RESOLUTION RE: APPROVE MINOR RESUBDIVISION, S #526 - LIFESTYLE HOMES, INC. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 17th day of April, 2000, at the hour of 9:00 a.m. in the Chambers of the Board for the purpose of hearing the application of Lifestyle Homes, Inc.,for a Minor Resubdivision, S#526, on the following described real estate, to-wit: Lot 3, Block 1, West Hill-N-Park Subdivision, Fourth Filing; located in the SW1/4 of Section 26, Township 5 North, Range 66 West of the 6th P.M., Weld County, Colorado WHEREAS, Section 8.2.6 of the Weld County Subdivision Ordinance provides standards for review of said Minor Resubdivision, S #526, and WHEREAS,the Board of County Commissioners heard all of the testimony and statements of those present,studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 8.2.5 of the Weld County Subdivision Ordinance. 2. The request is in conformance with Section 8.2 of the Subdivision Ordinance, as follows: a. Section 8.2.1 - The applicant is requesting to vacate a 3-foot portion of an existing drainage and utility easement (not a right-of-way). The applicant has received an approval for easement encroachment by the utility companies and the Utilities Coordinating Advisory Committee approved the request at its March 9, 2000, meeting. b. Section 8.2.2 - Seventy percent (70%) have signed a petition to waive any objection to this application. c. Section 8.2.3 - The vacation is consistent with the surrounding area and uses (in an existing residential subdivision) and is consistent with the Weld County Comprehensive Plan. Goal R.2 states,"Ensure that adequate public services and facilities are available to serve the residential development or district." This would require an additional 8 feet of easement to be located on the adjacent property to the east (Lot 4). There is an existing residence on this property located 14.48 feet from the property line. There is an existing 20-foot easement along the rear property line of Lot 3. A 20-foot easement could be required to remain consistent with Weld County Subdivision regulations but is not necessary given the fact that all utility companies involved have indicated that they have sufficient room in the easement as proposed. Seventy (70%) have signed a petition to waive any objection to this application. 8.2.3 - The vacation shall only be permitted when it is compatible with the surrounding area and uses, is consistent with efficient and orderly development, is consistent with the Weld County Comprehensive Plan, and does not deprive any parcel of adequate access to a public road or street right-of-way. The vacation is consistent with the surrounding area and uses (in an existing residential subdivision), is consistent with the Weld County 2000-0883 Comprehensive plan. Special guying easements at corners may be required. Public utility installations shall be located to permit multiple installations within the easements to avoid cross connections, minimize trenching, and adequately separate incompatible systems. 10.7 Sanitary Sewage Disposal Requirements 10.7.1 The proposed subdivision shall comply with the sanitary sewage disposal requirements of the underlying zone district. Plans for the proposed subdivision shall be referred to the Weld County Health Department for review. The Health Department may require the applicant to submit additional engineering or geological reports or data and to conduct a study of the economic feasibility of the sewage treatment work prior to making a recommendation. No sewage disposal system plan shall receive the approval of the Board unless the Health Department has made a favorable recommendation. Appeal of an unfavorable Health Department recommendation shall be in accordance with the procedures set out in Section 3.11 of the Weld County Individual Sewage Disposal Regulations. 10.8 Water Supply -- Water supply systems shall be provided consistent with the standards of the • requirements of this Ordinance and the underlying zone district. 10.8.1 Public Water Supply Systems 10.8.1.1 Where a central water supply system is provided through a municipality. a water district, water company or association, the applicant must furnish evidence of an adequate water supply and ability to serve the subdivision. Chris stated that Lifestyle Homes is requesting a change in the 15' utility easement to 12' along the east side of Lot 3, Block 1 of West Hill 'N' Park 4th Filing. Chris stated that the house is constructed into 2' of the easement. The applicant has submitted a petition signed by the surrounding property owners, as well as a petition signed by all the utility companies that use the easement. These petitions show support for the vacation of part of the easement. The Utility Board discussed the case and looked at the plat. Cody Wooldridge moved to vacate the 3' of easement along the east side of Lot 3, Block 1, Hill 'N' Park 4th Filing as all the affected utility companies have signed off their agreement with the vacation. Monica stated the history of the case as well as why it is being brought to the Utility Board at the final plat stage, rather than the zone change stage. Discussion ensued concerning the easements along the county roads, the use of environmental easements in conjuntion with utility easements, and utility easements along the open tracts (open spaces). The basic utility easement for the entire subdivision is 25'. The Utility Board discussed that all utility easements shall continue at this same width. The easements need to be added on several areas of the plat. These are listed in the next few sentences. First, all interior roadways, including lots, tracts, and open space areas must have a 25' utility easement. Next, all county roads shall have a 25' utility easement associated with their row. Third, a 25' utility easement must be placed along entire perimeter of the filing. Finally, there needs to be a 25' utility easement between filing one and filing two. Also requested by the committee, the applicant shall modify the plat to show utility easements located in the tract areas (this is intended for utility placement to transcend through the large open space areas). On the final plat, the Utility Board requested the addition of the following in the notes on the plat: 1. 25' utility easements and placements shall be identified in the buffer/building setback area and 2. Existing note on page 3 of the utility plan shall include all of the areas identified as well as the additional utility easement areas requested by the utility board. A plot plan was produced of Lot 3, Block 1 showing a 10' easement. We applied for a permit, permit #BC9800504, showing a 10' utility & drainage easement that was on the eastern side of the lot. When we received the permit from the building department, we proceeded to build the house, passed all inspections and received a Certificate of Occupancy following final inspection. The 15' utility and drainage easement was not discovered until an Improvement Location Survey was done two weeks prior to closing. We proceeded through the minor resubdivision application process and received signatures from the surrounding property owners and all necessary utility companies.
