LUPTON GAS PROCESSING PLANT This Application for a Use by Special Review Permit ("Application") is submitted by HS Gathering, LLC ("Applicant") in connection with Applicant's desire to construct and operate a natural gas processing plant(the"Plant")on a ten acre parcel owned by Applicant in the NW'% of Section 14,T2N,R66W,Weld County,Colorado. The Plant will be utilized to remove liquefiable hydrocarbons from natural gas and is expected to have a processing capacity of 40,000,000 cubic feet per day(40 MMCFD). The removal of these constituents is necessary in order to meet the gas quality specifications of Colorado Interstate Gas Company("CIG"),to whom the gas is delivered following processing. It will also allow the recovery of certain natural gas liquids such as ethane, butane and propane. The proposed location of the Plant was selected because of its proximity to other, existing natural gas compression and processing facilities, thus making it compatible with existing uses. Specifically,the site is located immediately south of,and adjacent to,Applicant's Ft. Lupton Gas Compressor Station situated on Weld County Road 22. Additionally,North American Resources Corporation operates its Ft.Lupton Gas Processing Plant just to the north of the compressor station, on the north side of Weld County Road 22. A vicinity map is included on the Special Review plat map. The proposed site offers the further advantage of being on land which has not been cultivated and, while zoned Agricultural, is undeveloped range and grazing land. No additional water, sanitation or utility services are required because the facility will be operated as an adjunct to Applicant's existing Compressor Station and those needs will be met by existing facilities and services at the Compressor Station. The Plant will operate 365 days per year, 7 days per week, 24 hours per day and will be designed so that it may be operated unattended. Personnel will check the Plant daily,but will not generally be present throughout the day. The Plant will be operated by the same personnel that operate Applicant's compressor station so it is not anticipated that there will be any material increase in local traffic. An automated emergency shut down system will constantly monitor conditions at the Plant and shut it down in an emergency. In addition,the compressor building will be equipped with fire detectors and combustible gas monitors which will automatically shut down the compressor should either a fire or the escape of combustible gas be detected. A call-out system, operated on an Page I of2 uninterruptible power supply, will notify Applicant of Plant shutdowns or any operational problems. Construction is expected to begin within two weeks from the time Applicant obtains its building permits and the Plant will be operational approximately 5 months after construction begins.The number of persons involved in the construction is not anticipated to exceed thirty(30). Construction personnel will work from 7:00 a.m. to 5:30 p.m., Monday through Saturday. Construction equipment shall include backhoes and small(15T to 25T)cranes. Large cranes(80T to 110T) will be used for one day to set the propane compressor. This Application is the result of a comprehensive analysis of existing and projected future production of natural gas from the Wattenberg Area. The Wattenberg Gas Gathering System currently transports approximately 215 MMCF of natural gas per day to three primary processing plants for further treatment and compression of the gas. These plants include the Amoco Wattenberg Gas Processing Plant(155 MMCFD),the NARCO Gas Processing Plant(55 MMCFD) and the Duke Spindle Gas Processing Plant(5 MMCFD). Because these plants are operating at or near their respective capacities, some producers and operators are unable to sell and market their gas. This, in turn, adversely affects the efficient and economic recovery of gas as well as the economic life of some of the wells in the county. The projected increase in demand for natural gas, both locally and regionally,requires that additional treatment and processing capacity be provided and it is Applicant's belief that this Plant can provide that additional capacity with minimal impact on neighboring property and owners, and in a manner that is consistent with existing uses and the objectives of the Weld County Comprehensive Plan. USE BY SPECIAL REVIEW APPLICATION SECTION 3 SPECIAL REVIEW QUESTIONNAIRE HS GATHERING, LLC Proposed Ft. Lupton Gas Processing Plant Township 2 North, Range 66 West Section 14: SW4NW4NW4 Weld County, Colorado USE BY SPECIAL REVIEW QUESTIONNAIRE HS GATHERING, LLC PROPOSED FT. LUPTON GAS PROCESSING PLANT 1. Explain, in detail,the proposed use of the property. HS Gathering, LLC, (the "Applicant")proposes to construct and operate a natural gas processing plant(the "Plant")which will have the capacity to process 40,000,000 cubic feet per day (40 MMCFD) of raw natural gas from the Applicant's Wattenberg Gathering System. The Plant is designed to separate and remove natural gas liquids (e.g., propane, butane, ethane) from the gas as required by the purchaser of the gas, Colorado Interstate Gas Company. After processing and the removal of these components, the residue gas will be delivered to Colorado Interstate Gas Company for transport to market and the recovered natural gas liquids either will be pumped to NARCO's fractionation facility located one quarter mile northeast of the proposed Plant site, or sold and transported by pressurized truck directly from the Plant. The principal component of the Plant involves the separation of the natural gas liquids (NGL's) from the gas by chilling the gas using a closed propane refrigeration system and removing the condensed liquids. The liquids will be stabilized to produce an NGL stream which can then be removed from the site in pressurized tank trucks. In addition, ethylene glycol will be injected into the gas stream during processing to remove any remaining water. Public Service Company of Colorado will provide fuel gas to the Plant utilizing existing facilities for use in connection with Applicant's Ft. Lupton Gas Compression System. Likewise, the Plant will take advantage of existing restroom and drinking water facilities at the compressor station so there will be no additional domestic water or sanitation needs. The Plant will operate 24 hours per day, 7 days per week, 365 days per year and will be designed to be unattended for approximately 16 hours per day. A safety shutdown system will shut down the Plant if required for safety reasons and will notify operators during unattended operations. The emergency shut down system will utilize automated valves to shut off gas into and out of the Plant and to vent the gas contained in the compressor building. The compressor building will be equipped with fire detectors and combustible gas monitors which will automatically shut down the compressor in emergencies. A twenty(20) foot perimeter road will be installed on the property to provide access to the fire department and other emergency services. Ordinary debris, trash and waste will be disposed of by commercial dumpster services. Other waste, such as compressor lube oil and rags that have been contaminated with lube oil or NGL's, will be transported from the property to approved disposal facilities using certified transporters. Page 1 of 6 2. Explain how this proposal is consistent with the intent of the Weld County Comprehensive Plan. Because of its proximity to existing, similar facilities and the avoidance of any encroachment on agricultural, residential, or other incompatible land uses, this proposal comports with the intent and stated goals of the Weld County Comprehensive Plan(the "Plan"). The Plan states that one of the most important considerations in land-use planning is the way the land is presently used. As noted elsewhere herein, the existence of Applicant's compressor station and NARCO's gas processing facility within the immediate vicinity of this location means that similar uses can be assembled in a consolidated and coordinated manner. Utilities, services and roads already exist so there is no need for the expansion or extension of new facilities and services into areas where they do not already exist. In particular,this proposal avoids any interference with the operation of prime farmland within the County or encroachment upon residential or other potentially incompatible land uses. It will also contribute to the expansion of the County's industrial economic base by providing an essential function in the treatment and marketing of natural gas produced in the County. The Plant will not be a consumer of water, thereby contributing to the goals of water conservation and maintenance of water quality. The proposal is also consistent with one of the overriding themes of the Plan, which is that new developments,projects and facilities are to"pay their own way." The operation of the Plant will not impose any new burdens or costs upon the County and will be a self sustaining operation. 3. Explain how this proposal is consistent with the intent of the Weld County Zoning Ordinance and the zone district in which it is located. Section 24.1 of the Weld County Zoning Ordinance ("Ordinance") contemplates and specifically provides for circumstances in which a particular land use is determined to be more intense or to have a potentially greater impact than uses otherwise allowed. That is the purpose of the Use by Special Review. In this case,the proposed location of the Plant is in the Agricultural Zone District and, therefore, additional consideration is necessary to ensure that it is established and operated in a manner that is compatible with existing and planned uses in the neighborhood. Ordinance Sec. 24.1.1. In this case, compatibility with existing uses is assured because the Plant will be located adjacent to an operating natural gas compressor station and within one-quarter mile of an existing gas processing plant. No currently productive agricultural lands or residential areas will be impacted. The treatment and processing of natural gas produced in Weld County is a necessary component of marketing this valuable resource. Providing additional capacity to accomplish this will not only foster the development of an important economic base (Ordinance Sec.4.1.7)but, in so doing, will contribute to the convenience and general welfare of the present and future residents of the County(Sec. 24.1.1). The Plant will contribute to the County's tax base (Sec. 4.1.5)with little or Page 2 of 6 no adverse impact in terms of additional roads (Sec. 4.1.1) or other governmental expenditures (Sec. 4.1.6). In short, Applicant believes the proposed Plant is ideally suited to be located at the site that has been proposed,notwithstanding the fact that the zone district for that location will not permit its construction as a Use Allowed by Right. Because it is not being utilized as agricultural land, and there is no reasonable foreseeability that it would be so utilized, this proposal presents an ideal circumstance in which to permit a Use by Special Review. 4. What type of uses surround this site? Explain how the proposed us is consistent and compatible with surrounding land uses. The Plant is proposed to be located in a remote, rural area in the vicinity of an existing natural gas compressor station and an existing natural gas processing plant. As such, it is consistent and compatible with those land uses. The subject property and the remainder of the surrounding land is undeveloped range land. The soil for the property is composed of Valent sand with limited potential for agricultural development due to its sandy texture and high permeability. The nearest residential property is located approximately 4400 feet from the site and it is not anticipated that operations at the Plant will have any material impact on that residential property. Pictures of the proposed site and the adjoining compressor station are attached. 5. Describe, in detail,the following: a. How may people will use this site? Employees, maintenance personnel, contractors and representatives of other companies may be present at the site from time to time,but normally the Plant will be unattended. A maximum of 10 people may be at the site at one time. b. How may employees are proposed to be employed at this site? The Plant will be operated by the same personnel that currently operate the Ft. Lupton Compressor Station located adjacent to the proposed Plant. Two operators currently operate the compressor station for 8 hours per day. c. What are the hours of operation? The Plant will operate 24 hours per day, 7 days per week, 365 days per year. Page 3 of 6 d. What type and how may structures will be erected (built) on this site? Major equipment to be installed at the site includes: 2-Process Skids, approximately 12'x35' 1-Ethylene Glycol regeneration skid, approximately 10'x25' 1-Propane refrigeration compressor 1-30'x40'x25' eve, steel building to house propane refrigeration compressor 3-30,000 gallon,pressurized liquids storage tanks The process skids are portable skids supporting the process equipment. None of the process skids will be enclosed in buildings. The building housing the propane compressor will be similar in design and will be the same color as the existing buildings at the compressor station located adjacent to the proposed Plant. Three, 30,000 gallon,pressurized liquids storage tanks will be installed to store the NGL's. The tanks will be similar to the tanks located on the compressor station site and similar to the storage tanks at North American Resource Company's Ft. Lupton Plant located one quarter mile northeast of the proposed Plant site. e. What type and how may animals, if any,will be on this site? None. f. What kind (type, size,weight) of vehicles will access this site and how often? Operating personnel will use pickups to access the site each day. In the event the Company sells its NGL's by pressurized truck,between 3 and 7 trucks per day will use the site to pickup NGL's. The trucks will be tractor/trailers with 250 psig vapor pressure trailers transporting 40,000#of liquids. g. Who will provide fire protection to the site? The proposed Plant is located within the Ft. Lupton Fire Protection District. The compressor building will be equipped with combustible gas monitors and fire detectors. The combustible gas detectors will detect potential combustible gas levels before they reach an explosive level and will shut down the station and close inlet and outlet block valves. The fire detectors will shut down the plant and close inlet and outlet block valves. h. What is the water source on the property? (Both domestic and irrigation) Page 4 of 6 There are no domestic or industrial water requirements for the proposed Plant. i. What is the sewage disposal system on the property? (Existing and proposed) There are no sewage disposal needs at the Plant and there will be no system installed for that purpose. j. If storage or warehousing is proposed,what type of items will be stored? Three, 30,000 gallon,pressurized liquids storage tanks will be installed to store the NGL's. 6. Explain the proposed landscaping for the site. The landscaping shall be separately submitted as a landscape plan map as part of the application submittal. There is no landscaping proposed for the site. Unused areas will remain undeveloped range land. 7. Explain any proposed reclamation procedures when termination of the Use by Special Review activity occurs. Applicant will remove all above ground equipment and any concrete structures within 18 inches of the land surface. (This should be amplified. Any grading? Cleaning up of spills?) 8. Explain how the storm water drainage will be handled on the site. Applicant will utilize collection ponds and silt fences as necessary to control erosion both during construction and final operations in accordance with a Stormwater Discharge Plan and permit which Applicant will obtain from the Colorado Department of Health. 9. Explain how long it will take to construct this site and when construction and landscaping is scheduled to begin. Construction is expected to begin within two weeks of obtaining the required building permits. The Plant will be operational approximately 5 months after construction begins. The maximum workforce for the Plant construction is estimated to be 25 construction personnel. Page 5 of 6 10. Explain where storage and/or stockpile of wastes will occur on this site. There will be no storage and/or stockpile of wastes at this site.Normal waste including paper trash will be disposed of utilizing commercial dumpster services. Other waste from the plant will include: 1.) Used compressor lube oil 2.) Lube oil or hydrocarbon liquid contaminated rags Used lube oil will be transported away from the site using certified transporters. Any spill reporting or remedial actions will be the responsibility of HS Resources, Inc.'s Environmental Affairs Manager. Contaminated rags will be transported off site to approved disposal.
