Kirkmeyer, Chair Commissioner M. J. Geile, Pro-Tern Commissioner George E. Baxter Commissioner Dale K. Hall Commissioner Glenn Vaad Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Kim Ogle Health Department representative, Sheble McConnellogue Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated June 19, 2000, and duly published June 22, 2000, in the South Weld Sun, a public hearing was conducted to consider the request of KGF, Inc., do Glen Fritzler, for a Site Specific Development Plan and Use by Special Review Permit#1268 for a Guest Farm in the A(Agricultural)Zone District. Lee Morrison,Assistant County Attorney, made this a matter of record. Kim Ogle, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Mr. Ogle gave a brief description of the location of the site and surrounding uses, and stated that although there will be a Use by Special Review Permit on this property, the site will continue as a productive farm. Mr. Ogle further stated nine referral agencies responded favorably or submitted proposed conditions, four did not respond, and no concerns have been expressed by surrounding property owners. He stated the initial concerns of the Planning Commission have been addressed by the applicant, and the Colorado Department of Transportation (CDOT) has granted an access permit authorizing 50 vehicles associated with the guest farm and 2 vehicles associated with the farm to access onto State Highway 256 daily, with certain improvements to be made to the road. Mr. Ogle stated the LaSalle Fire Protection District has approved the site for medical emergencies and will inspect the site prior to operation. He further stated signs will require appropriate permits,and the on-site landscaping of the parking area will consist of winter wheat or rye, and the Department of Public Health and Environment requests Development Standard #6 be amended to state, "The facility shall utilize portable toilets and self- contained hand washing units for up to ninety (90) days this Fall, 2000." In response to Commissioner Geile, Mr. Ogle stated the applicant is aware of the number of animals that will be allowed on the site as a Use by Right. He reiterated the Landscaping Plan consists of planting the parking area in either winter wheat or rye. Mr. Ogle further stated there is a house and farm outbuildings; however, the permit will allow a barn and concession trailer if /-/Z( P) 2000-1621 PL1415 HEARING CERTIFICATION - KGF, INC., C/O GLEN FRITZLER (USR#1268) PAGE 2 desired in the future. In response to Commissioner Baxter, Glen Fritzler represented KGF, Inc., and stated either winter wheat or rye will be planted in the parking area and the maze and parking area will rotate locations for best farming practices. Responding to Commissioner Geile, Mr. Fritzler stated the Planning Commission requested he submit a letter explaining what landscaping is proposed for the parking area. In response to Chair Kirkmeyer, Mr. Fritzler stated he has reviewed and agrees with the Conditions of Approval and Development Standards as proposed with discussed changes to Development Standard #6. No public testimony was offered concerning this matter. Commissioner Vaad moved to approve the request of KGF, Inc., do Glen Fritzler, for a Site Specific Development Plan and Use by Special Review Permit #1268 for a Guest Farm in the A(Agricultural)Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record and amend Development Standard#6 to state, "The facility shall utilize portable toilets and self-contained hand washing units for up to ninety (90) days this Fall, 2000." The motion was seconded by Commissioner Baxter, and it carried unanimously. This Certification was approved on the 10th day of July 2000.
