HomeMy WebLinkAbout20003251.tiff RESOLUTION RE: APPROVE CORRECTED QUIT CLAIM DEED AND AUTHORIZE CHAIR TO SIGN - MARK A. HILL WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on February 22, 1995, the Board did approve Resolution #950259 for a Quit Claim Deed to Mark A. Hill, and WHEREAS, the Board has been presented with a Corrected Quit Claim Deed between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, and Mark A. Hill, Landmark Oil and Gas Properties, 10115 West 25th Avenue, #5, Lakewood, Colorado 80215, with terms and conditions being as stated in said corrected Quit Claim Deed, for property described as a strip or parcel of ground 20 feet wide within the boundaries of the NW1/4 of Section 6, Township 2 North, Range 62 West of the 6th P.M., Weld County, Colorado, and WHEREAS, after review, the Board deems it advisable to approve said corrected Quit Claim Deed, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Corrected Quit Claim Deed between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, and Mark A. Hill be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said corrected Quit Claim Deed. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 27th day of December, A.D., 2000. Hill,of the second part. WITNESSETH,that the said party of the first part, for and in consideration of the good and valuable consideration,to the said party of the first part in hand paid by the said party of the second part, the receipt whereof is hereby confessed and acknowledged, has remised, released, sold, conveyed and QUIT CLAIMED, and by these presents does remise, release, sell, convey and QUIT CLAIM unto the said party of the second part, its heirs, successors and assigns, forever, all the right, title, interest, claim and demand which the said party of the first part has in and to the following described lots or parcels of land situate, lying and being in the County of Weld and State of Colorado,to wit: A strip or parcel of ground 20' wide within the boundaries of the Northwest Quarter of Section 6 in Township 2 North, Range 62 West of the 6th Principal Meridian and described as follows: Commencing at a point 60' south and 100' east of the Southwest corner of Block 1 of the Town of Roggen; thence, east 300';thence, south 20'; thence, west 300';thence, north 20'to the point of beginning; it being the intent to convey by this instrument the north 20' of the east 300'of the property conveyed to The Colorado Milling& Elevator Company, a corporation then duly organized and existing under the laws of the State of Colorado, by deed dated October 22, 1918, recorded on November 22, 1918 in Book 509 at page 87 of the records of Weld County, Colorado. TO HAVE AND TO HOLD the same,together with all and singular the appurtenances and privileges thereunto belonging or in anywise thereunto appertaining, and all the estate, right,title, interest and claim whatsoever, of the said party of the first part, either in law or equity,to the only proper use, benefit and behoof of the said party of the second part, heirs and assigns forever. IN WITNESS WHEREOF, the said party of the first part has hereunto set its hand and seal the day and year first above written. THIS CORRECTED QUIT CLAIM DEED is being approved and recorded for the purpose of correcting the legal description set forth in the original quit claim deed between the parties dated February 22, 1995, and recorded in the Office of the Weld County Clerk and Recorder on March 3, 1995, at Book 1482, Page 508, Reception Number 2428836. IN WITNESS WHEREOF, I,Barbara J.
