Environmental Protection Services has reviewed this proposal and recommends
for approval, subject to the following conditions:
1. All liquid and solid wastes, shall be stored and removed for final
disposal in a manner that protects against surface and groundwater
contamination.
2. Required Emissions Permit is obtained from the Air Pollution Control
Division, Colorado Department of Health for fugitive dust and odors.
3. No permanent disposal of wastes shall be permitted at this site.
4. The septic system for the proposed office is required to be designed
by a Colorado Registered Professional Engineer according to the Weld
County Individual Sewage Disposal Regulations.
5. An ISDS Evaluation on all existing septic systems will be necessary
prior to issuing the required septic permits on the existing
systems.
6. All waste materials shall he handled, stored, and disposed in a
manner that controls fugitive dust, blowing debris, and other
potential nuisance conditions.
7. Fugitive dust must be confined on this site and a dust abatement and
control plan must be submitted and approved by this department .
8. Required NPDES Permit shall be obtained from the Water Quality
Control Division of the Colorado Department of Health, and/or
amended if appropriate for the ii creased operation.
9. Maximum permissible noise level shall not exceed the industr:ia-_
limit of 70 db (A) , as measured according to 25-12-102, Colorado
Revised Statues.
10. The Division requires that this facility provide restrooms and,/or
vaulted toilets. Portable toilets are not acceptable under the Weld
County Regulations.

PLANNING COMMISSION FUNCTION:
To review the proposed amendment to a Use by Special Review (USR) for compliance
with the City of Greeley Comprehensive Plan and make a recommendation to the Weld
County Planning Commission.
PROJECT BACKGROUND AND OVERVIEW:
The applicant is requesting an amendment of the USR to release a 16.32 acre portion of
property from an existing permitted sand and gravel mining operation. The property is
being conveyed to the Poudre Learning Center. The Learning Center plans to develop
outdoor educational facilities that focus on the natural geology and ecology of the local
environment on the released portion of the property. The development of the Learning
Center will be reviewed under a separate administrative process. The balance of the site,
consisting of 49.4 acres south of the Cache la Poudre River, will be mined by the Weld
County Public Works Department over an estimated five year period. The Learning
Center will develop the balance of the property for additional educational purposes after
the site is mined and reclaimed as a lake.
The site is within the City of Greeley's Long Range Expected Growth Area(LREGA).
which is the area that is anticipated for growth in the next twenty years. The site is also
directly adjacent to the City of Greeley municipal boundaries. The Poudre River Ranch
development is directly east of the property under consideration and east of 83`d Avenue.
The final phases of this mixed residential and light commercial development is in the
planning process.

KEY ISSUES AND ANALYSIS:
Does the request comply with the City of Greeley Comprehensive Plan?
The following Comprehensive Plan policies apply to this request.
Comprehensive Plan Policy 5.3
[The City should] insure that proposed land use developments do not permanently
preclude the extraction of commercial sand and gravel deposits on a case by case basis
until such time that a detailed mineral extraction plan is adopted
Staff Comment: According to the Weld County Planning Department, the southern
portion of this property being released for the Poudre Learning Center does not contain
the same quality or quantity of mineral resources that exist on the balance of the property
and was not considered for mining in the original plan. The area was to be used for stock
piling overburden. The sand and gravel operation will continue on the northern portion of
the property. The requested amendment to the permit does not permanently preclude the
extraction of commercial sand and gravel deposits.
Comprehensive Plan Policy 5.4

Staff Comment: The reclaimed site will contain a 27-acre lake with an outdoor education
center. While not part of this application, the Poudre Learning Center plans to eventually
utilize the entire property for outdoor education. The Poudre River Trail is directly
adjacent to the Learning Center's southern property line. The trail system and the outdoor
learning center are complementary to each other. The natural environment and anticipated
future land uses are enhanced by the proposed amendment to the USR.
ADMINISTRATIVE REVIEW TEAM:
The Administrative Review Team informally reviewed this item on August 14, 2000.
There were no comments regarding this request.
RECOMMENDATION:
Planning Stair recommends that the Planning Commission find that the requested
amendment to a USR is located in the City of Greeley's Long Range Expected Growth
Area (LREGA), and that the request is consistent with the City of Greeley Comprehensive
Plan policies:
5.3 • The requested amendment to the permit does not permanently preclude the
extraction of commercial sand and gravel deposits;
5.4 - The natural environment and anticipated future land uses are enhanced by the
proposed amendment to the USR;
And recommend approval of the request to the Weld County Planning Commission.

General Overview
The 83'Avenue Development Pit is located in the central part of Weld County, three miles west
of the City of Greeley, CO, at 83`d Avenue and WCR 64. Hall-Irwin has just transferred the
Mineral Reclamation Permit and Succession of Operators to Weld County.
Weld County is mining the Herbst Pit to the west of the 83rd Avenue Development Pit at the
present time. We are amending the application to show the area where we ask for the release of
16.32 acres. This area shall be used by the Poudre Learning Center as an education site.
Weld County will make use of this additional gravel area to obtain sand and gravel for use in the
immediate quadrant of county roads to eliminate long hauling distances.
This procedure establishes an intermittent use of the pit. The mining plan is to haul material to
county roadways in the vicinity when the need arises.
Operating equipment will consist of a dozer, loader, trucks, and crusher plant.
Weld County has agreed through the Succession of Operators to mine and operate the pit the
same as permitted.
