RESOLUTION RE: GRANT MOBILE HOME PERMIT, ZPMH #2208 - PHYLLIS ARNOLD WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, on the 28th day of August, 2000, considered the request of Phyllis Arnold, 39998 Weld County Road 74, Briggsdale, Colorado 80611, for a mobile home to be used as a principal dwelling during a medical hardship, and WHEREAS, said mobile home is to be occupied in an A (Agricultural) Zone District on a parcel of land being more particularly described as follows: Lot A of Recorded Exemption #2138; being part of the N1/2 NE1/4 of Section 10, Township 6 North, Range 62 West of the 6th P.M., Weld County, Colorado WHEREAS, the Board of County Commissioners, having heard all of the testimony, finds that said request should be granted subject to the following conditions: 1. The applicant shall apply for a building permit for the mobile home prior to locating the mobile home on the property. 2. Prior to occupancy of the mobile home, its shall be connected to an approved septic system and a legal water supply. 3. The mobile home shall not be occupied until such time that the applicant has complied with Conditions 1 and 2 stated above. 4. The applicant shall provide documentation to the Department of Planning Services on September 1st of each year, showing that there is still a need for the mobile home. Once the applicant cannot justify the need, the mobile home shall be removed from the property within thirty (30) days. 5. Weld County Road 81 is designated on the Transportation Plan Map as a local gravel road, which requires a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road in not maintained by Weld County. Pursuant to the definition of setback, in the Weld County Zoning Ordinance, the required setback is measured from the future right-of-way line. 6. The applicant shall complete and submit a Weld County Road Access Information sheet to the Weld County Department of Public Works. 7. Pursuant to Ordinance #169-A, if noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds. 9. The applicant shall maintain compliance with Section 43.2.4 of the Weld county Zoning Ordinance at all times. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the request of Phyllis Arnold for permission to place a mobile home to be used as a principal dwelling during a medical hardship on the above described parcel of land, which was found to be in compliance with Section 43 of the Weld County Zoning Ordinance, be, and hereby is, granted subject to the hereinabove listed conditions. She has two sons who are of school age and I serve as their physician. Her current situation requires her to work in Denver for Airborne Express; she has to be at work at 4:00 a.m. and does not get off work until 12:30 p.m. The location of her home makes it ideal for her parents to live on the same property close to Phyllis and their grandsons. This would allow Phyllis to have her mother watch the boys when she leaves for work without having any dangerous situations arise. The boy's father is not in the picture because he is a convicted child molester and cannot be trusted with the boys. Phyllis is in the process of obtaining a divorce and is seeking permanent custody. I would appreciate it if you could grant a waiver or be lenient in your rulings to help this lady. She is trying to keep her family together and still make a decent living for her sons. I have known the family for sometime and the father has never been responsible and has not provided for the children.
