Dear Mr. Clancy:
This letter is in reference to the inquiries outlined in your letter dated September 28, 2000, regarding
the Site Specific Development Plan and Special Review Permit (USR-274) for Duke Energy. The
Department of Planning Services' staff has reviewed your request and made the determination that
the proposed changes are not substantial changes to the Special Review Permit. Staff has based
this determination upon the individual items addressed in your letter and the fact that these changes
will bring the facility up to date and provide additional safety to the site. The overall nature of the
permit will not change with this upgrade. Building permits are required for all construction, as
outlined in the Weld County Building Code Ordinance. Please address any concerns regarding
building permits to Dave Sprague, Lead Building Official.

Dear Mr. Sprague,
Per our conversation I would like to explain the construction project that is
taking place at our Roggen facility under USR-274.
We are upgrading two process skids and adding additional equipment necessary
for the upgrade. These are not new process skids.
I hope this explains to your satisfaction what we are trying to accomplish at this
facility. If it does not, please do not hesitate to contact me.
I appreciate your time and your help in expediting this matter. I am also
enclosing the single permit application you requested with the understanding
that the seperate permit applications attached will serve as information backup.

Re: Duke Energy/USR 274
Dear Planning Commission:
Duke Energy appreciates this opportunity to submit information concerning its plans to
replace part of the existing equipment at its Roggen facility. You will note that Duke Energy seeks
only to update existing operations, it does not propose to increase the facility's size or change the
operations on the facility. Therefore, it is our belief that after you have reviewed the enclosed
material, you will agree that the proposed work does not constitute a "major change" which would
require an amendment to USR 274.
As you may know, AMGC Corporation, a predecessor of Duke Energy, purchased the
existing facility in 1995. The facility had been originally constructed pursuant to a USR issued in
1975 and amended in 1993. Duke Energy now would like to update the equipment to enhance its
safety and efficiency.
The areas which require work are highlighted on the enclosed schematic drawing and
summarized in the attached chart. The changes, also summarized below, will effectively make the
facility safer and ensure its continued operation for many years to come:
1. Replacement of original underground pipes with modern above ground pipes and
pipe rack. These new pipes will significantly enhance the safety of the facility. They
are constructed according to the strictest new standards, and, given their above
ground location, their integrity may be more easily monitored. They will not
increase the facility's capacity.
2. Replacement of the control system. The new system will utilize a digital computer
control system rather than the older pneumatic system. This new system will allow

Duke Energy to operate the facility more safely and at better efficiencies. The new
system will also utilize a paging system which will eliminate the older horn system
and allow employees to more quickly respond to any potential problems.
3. Replacement of three Motor Control Centers with one new modern Motor Control
Center. The new Motor Control Center(MCC BLDG)will serve the same function
as three prior buildings, but will of course be more modern, efficient, and safe.
4. Replacement of two Exchangers. (E-2510/11 & E-2513).
5. Installation of Treating Vessels. The treating vessels (V-1003 & V-1004) simply
remove H2S from the gas. H2S is a compound that,unless removed,will concentrate
into liquid and create product quality issues. As a field ages,more H2S is sometimes
found. Given the age of the field, Duke Energy believes it is important to install this
equipment for safety and quality control purposes.
6. Installation of Stabilizer to provide similar but reduced function as existing
Fractionater. The new stabilizer(T-1008, STABILIZER& V-1005) will provide a
similar function to the existing fractionater. Off-site impact will not increase and the
new stabilizer will not increase capacity or change the use of the USR.
7. Replacement of dehydration beds. (V-2004, D-2001 & D-2002).
8. Replacement of Engine and Compressor. (C-6002 & C-6003).
9. Replacement of Heater. (H-7004).
10. Replacement of miscellaneous processing equipment. (V-6010, V-6001, E-1002, F-
1001, V-1000, V-2004, T-2518).
As you will note, Duke Energy will either replace old equipment with new, or install new
equipment to serve the same function as previously existing equipment. Duke Energy is making this
substantial investment to modernize its facility and to keep it operational for many years.
Importantly, these proposed changes will not increase the size or off-site impact of the facility. In
short, Duke Energy will remain well within its permitted capacity, as well as the design and
operational standards for Uses by Special Review.

While this investment will of course benefit Duke Energy, it will also benefit the residents
of Weld County. Adjoining landowners will directly benefit from reduced off-site impacts, local
mineral owners and drillers will be assured of a place to process natural gas, and all Weld County
residents will retain an important tax base.
Unfortunately,because of the size the of the investment,the costs associated with a delay are
enormous. Accordingly,Duke Energy appreciates your willingness to work to expeditiously resolve
this matter. In that regard,I will have company representatives available all day Friday to meet with
you and answer any further questions.
Duke Energy respectfully requests that you determine that the plans do not constitute an
expansion or enlargement of USR 274. However, in the event you determine that an amended USR
is necessary, given the enormous costs associated with any delay, Duke Energy requests that you
authorize an early release of the building permits. In that event, Duke Energy will agree to alter or
modify the equipment in the event the County determines any changes are necessary.
Duke Energy commits to work diligently with the building inspector to complete and assure
continued compliance with any remaining permit requirements. Thank you again for your careful

office.Based on the information submitted by the applicant, the Division has prepared the draft operating permit for
approval.Any interested person may contact Geoff Drissel of the Division at 303-692-3197 to obtain additional
information.Any interested person may submit written comments to the Division concerning 1)the sufficiency of the
preliminary analysis, 2)whether the permit application should be approved or denied, 3)the ability of the proposed
