EXPLANATION B
THE MARINA AND OTHER LAKE FRONT FACILITIES
• The plans for the marina are as finally approved by the U.S. Corps of Engineers who
maintain jurisdiction over the waters of the Milton Reservoir. Certain wetland
mitigations required by the permit are shown.
Due to the annual fluctuations in the level of the reservoir the bottom of the marina and
access channel will be &edged to a depth of elevation 4785'.
The floating docks to be constructed are shown along the west end and north side of
this &edged area. These docks will accommodate a minimum of 20 sailboats or
small motor boats of not more that 5 horsepower. Additional capacity can be added
perpendicular to these at the piling locations. A dockmaster's building will control the
access to the boat ramp and paved boat trailer parking. This building will also
contain toilet facilities for the boat owners.
The east end of the peninsula south of the marina will be used for the launching of
wind surfers, canoes, and small fishing dinghies, pontoon floats, Hobie cats, sunfish
and chil&en's paddle boats, all of which can be done by hand. A swim beach is not
included (11.4). The hill on the south side will be gaded down and will have a picnic
area with shelters as shown.
North of the marina the clubhouse will be built on the high Bound overlooking both
the lake and the marina. Separate new plans (1.0) for this facility accompany this
submission, including new landscaping plans. The plans in the original submittal no
longer complied with the A.D.A. This facility includes a large member's meeting
facility, exercise rooms, and &essing rooms. A 30' by 50' swimming pool with larger
deck area. two tennis courts. and approximately 60 parking spaces.
EXPLANATION A
THE EQUESTRIAN CENTER
At the time the original zoning application was approved the Beebe Draw Farms
. Equestrian Center had been in operation for over 3 years as the only complete
eventing center on the Northern Front Range. It conducted many events each spring
and summer including three Rocky Mountain Area IX (six states) Championships, and
many pony dub and young rider events. After five years of successful events and
national recognition in the United States Combined Training Association progams, it
became apparent that due to business conditions the housing development plans
were being significantly delayed. The equestrian center operations for the benefit of
homeowners use had always been the integal part of the development planning, so
its operation of outside events was discontinued the following year.
Now that the development has finally been restarted it has been determined that
conditions for the eventing portion of the Beebe Draw Equestrian activities has so
dramatically changed that it is no longer feasible to try to reestablish those activities
after 10 years of being absent from the scene. All of those portions of the progam
planned for the benefit of the homeowners will still be provided, but the outside
competitive events will not be pursued by the developers.
The more than two miles of cross country courses at the higher levels for proficiency
which had been completed are still available for training. The 19 plus miles of riding
trails through the open space Been belts will be maintained for the use of the
homeowners. The major emphasis will stay on western pleasure riding and
instruction.
Stabling for homeowners who request it will be built and operated in increments as
needed, and a training ring (item O.) or rings for riding instruction will be built. The
indoor arena and the stadium jumping and dressage fields will not be built or
maintained since they were planned for the competitive eventing which has been
eliminated from the progam.

Dear Pam:
On behalf of Beebe Draw Farms Metropolitan District, I would like to offer the following in response to
your comment letter dated March 14., 2000.
Environmental/Building Setback Zones
The Environmental Zone is restricted from any and all development activities,but the Building Setback
Zone allows for construction of any items other than permanent structures, i.e. homes or garages. The
Building Setback Zone does allow for septic and/or replacement septic systems to be constructed in that
area.
Picnic Shelter and Stables
Accommodations for public restroom facilities will be made in the site plan development for these areas. It
is anticipated that a separate vaulted system will be used for the picnic area,and each stable will include
appropriate permanent facilities when constructed,in accordance with County site plan requirements.
Comments:
Primary and secondary septic systems envelopes shall he designated on each lot. Each envelope must
meet minimum current setbacks as specified in the Weld County Individual Sewage Disposal System
Regulations.
This request is not practical nor reasonable to fulfill because builders will be constructing homes on lots for
many years to come, and this provision restricts future builders from assessing each lot individually,
thereby severely impacting the salability of the lots. Because each lot is evaluated by each builder
individually, the best lot layout is determined at Plot Plan, which also includes application for and
individual septic system permit through Weld County. This permit process requires the builder to have
primary and secondary(replacement)systems designed by a Colorado Professional Engineer.
2. The clubhouse and dockmaster septic system envelopes shall be a minimum of 200 feet from Milton
Reservoir.
This requirement shall be met at Site Plan for each of these structures. The primary reason for including
items located in Outlot A of the approved Filing 1 is to provide assurance with the original amenity
requirements set forth in the approved P.U.D.,not as a part of review for Filing No. 2.

3. The picnic shelter area shall provide, at a minimum permanent, vaulted restroom facilities. A vault
facility similar to a rest area or park service facility is recommended Permanent restroom facilities,
with septic tank and absorption_feld area required for public use at the stable.
Again, septic systems for all structures shall be designed per Weld County regulations at the time the
individual sites are developed.
4. Language for the preservation and/or protection of the second absorption field envelope shall be
placed in the development covenants. The covenants should state that activities such as landscaping
(i.e.planting of trees and shrubs) and construction (i.e. auxiliary structures, dirt mounds, etc.) are
expressly prohibited in the designated absorption field site.
The site covenants for the entire project were approved with the formation of the Beebe Draw Farms
Metropolitan District, including all environmental and landscaping restrictions. All agencies were allowed
comment prior to approval.
5. A Weld County Septic Permit is required for each proposed septic system and shall be installed
according to the Weld County Individual Sewage Disposal System Regulations. Each septic system!
shall be designed for site-specific conditions, including but not limited to maximum seasonal high
groundwater,poor soils, and shallow bedrock
Each lot and accessory structure requiring a septic system has included or will include a designed system
per Weld County regulations.
6. The Right to Farm covenant shall be recorded on the plat.
The note will be added as requested.
7. Stormwater from and/or through the equestrian center must be contained on the equestrian center lot.
Management of the manure and Stormwater must comply with the Confined Animal Feeding
Operations Control Regulations.
Stormwater management will be addressed for the equestrian center at the time of Site Plan design for
construction. All applicable regulations will be adhered to or met.
The comments from previous referrals are again noted,and have and/or will be met.

RESPONSE TO PLANNING/REFERRAL CONCERNS
Dear Monica:
On behalf of Beebe Draw Farms Metropolitan District,we would like to offer the following responses in
return to the concerns expressed by Weld County and other referral agencies associated with this project
We have compiled these responses with the intent of stating the concern or question first,followed by our
project team's response,in order to maintain organization of the issues.
Response to the letter from Monica,dated March 10, 2000
General Statement
Please note that there has been a Final Plat submitted,as well as a Final Master Plan, including
Landscaping and Amenity Plan drawings. We have done our best in separating out the comments we feel
are applicable to each particular drawing,and have addressed them as such, and would very much
appreciate any reviewing agencies io differentiate between the drawing sets carefully so as to avoid
confusion when commenting on these drawings.
Overall Site Information
Number of Users of the Amenities
1. There will be a total of 724 lots in both filings of Beebe Draw Farms.
a. Projections are for a 90%build out over 10 years,approximately
600 families.
b. The intention has always been to complete the development and the
amenities in phases.
The Equestrian Facilities
v: I.The Number Of Horse Owners
It is impossible to predict the exact number of property owners who will have horses,but if 10" ,
had two horses each that would equate to 120 horses on a 3,484 acre development or one horse per
each 29 acres.
2. Horse Riding Trails
There are approximately 19 miles of horse riding trails.
a. The trails will be maintained by the Metropolitan District.
b. Use is restricted to property owners and their families or people renting stables.
c. Trails will be available for use after the recording of Filing 2.
d. Trails will be marked by directional signs and a map will be available.

e. The trails will not be lighted and are intended for daylight use.
f. Safety rules will be distributed to horse owners and will be strictly enforced.
g. Trails will be used at the owners risk,but the Metropolitan District will carry appropriate
liability insurance.
3. Need and Use of Stables
Forecasting the need for and use of stabling is very difficult for the following reasons:
a. A number of the larger lots in each Filing that back to green belt open space have been designated
to permit stabling and paddocks.
b. In the First Filing 40 of the 188 lots, or 21%are designated horse lots.
c. In Filing 2. 105 of the 536 lots are designated horse lots,also 21%.
d. Some buyers who never intend to own horses want to purchase a designated horse lot for resale
value.
e. Other horse owners work with specific trainers and want to stable at the barns where their framers
are.
The present sampling from sales is much too small to make a valid forecast of the need for stabling. but
with with 21%of 724 or 145 designated horse lots and more than 100 acres available for equestrian
facilities,there is more than enough space to build blocks of stables as needed.
4. Building Stables to meet Demand
a. Stables will be built in phases as demand from property owners dictates.
b. Property owners who want to stable a horse will sign a waiting list. When there are 10 properly
owners on a list a block of 16 stables will be built by the Metropolitan District.
c. Additional stable blocks of 16 will be added using the same method.
5.Equestrian Manager(s)
a. The Equestrian Manager(s)position should be considered an on call 24 hours per day job.
b. The Equestrian Managers residence will be a three bedroom,two bath home that will be built
when the first block of stables are built.
c. The Equestrian Manager may be a professional horse and riding trainer.
d. The Equestrian Manager will have the option to offer training to people who are not property
owners within the development)
e. The Equestrian Manager may lease stable space to people who are not property owners within the
development,with the property owners having priority.
6. Horse Competitions&Events
a. The equestrian facilities will bell)Li 1:1 I I operated for the benefit of the property owners and tlic
outside individuals and trainers who arrange to use them through the Equestrian Manager.
b. The outside competition events that were held at Beebe Draw Farms during the late 1980s wi II not
be pursued by either the Metropolitan District or the Property Owners Association.
c. The Metropolitan District or the Property Owners Association may elect to lease the equestrian
facilities to an organizer or association to conduct horse competitions and events.
7. The Outdoor Training Ring
a. The 150x300 Outdoor Training Ring may be used for western training such as barrel racing or
gymkhanas,as well as for the American Show Horse events of dressage and stadium jumping

Specific Comments
1. The scales on the map are not consistent.
Response: We are not certain of which maps are being compared here,but would offer that not all
drawings can be of the same scale,due to the need to effectively depict the necessary information.and
that each drawing has a graphical and numerical scale placed on it to avoid ambiguity.
2. There is some concern that the match lines do not correlate, and I am asking that the applicant shine a
taped together plan.
Response: If this comment relates to the Final Nat,we have checked that the entirety of the Plat
correlates to the key map given on the cover page, and that the match lines do indeed match. A key
map has been added to each sheet to further aid in location of the drawing in relation to the project
3. (Fax illegible) The map needs to be redone so one configure out where he is in relationship to the
entire subdivision.
Response: Again,we are uncertain as to which map is begin referred to in this response, but arc
assuming it is the amenity plan map. These plans have been reconfigure onto three large scale sheets
to better assist in relating all of the property as a whole.
4. Additionally, the applicant is recommending that they are eliminating.some amenities, only to repi i,:r
them at a later time. The applicants do not have the opportunity to do this, they do need to adhere
those uses that were part of the intent of the change of zone.
Response: There is no intent of eliminating any of the original amenities, only the phasing of them is
they will be needed and used during the five phases of Filing l and the seven phases of Filing 2 All of
the original amenities and activities for the property owners are include and in some cases enhanced
over the life of the project.
5. We need more information concerning the equestrian manager and the uses of that activity. is the
structure for someone to reside in, or is it an 8-5 type of occupation?
a. The Equestrian Manager(s)position should be considered an on call 24 hours per day job.
b. The Equestrian Manager_s residence will be a two bedroom,two bath home that will be built
when the first block of stables are built.
6. There is no recommendation of parking in relationship to the amenities plan.
Response: The amenity plan for the Property Owners Clubhouse shows parking for 110 vehicles.
7. The site circulation cannot be evaluated by public works until we have had the opportunity to look.a
the roadways in conjunction to the amenities plan (getting people to and from these uses is a question

the connection from the residential portion of the property to the Recreational Outlot. Additionally we
submitted plans last year for the Marina Road extension from Beebe Draw Farms Parkway to the
Outlot,and as a result that road has been constructed.
8. Future RU/Boat parking-we are unable to tell if that site is appropriately sized, as we do not know the
number of users, nor do we know the type of physical amenities associated with that proposed parking
lot, this information needs to be included.
Response: The RV/Boat and Trailer parking lot as shown on the Amenity Site Plan will consist of
more than 8 acres with a road base surface, surrounded by an 8 foot chain link fence with locked gates

at each end. Property owners who own items which prohibited in the Covenants from being parked on
their lots or on the streets of the subdivision may rent a space from the Metropolitan District to store
these items. All renters will have keys.
This lot will accommodate 140 large units. Should additional space be needed, a second lot will be
built north of the Equestrian Center.
9. Applicant needs to know that a Site Plan will be required on all amenities
Response: The applicant is aware of this requirement and will prepare the necessary items at that tune

to specifically include whether or not they are including special activities or special events. The
applicant needs to know that this application at this point is limited to no overnight housing.

Response: The Property Owners Clubhouse will be for the private use of the individual property
owners,their families and their guests.
a. It will be locked at all times and every property owner will have a card key for access.
b. The top entry level floor contains a large great room which may be rented by property owners for
private parties, receptions and meetings.
c. Should a larger hall be required for HOA Meetings,a hall will be rented outside the subdivision_
d. The top level also contains an office, restrooms, cloak storage, fireplace,a catering kitchen, a
lounge area,and an outdoor deck.
e. The lower walkout level includes a large open room which may be used by the properly owners to
organize exercise groups or other activity groups as they wish.
The lower level also contains a mechanical/storage room, elevator mechanical room, restroon:s
and dressing facilities for the outdoor swimming pool.
g. The swimming pool will be on a separate deck area approximately 50 feet from the Property
Owners Clubhouse and will be security fenced with locked gates and card key gate access.
h. Parking for the Property Owners Clubhouse, swimming pool, and tennis courts as shown on the
Amenity Plan,will accommodate 110 vehicles.
i. Property owners wishing to use the swimming pool will be able to go directly to the pool from the
parking area without going through the clubhouse.

1. Access doors encompass the entire upper level of the building and the upper level deck runs all the
way around the building with stair access to the walkout level and deck area below.
in. The Property Owners Clubhouse is not intended for overnight use
12. We need more information concerning the dockmaster structure-if this is for overnight housing, who
will utilize this site-this parking lot does say this includes paved trailer parking-there is no indication
as to whether or not they have accommodated the long vehicles for towing boats and similar facilities.
Response: The purpose of the Dockmaster is to control access to the marina and to supervise the
launching and removal of boats, assign docking, control parking of towing vehicles and trailers.
a. The Dockmaster's building will include an office restrooms, and a waiting/meeting room where
boat owners may hold meetings.
b. Rules and Regulations of the Property Owners Association governing boating and fishing
activities on the lake will he post outside the Dockmaster's building.
c. The parking area shown on the Amenity site plan will accommodate 100 towing vehicles with
trailers. Several acres are available for more.
d. The Dockmasters building is not intended for overnight use.
13. The clubhouse/tennis court area does not show any pedestrian circulation or parking plan for the
clubhouse/tennis court activities.
Response: The Property Owners Clubhouse, swimming pool,and tennis courts arc for the use of time
private individual use of the property owners,their families and their guests only.
a. Parking for the Property Owners Clubhouse, swimming pool, and tennis courts as shown on Ilk
Amenity Plan,will accommodate 110 vehicles.A
b. Property owners wishing to use the swimming pool will be able to go directly to the pool from the
parking area without going through the clubhouse.
c. Tennis players may also go directly to the tennis courts from the parking area without going
through the clubhouse.
d. The Property Owners Clubhouse provides a turn around drive way with a porte-cochere covered
entry for drop off during bad weather.
e. The swimming pool will be on a separate deck area approximately 50 feet from the Property
Owners Clubhouse and will be security fenced with locked gates and card key gate access.
f The tennis courts will be on a separate area surrounded by a planted natural wind break
approximately 100 feet from the Property Owners Clubhouse and will be security fenced with
locked gates and card key gate access.
g. None of these areas are intended for overnight use.
14. The applicant must remember that any building, even a gazebo, that exceeds 120 square feet does need
to have a building permit.
Response: The applicant is aware of the building permit requirements for the site and will ensure that
proper permits are secured for all applicable structures.
15. The applicant needs to show that the lots which front onto the environmental buffer zone need to show
building envelopes, the lot sizes are small enough that the placement(f a septic and existing septic
system maybe an issue—as previously asked the applicant needs to show building envelopes on all of
these lots with potential amenities
Response: The lots which front onto the environmental buffer zone DO SHOW the building envelopes.
a. The environmental buffer zones only prohibit structures and do not effect placement of septic:
systems.

b. There are no amenity uses connected with the environmental buffer zones.
16. The addressing plan is inappropriate and will not be accepted by Weld County-several of the Cu!dr
sacs(for example cul de sac 3) are repeated multiple times throughout the plan and is not appropriate-
the applicant does need to show and propose the existing addressing system or the county will propose
one that meets county standards-the one shown does not.
Response: When the addressing plan was prepared for Filing 1, Mr.Perez of Building and Zoning, the
LaSalle Fire Department,and the Sheriffs' Department insisted that the cul de sacs off of the North-
South collector roads have the same name as the collector road with a number after it.
a. They did not want numerous different names for cul de sacs.
b. The address numbers would continue around the cul de sacs.
c. The street signs at each curl de sac would contain all of the addresses on that col de sac.
d. We assumed the county would provide the numbers as it did for Filing 1,and that we would onh
be responsible for the names.
17. The applicant needs to show school bus service plans and a general pedestrian circulation plan
Response: For Filing 1,the School District will only have one pick up point,which is at the East side
of the Administration building.
a. We were required to extend the vehicle access around the south end of the building so the school
bus would not have to turn around.
b. There is covered shelter at the pick up point.
c. During cold weather, children can go into the heated mail room at the pick up point.
d. High school students do not get bus service.
e. This is all the School District has planned as of this time.
As to the general overall pedestrian circulation plan, the lot sizes combined with the rural nature of the

18. The amenities plan is not carried out through all of the sheets, and there is not a vicinity map,
therefore one has a difficult time figuring out where she is.
Response: The Amenity Plan relates only to Outlot A of Filing No. 1,except for the designated horse
trails. The three sheet set inchided with this submittal includes a large scale drawing of both the Outlot
A amenities,as well as the configuration of the required horse trails. A vicinity map was and is
included on all drawings.

I. Stables will be built in phases as demand from property owners dictates.

B. Equestrian Manager(s)
1. The Equestrian Manager(s)position should be considered an on call 24 hours per thy job

4. The Equestrian Manager will have the option to offer training to people who are not property

7. Safety rules will be distributed to horse owners and will be strictly enforced.
8. Trails will be used at the owner's risk,but the Metropolitan District will carry appropriate

20. The applicant did address the conversion of gas roads to other uses we need some follow up on di.,
as the plat delineates these and then changes them.
Response: The Plat itself does not address these roads,as they are not contained in any sort of public
right-of-way or easement. The oil and gas road conversions are within the public open space Tracts
and will be made as shown on the Amenity Plan for Horse Trails and Oil/Gas Road Conversion.
21. The filings need to he identified on a large sheet to show the proposal of the filings and their
relationship to each other.
Response: Twenty copies of the overall Master Plan were previously submitted. This plan is again
being submitted,and clearly shows these relationships.
22. The landscaping plan needs to he modified to shoe the size, type, common name, botanical name. end
usage for the proposed landscaping treatment.

Dear Mr. Fell:
Horizon Construction Services, L.L.C. (Horizon), is pleased to submit this proposal to
provide Beebe Draw Farms Metropolitan District,with a Geoteehnical Investigation for
Beebe Draw Farms and Equestrian Center, Filing 2. This proposal is baged on the 536
residential lots as found in the preliminary drawings provided by Landmark Engineering.
We have taken into account your concerns for ensuring a sufficient testing density is
provided in this study. This investigation will provide one boring for approximately
every four lots. The individual lot builders can have an open excavatiopection
performed to ensure that the soils found during our investigation are similar to soils found
on their individual lots. We can also perform a field survey of the bore4les as needed.
The costs for providing borehole locations for geoterhniral and percolation test hole
locations are listed below.
Horizon shall perform consolidation, unconfined compressive strength and swell tests on
selected boring samples to establish swell potential, soil strength and consolidation
properties, when possible. We shall also perform Atterberg limits with al percent passim
# 200 sieve analysis on plastic materials or sieve analyses on selected non-plastic
samples. Moisture contents and natural density values will be recorded for material from
each borehole and we shall have select samples evaluated for pH and conductivity.
Recommendations for bearing capacity,remedial actions to take for swell potential or
other adverse conditions shall also be addressed.
We shall also perform preliminary percolation tests near selected geotreimical
investigation boring locations, as discussed previously.

N The scope of this analysis was to determine the most l Lkely
route a given resident would use to access the county road system
that is adjacent to Beebe Draw Farms. The county road system
consists of WCR39, WCR32, and WCR38. The current site plan for Beebe
Draw Farms shows one access to each of these county roads. Figure
1 shows the current site plan for Beebe Draw Farms. The analysis
involved estimating the travel time from each dwelling unit lot to
get to WCR39. It is assumed that all external trips to/from Beebe
Draw Farms will distribute from WCR39. The number of lots was
progressively accumulated along the routes to get to one of the three
accesses available. This analysis indicated the following:

rate per unit as the average indicated in Trip Generation, 6th Edition,
ITE. The logic of this conclusion was that a resident would plan trips to
places like the grocery store, etc to correspond with work trips or other
trips for other purposes . There would be very few "spur of the moment"
trips due to the distance and time commitment involved. The average daily
trip rate for a single family dwelling unit from the cited reference is
9. 57 trip ends per day. The range of trip generation data points is 4.31-
21. 85 trip ends per day. While 4 .31 trip ends per day seemed to be too
low, averaging the 4. 31 and 9.57 seemed to be a reasonable method of
determining a daily trip rate for a development such as Beebe Draw Farms.
This results in a rate of 6.94 trip ends per day.
This trip rate was applied to the dwelling unit lot analysis, above,
with the following results:
Beebe Draw Farm Parkway will exceed 1000 vehicles per day (vpd)
from Milton Lake Road to WCR39. It is recommended that it be
classified as an arterial street for its entire length.
None of the streets intersecting Beebe Draw Farm Parkway will
exceed 500 vpd at the highest count location, lit is
recommended that these streets be classified as local streets.
Fairbanks Road North will exceed 500 vpd between Lexington Road
and WCR38. Since it will have less than 1000 vpd, it should be
classified as a collector street in this segment. Fairbanks
Road North should be classified as a local street west of
Lexington Road.
Pelican Lake Road will exceed 1000 vpd between Ledyard Road and
WCR32. According to Weld County criteria, this segment :hould
be classified as an arterial street. The other legs at the
Pelican Lake Road/Ledyard Road intersection should be
classified as local streets.
It is concluded that, except for Beebe Draw Farm Parkway and a short
segment of Fairbanks Road North and Pelican Lake Road, all other streets
within Beebe Draw Farms should be classified as local streets. Local
streets can have more than six accesses per mile.

DETAILED DESCRIPTION OF AUTHORIZE!)WORK
In accordance with the terms and conditions of this Department of the Army permit, Beebe Draw Fat ms
Metropolitan District, is granted authorization by the Secretary of the Army to impact 5.4 acres of waters of
the United States in conjunction with the construction of the Milton Reservoir Marina.
This project is located in Section 10,Township 3 North, Range 65 West, Weld County, Colorado
Beebe Draw Farms Metropolitan District (BDFMD) will construct a marina as a component of the Beebe
Draw Farms Residential Development and Equestrian Center. Construction of the marina will occur at an
inlet on the northwest side of the reservoir requiring approximately 70,657 cubic yards (cy) of dredge
material to be removed from the reservoir. The dredge material will be placed on a near upland location.
49,000 CY of additional material will he moved from the south peninsula into the original existing inlet
within the ordinary high water line. The bulkhead will be constructed of metal sheet piling.
The proposed marina will include a boat launch area paved with asphalt with a concrete ramp, a. floating
dock along the north and south shores of the marina, and a bulkhead at the west-end of the manna. Hie
boat ramp will be 70 feet long and 30 feet wide. The structure will he up to 15 feet tall and be keyed into
the reservoir bottom and secured to the shore with tie roads and deadmen. About 1-2 feet of the bulkhead
will be exposed shoreward. Wood decking will he used for the 10 foot wide floating dock (Exhibits 2 & 4).
The peninsula area south of the proposed marina will be graded into the existing inlet as indicated in
Exhibit 1. The wetlands identified on the south peninsula will remain undisturbed. The manna may be
enlarged provided that such enlargement shall not encroach further on the riparian corridor. 'there shall be
no surface water connection directly between the boat harbor and the riparian corridor. Structures and other
development associated with the boat harbor will be limited to the harbor shoreline and shall not he
constructed in or encroach on the riparian corridor or buffer and setback zones, except as authorized herein.
The beach and recreation area will he developed on the Section 10 peninsula. Parking for the harbor, beach
and recreation areas will be limited to the northwest side of the boat harbor and will be located at least 300
feet from the riparian corridor. The District shall not permit fueling concessions or operations on the
reservoir or at the boat harbor.
Construction and operation of the marina could have an impact on the bald eagle and its habitat and other
wildlife species and their habitat. Many conservation recommendations as stated in the Biologicals Opinion
and Memorandum of Agreement have been written and by all involved parties. Therefor, these documents
are made part of this permit.
Approximately 76 acres of wetlands exist on the property that will not be impacted. However,
approximately 5.4 acres of waters of the United States will be impacted through the dredging requirement
for constructing the marina. The Beebe Draw Farms Metropolitan District agreed to the conservation
measures outlined in the Biological Opinion, Final planning aide memorandum and MOA to lessen the
potential impacts of the development on the wildlife and fisheries that use Milton Reservoir.

Mitigation efforts will ensure compliance with the measures discussed under the endangered vpeeie.‘ act
and planting 30 cottonwood trees along 600 consecutive feet of shoreline south of the marina. The planting
of the cottonwood trees will help mitigate scattered cottonwoods that will be removed during marina
construction. BDFMD agreed to several environmental commitments that include: 1) No development of
• and restricted access to the high quality habitat around the peninsula in Section 15. 2) Creations a combined
300-foot buffer and setback zone between proposed developed areas and Milton Reservoir and Platte Valley
Canal. 3) Restrictions of the use of off-road motorized vehicles. 4) Controls for pets and horses. the
applicant will take every precaution to ensure that the planning aid memorandum (as agreed among all
parties), biological opinion, and Memorandum of Agreement executed February 25, 1997, and agreed to
will be up-held.
'the public review period revealed that 0.08 acre of water smartweed (wetland) will be impacted during the
construction of the marina. Therefor, a minimum of 0.1 acre of water smartweed wetland mitigation will
be performed in the small cove south of the mouth of the marina cove. 'Ellis cove will he excavated to depth
that will permanently ensure the hydrology for the existence of smartweed.

GENERAL CONDITIONS, CONTINUED
7. That all construction debris will he disposed of on land in such a manner that it cannot enter a
• waterway or wetland.Nor will it be left within the project site as litter.
8. That equipment for handling and conveying materials during construction shall he operated to prevent
dumping or spilling the material into the water and wetlands except as approved herein.
9. That measures will be employed to prevent or control spilled petroleum products, chemicals, or other
deleterious materials from entering the water and the permittee will formulate a contingency plan to be
effective in the event of a spill.
10. That fuel storage tanks above ground shall be diked or curbed or other suitable means provided to
prevent the spread of liquids in case of leakage in the tanks or piping.
11. That the clearing of vegetation will he limited to that which is absolutely necessary' for construction of
the project.
12. That when the District Engineer has been notified that a filling actis ity is adversely affecting 11sh or
wildlife resources or the harvest thereof and the District Engineer subsequently directs remedial
measures, the permittee will comply with such directions as may he received to suspend or rr uddj the
activity to the extent necessary to mitigate or eliminate the adverse effect as required.
13. That all dredged or excavated materials, with the exception of that authorized herein, will he placed on
an upland site above the ordinary high water line in a confined area,not classified as a wetland, to
prevent the return of such materials to the waterway
14. That all earthwork operations on shore will be carried out in such a manner that sediment runoff and
soil erosion to the water and wetlands arc controlled.
15. That all areas along the banks of the reservoir disturbed or newly created by the activity will be seeded
with vegetation indigenous to the area for protection against subsequent erosion.
16. That the fill created by the discharge will he properly maintained to prevent erosion and other non-
point source of pollution.
17. That the disposal area,method of disposal,or methods of dredging will not be changed without prior
written approval of the District Engineer.
18. That the discharge will consist of suitable material free from any and all toxic Pollutants.
19. That all equipment used on this project site will be inspected for any all petroleum leaks
(gasoline,oil, diesel fuel, hydraulic fluid,ant-freeze, and etc.) These leaks will be properly
repaired prior to the equipment being allowed on work site.

FOR PARTIES ISSUED A DEPARTMENT OF THE ARMY INDIVIDUAL PERMIT
You are hereby advised that the following options are available to you in your evaluation of the
enclosed permit:
1) You may sign the permit, and return it to the district engineer for final
authorization. Your signature on the permit means that you accept the permit in its entirety,
and waive all rights to appeal the permit, or its terms and conditions.
2) You may decline to sign the permit because you object to certain terms and
conditions therein, and you may request that the permit be modified accordingly. You must
outline your objections to the terms and conditions of the permit in a letter to the district
engineer. Your objections must be received by the district engineer within 60 days of the date
of this NAO, or you will forfeit your right to request changes to the terms and conditions of
the permit. Upon receipt of your letter, the district engineer will evaluate your objections, and
may: (a) modify the permit to address all of your concerns, or (b) modify the permit to
address some of your objections, or (c) not modify the permit, having determined that the
permit should be issued as previously written. In any of these three cases, the district engineer
will send you a final permit for your reconsideration, as well a notification of appeal (NAP)
form and a request for appeal (REA) form. Should you decline the final proffered permit, you
can appeal the declined permit under the Corps of Engineers Administrative Appeal Process by
submitting the completed RFA form to the division engineer. The RFA must be received by
the division engineer withi❑ 60 days of the date of the NAP that was transmitted with the
second proffered permit.
SPECIAL CONDITIONS
• A.That covenants and District Regulations will prohibit use of the reservoir shoreline except at the
swimming beach and permitted recreation facilities.
B.That 0.08 acres of impacted smartwced wetlands will be mitigated on site in the small cove near the
mouth of the marina cove. A minimum of 0.I acre will be mitigated on site by excavating the small cove m
such a way as to ensure permanent water inundation for the sustainability of smartwced.
C.That 30 cotton seed producing cottonwood trees with a height of 3-6 feet will be planted along 601' feet
of shoreline south of the marina. For this condition to be considered successful the survival ratio for the
planted trees must be a minimum of 85%.
D. That construction work on this project will be conducted between August 15 and March I of eaeli year
to prevent disturbance at the nearby great blue heron rookery during the breeding season.
E. That the terms and conditions, which all parties agreed to, of the final planning aid memorandum,
biological opinion, and MOA will be strictly adhered to..
F. In efforts to protect the existing Riparian and Backwater Corridor along the Platte Valley Canal, the
Heron Rookery and other wildlife from human activity, an undeveloped zone will be protected from human
activity through covenant restrictions. The 200 foot buffer and 100 foot setback will serve as natural
barriers between any and all construction and human activity within the boundaries of this project and
Riparian Corridor along the Platte Valley Canal. The buffer and setback will extend from the inlet upstream
to the crossing of Beebe Draw Farms Parkway approximately 0.75 miles from the inlet. The butler and
setback include the construction of roads and other development features on both sides of the Platte Valle)
Canal and will be signed along its outer perimeters advising people that the area behind the signs is a
wildlife protection area and that human and pet activity within that area is restricted.
G. That buoys placed every 50 feet apart to clearly indicate that access from the reservoir to the southern
peninsula is prohibited. These buoys will be installed to ensure the protection of the existing bald eagle
nest, its occupants, and other wildlife using the peninsula. These buoys will say"wildlife protection area
access prohibited' "Keep Out". The buoys will be maintained in good condition at all times to include the
message contained on them.

2. Use and Maintenance of Canal and Deeded Parcel .
• A. FRICO shall have the exclusive right to use the
Canal for the transportation of irrigation waters over and across
the present location of the Canal subject to its obligation CO
preserve and maintain the right of way in a manner consistent with
good ditch maintenance practices . The right of way shall be
maintained in its present location as surveyed .
B. If any of the property described in Exhibit "B" is
platted and developed for residential use _adjacent to the Canal ,
LAND CO. shall cause a deed restriction or protective covenant __ to
be recorded in the records of Weld County, Colorado , prohibiting
the construction of improvements within 50 feet of the outer
boundaries of the right of way and the parcel described in Exhibit.

reasonably be required to provide for the unrestricted flow of
water in the Canal, and the prevention or correction of erosion of

crossing structure . Prior to commencement of construction of the

G. FRICO hereby grants LAND CO. the right to clean an(

Ditch . Although LAND CO. shall not be obligated to maintain the

At such time as FRICO shall desire the remove weedh

GEOLOGIC INVESTIGATION
SCOPE
This report presents the results of a geologic evaluation prepared
for a portion of the proposed Beebe Draw Farms Development includinu
the first filing residential area , and the equestrian center Ioczc ed
adjacent to the north side of Milton Reservoir and west af MD on
Reservoir, southeast of Gilcrest, Colorado. The scope of the proict
included identification of the Geologic characteristics of the site and an
evaluation the effects of these characteristics on the planning nd
development of the property.
SITE EXPLORATION
The field exploration, carried out on May 23, 1985, consisted ';f a
visual reconnaissance of the site by an engineering geologist of Eml•ire
Laboratories, Inc. The field exploration was augmented by
interpretation of topographic maps , study of geologic literature, and )ur
general knowledge of the geology in the area. In addition , sev ,!ral
geologic and subsurface investigation reports including A Report c A
Soil Percolation Test prepared by Empire Laboratories, Irc. , July 9 ,
18L , were prepared for portions of the site. This data was iIso
reviewed. USDA Soil Conservation Service maps have been. prepared by
others. The soils map is part of the geologic map prepared for the site
and is included in Appendix A.
SITE LOCATION AND DESCRIPTION
The proposed site is located east of County Road 39 and south of
County Road 38 southeast of Gilcrest, Colorado. More particularly , the
site under investigation is described as Beebe Draw Farms, First Filing
and Equestrian Center , a tract of land situate in portions of Sections 3 ,
4 , 8 , 9 , and 10 , Township 3 North , Range 65 West of the Sixth
Weld County , Colorado.
The property consists of an existing cattle ranch located north nd
west of Milton Reservoir. The topography of the property is gently
rolling. The site contains many small depressions typical of eolian or
wind-blown deposit areas. Numerous oil and gas wells are loco _ed
throughout the site and dirt and gravel roads that connect to these oil
wells are located throughout the project area. The equest-ion area is
planned in the northeastern portion of the site. A small reviewing tower
has been built near the center of the equestrian site in the eas' ern
portion of the project area. Several small lakes are located in the
southeast corner of the equestrian center site adjacen.. to Miton
Reservoir and the Milton Reservoir Dam which are located ad acent to the
southeast corner of this portion of the property. The sout`aern poi- ion
of the equestrian center extends to the shoreline of the MI ton
Reservoir, and Beebe Draw forms the west edge the equestrian 3t ea.
The Draw contains moderate to steep eroded slopes and is vegetated •vith
brush and trees. The Evans No. 2 Ditch traverses the area of the
equestrian center site. The western portion of the site in the area of
the proposed first filing consists of rolling hills , vegetated with gr rss,
weeds, and sage as does the majority of equestrian site area. The
property is bordered on the west by Weld County Road 39 .
RECOMMENDATIONS AND DISCUSSION
It is our understanding that the site is to be developed as both an
equestrian center and a residential area. The equestrian center will
have several cross-country and jumping courses , parking Ireas , in ioor
and outdoor arenas, and other associated structures. The residential
area will consist of single-family residential lots served by a • ater-
district and on-site sewage disposal systems. A road will connect the
first filing to the eauestrian area site, and a bridge is planned across
Beebe Draw.
Geology
The proposed development under study is located within the
Colorado Piedmont section of the Great Plains physiographic provir:ce.
The Colorado Piedmont, formed during Late Tertiary and E: ir!y
Quaternary time (approximately sixty-five million (65,00(1 ,000) years
ago) , is a broad , erosional trench which separates the Southern Rl cky
Mountains from the High Plains. Structurally, the proper,y b nq
studied lies along the western flank of the Denver Basin. During the
Late Mesozoic and Early Cenozoic Periods (approximately seventy m; lion
(70 ,000,000) years ago) , intense tectonic activity occurred , causinc the
uplifting of the Front Range and the associated downwarping at the
Denver Basin to the east. Relatively fiat uplands and r road va, evs
characterize the present-day topography of the Colorado Piedmont in this
region. The site is underlain by the upper Cretaceous La- 3rrie
formation. In the majority of the site the bedrock is overlain by ec. ian ,
dune, deposites of Pleistocene age. Minor amounts of aulluvial s Inds
and gravels of Pre-Bull Lake Age are encountered in the Beebe "r:,w
area.
Bedrock outescrops were not noted in the site nor were they
encountered in borings drilled by Empire Laboratories , Inc.. , or
CTL/Thompson, Inc. to depths of forty (40) feet. However, bedrock
was encountered in the deep borings drilled at the site at depths of
sixty-seven (67) to one hundred twenty-three (123) feet below the
surface. The regional dip of the bedrock in the area is slight an
easterly direction. Therefore, from a structural standpoint the pros erty
should be relatively stable. To our knowledge, there are no as :tive
known faults in the area; however, epicenters have been io.:ated
northeast and southwest of the project area. It is felt that the area may
be located in a slightly seismic active area and this should be take n in
account in designing structures built at the site. The majority c the
property lies within the drainage area of Beebe Draw. Flood r lain
studies have been done by others to determine areas subject to flood ng.
In addition, some flood control dikes have been constructed and
• additional dikes are planned to minimize flooding caused b': runoff and
excessive filling of Milton Reservoir adjacent to the property. i is
recommended that construction not be allowed within the one-hunr red
year flood plain or be elevated above the one hundred year flood c lain
of Beebe Draw. Construction also should not be allowed in over `low
areas of Milton Reservoir.
The majority of the soils encountered both visually and in the
reports provided to us prepared for the site indicate the soils nverl""ing
the site consist of silty and/or clay sands. These mate'-ials may be
subject to erosion. Therefore, all areas stripped of vegetation du -inq
construction should be reseeded to minimize erosion. With proper site
grading around all structures and proposed roadways and with pryer
revegetation erosion , problems should be minimized at the site. Due to
the generally gentle sloping nature of the topography at the site, - lass
movement due to gravity such as land slides , mud flows, etc . , shoulc he
minimal. To help minimize movement and erosion, all cut and fill sliipes
should be placed on minimum grades of 2 :1 or flatter. Groundwater
levels in the area are expected to be at shallow depths adjacent to the
depressions and ponds located adjacent to Milton Reservoir and P_.eebe
Draw in the southeast portion of the area. It is anticipated that
groundwater levels will be encountered at deeper depths throughou° the
majority of the site away from the Beebe Draw and Milton Reservoir
area. Due to the sandy nature of the soils encountered , i is
anticipated that conventional-type spread footings will be feasible for the
proposed construction. Percolation tests run in selected areas throug lout
the project area indicate that soil percolation rates are either suitably or
too rapid in accordance with Weld County Regulations. I t is
recommended that in areas where percolation rates are too rapid that the
subsoils in the area of the proposed soil absorption beds be mixed pith
silty or clay material to reduce percolation rates to acceptable rates .
Studies of economic deposits of coal and sand gravel at the site
have been prepared by others. These studies indicate that the site ices
not appear to be suitable for economic extraction of coal and sand a ld
gravel. In addition, the geologic conditions of the site are such , in ur
opinion, that the site is also not suitable as an economic source of
quarry rock or limestone. Also, it does not appear that the bedrock
formations in the area contain uranium or other radioactive minerals; .3-id
therefore, in our opinion , the site should not be subjected to radioaci ve
hazards as well.
GENERAL COMMENTS
It should be noted that the geologic investigation was based or a
visual inspection of the site, interpretation of topographic maps ,
review of existing dates and literature, and a general knowledge of he
geology of the area. It is recommended that additional test Jorings n i
percolation tests be made at The site prior to construction. Sara les
obtained from the borings should be tested in the laboratory to evalr, ate
the physical properties and bearing capacities of the soils encountered .
