I object the dust,noise,and the eye soar caused by an extended gravel pit,that Andesite Rock Company
has already developed. Please do not grant them the permit for the sake of the residence of my property
and the residence of Carr,Colorado.
1 request also the information on effect mining gravel in the interest in the minerals of our lands. Again I
strongly object to this extension to the Andesite operation.

Following is a revised map of the amendment area for AmUSR 840. Also attached, for reference, is a
sheet showing the original Reclamation Plan for the amendment.
As I mentioned in our recent conversation, we are revising our Reclamation Plan for the amendment
• area. The original plan called for two storage reservoirs. We have revised the Reclamation Plan to
instead reclaim the amendment area in the same manner as the rest of our currently permitted area
as pastureland.
The mining method for the amendment area will not change.
Briefly, the reclamation method to achieve the final after-use as pastureland is as follows:
Stripped topsoil and overburden are immediately replaced in the preceding excavated portior s of
the mining operation by scrapers following behind the excavator and haul trucks of the mining
operation. Permanent revegetation of the backfilled areas of the current permit site occur within the
same one or two years following the backfilling and topsoiling, preceded by a temporary cover-crop
to enhance the organic content of the topsoil and to preclude erosion, until the permanent grass-
seed mixture can become established. This method of an "over-the-shoulder" reclamation
technique has resulted in very successful and permanent grass stands on the reclaimed mined area
of the current permit site.
Because of the revised reclamation method described above, the amendment area will be reclaimed at
a height much closer to its pre-mining elevation. However, the amendment area will be slightly lower
than the Phase 1 area to its east. We will establish a stormwater retention pond on the eastern
boundary of the amendment area, which will hold water from storm events. The pond will allow tDr
adequate settling time of sediment, should there be any run-off from the area. We will maintain the
pond after reclamation.

Answers to your questions on our revised Reclamation Plan for AmUSR 840.
Contour Lines on the revised reclamation plan:
- Deposit depth and overburden layers are variable in thickness. The contour line on the revised
drawing are our most reasonable estimate of the final grade. Marketplace and deposit gradation will
determine the final layer of granular backfill used in the area. We have traditionally replaced
approximately four (4) feet of material in the excavation.
Detention Pond on the revised reclamation plan:
(Sorry, I miswrote the pond type - it is a detention pond, versus retention.)
- It will be unlined.
- From our experience in the adjacent area, we have found that surface topsoil and overburden are very
permeable. Our experience with large storm events for the past ten years of operation has been that
sheet runoff is minimal. In the case of a storm event, much of the rain water will penetrate directly into
the soil it initially contacts. Excess sheet flow, if any, should follow the contours of the area to the
detention pond, where it should remain until soaking into the ground.
- The area will be vegetated with reclamation, which will also greatly lessen the impact of any storm
events.
-There will be no pipes on- or off-site from or to the pond.
- The pond will be 12 feet nominal depth. It will be approximately 800 by 100 feet. If needed, we will
enlarge and deepen it in the future.
- We have a similar detention pond on the currently permitted area, which is part of our Storrnwater
Management Plan, which has worked well for detaining water in the rare storm events.

Dear Gregg:
Thank you for sending the pre-operational inspection report, As we mentioned when we met at
the site on April 21, 2000, we arc revising our reclamation plan for the amendment area.
The original reclamation plan for the amendment area was proposed to be water storage
re: ervoirs. The revised reclamation plan for the amendment area contains no water storage
re:aervoirs. The amendment area will be reclaimed in the same manner as the rest of our
currently permitted area - as pastureland. A revised drawing of the section is attached.
Fcflowing is a summary of the reclamation method used on the original permitted area:

much closer to its pre-mining elevation than was shown on the original reclamation plan for the

We will establish a stormwater detention "pond" on the eastern boundary of the amendment
area; because during and after mining, the amendment area will be slightly lower than the
Phase 1 area to its east. The majority of the time, there will not be water in the"pond," but in
the case of a storm event, the"pond"will be of an adequate size to hold any excess water from
sheet run-off. Stormwater detention ponds should be able to hold 900 cubic feet of water per
acre. We are mining 83 acres, so the pond will be constructed to hold at least 74,700 cubic
feet The pond will not be lined, to allow for percolation of stormwater into the soil. We will
maintain the pond after mining is completed.
We have a similar detention pond on the currently permitted area, which is part of our
Stormwater Management Plan, and which has worked well for detaining water in the rare storm

maintain a minimum of a 2:1 set-back. In other words, for every 1 foot of depth of excavation,
we will stay 2 feet distance from the cable. We will flag it prior to any mining operations in the
area to ensure that it not be affected in any way.

Dear Kim:
We are in receipt of the petition and letter from Ross DePorter, stating neighborhood concerns
about dust and noise. Thank you for forwarding both documents to us by fax on May 1, 2000
We are writing to address the neighborhood concerns.
We started our Carr operation in 1990 and have gradually built our business volume and
physical plant to our current levels. We operate under a number of state and county permits,
Weld County being the primary authority. We have been inspected on a number of occasions
over the years by both county and state health departments regarding our dust control plan.
The record shows us to be well within compliance. Our sound levels at the property line have
been well under county standards as well.
The predominant wind direction at Carr is from the north-northwest, which places our mining
activities downwind from all the residents and the town of Carr. Our processing plant is
approximately 4000 feet distant from the DePorter house. Therefore, the airborne dust at the
DePorter home is more likely due to the gravel road (Weld County Road 21) adjacent to their
house and the other gravel roads in Carr.
We have sprayed a dust suppression product to control road dust on adjacent county roads
over the past two-years, due to the truck traffic we contributed to those roads. As you know, we
sprayed a magnesium chloride solution on Weld County Roads 124, 17, and 126 during the
past two summers to control dust from the truck traffic while we were supplying the aggregate
material for the CDOT job on 1-25. It is our understanding from the Road and Bridge
Department that the dust suppression worked quite well. Our trucks passed three homes on our
haul route and received no complaints from the owners. We have used the same solution in
front of the DePorter house in the past on WCR 21. There is substantial evidence that the dust
suppression product works well for unpaved gravel roads in rural areas. auk
Regarding the visual and noise impacts of the amendment area, our mining plan for the
amendment area is scheduled to be 1-3 years. Also, the recent revision to the reclamation plan
for the amendment area calls for concurrent "over-the-shoulder" reclamation. Briefly, this
means that the excavated area will be backfilled and seeded almost immediately after the
aggregate material has been removed. Finally, the mining plan for the amendment area
includes a secondary access/haul road along the western side of the area up to WCR 12€. We
could offer to place the road along the eastern boundary to increase the distance to Carr We
would be happy to amend our mining plan accordingly.
Finally, enclosed is a recent inspection report from the Colorado Division of Minerals and
Geology. Please note their satisfaction on our reclamation efforts to date.
We stand behind our record as responsible business people and gravel producers. We have
repeatedly made it clear that we have an "open door" policy to our neighbors at Carr. We would
be happy to meet with any of the residents to discuss these issues face-to-face.

located 600 feet within our property. We believe that the proposed location is too
close to several homes in our community. This is going to cause a lot of unwanted
noise, as well as dust. We are also concerned about the truck traffic and the road
conditions that they cause. This is already a problem with your existing gravel mine.
The roads are nothing but washboards all the way out to the interstate.
Please reconsider your new location.
