require the applicant to place a utility easement west of the lake (Open Space B). 4. A ten foot (10') utility easement shall be added along the northern boundary of Tract 1. 5. All utility easement dimensions shall be listed on the final plat. All utility easements interior to the residential lots may be reduced to ten feet (10') All uthity easements interior to the residential lots must be on all side lot lines.
