FREDERICK WATTENBERG, et al., Defendants. ORDER THIS MATTER is before the Court on Plaintiffs Motion to Join Parties and Amend Complaint filed May 5, 1999. Where a party has moved to amend, unless there is undue delay, bad faith, dilatory motive on the part of the moving party, or a danger of undue prejudice to the non-moving party, leave should be freely given by the Court. Foman v. Davis, 371 U.S. 178, 182 (1962); Frank v. US West. Inc., 3 F.3d 1357 (10th Cir. 1993); Barrett v. Qual-Med. Inc., 153 F.R.D. 653 (D. Colo. 1994). In this case, the Plaintiff seeks to add four additional parties who are heirs of Frederick Wattenberg, who was one of the earliest title owners of the property in dispute. The Plaintiff also desires to designate Public Trustee of Weld County as the successor representative of two dissolved corporations, X 0 Exploration, Inc. and Wattenberg Improvement Association, Inc., who have previously been named in this action. I find that these amendments to the Plaintiffs Complaint are necessary to properly quiet title to the property at issue. Additionally, the responding Defendants have stated that they have a • C 2000-0732 affif �' no objection to the Plaintiffs Motion. Further, there is no evidence of undue delay, bad faith, dilatory motive, or undue prejudice to any of the non-moving parties. Accordingly, it is ORDERED that Plaintiffs Motion to Join Parties and Amend Complaint filed May 5, 1999 is GRANTED. It is FURTHER ORDERED that the attached Amended Complaint shall be filed as of the date of this Order. It is FURTHER ORDERED that for the purposes of the Statute of Limitations and under Federal Rules of Civil Procedure 15(c), the claims set forth in the Amended Complaint shall relate back to the date that the original Complaint was filed.
