RE: ACTION OF BOARD CONCERNING SUBDIVISION EXEMPTION #789 - BOYD
MEYER
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the request for Recorded Exemption #789 was submitted by Boyd Meyer,
5413 E. Harmony Road, Fort Collins, Colorado 80525, for property which is located in part of
the East half of Section 24, Township 6 North, Range 67 West of the 6th P.M., Weld County,
Colorado, and
WHEREAS, after reviewing the Planning staffs concerns and hearing the testimony
presented, the Board determined that said request shall be denied for the following reasons:
1. It is the opinion of the Board of County Commissioners that this proposal evades
the purpose of the Weld County Subdivision Ordinance as defined in Section
1.3.
2. The Board feels this division would be inconsistent with efficient and orderly
development, because the end result would be an island lot having access only
across other properties.
3. The Board feels this proposal is not consistent with the Weld County
Comprehensive Plan.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the request for Subdivision Exemption #789, submitted by Boyd
Meyer be, and hereby is, denied.

The Department of Planning Services'staff has reviewed this request and recommends that this request be denied
for the following reasons:
1. It is the opinion of the Department of Planning Services' staff that the applicant has not shown compliance with
Section 11.4.2.1 through 11.4.2.6 of the Weld County Subdivision Ordinance, as follows
d. Section 11.4.2.4- Consistency with the purpose of efficient and orderly development as expressed in Section
1.3 of the Weld County Subdivision Ordinance.
1) Section 1.3.1 -Assisting orderly and integrated development. The proposed Subdivision Exemption
would create an "island" lot, that is, a lot that has no part of its external boundaries that are adjacent
to a county road or a State Highway. In this particular case, there are two existing homes on the
property. The proposed Subdivision Exemption would divide off two and a half acres of land and one
existing house from the remainder of the farm. The lot would be over fifteen hundred (1,500')feet south
of the nearest road access, State Highway 392.
2) Section 1.3.7 - Safeguarding the interests of the public, the homeowner, and the subdivider.
This application does not take into account the interests of the future owners who will be
responsible for acquiring any utilities that do not currently exist on the site. Additionally, there
are not adequate provisions for the continued maintenance and upkeep of the access road.
Should the Board of County Commissioners approve this request, the Department of Planning Services' staff
recommends the following conditions be attached:.
1. A Weld County Septic Permit is required for the proposed home septic system(s) and shall be installed according to
the Weld County Individual Sewage Disposal Regulations.

2. Prior to recording the plat, the applicant shall:
A. All approved accesses shall be clearly shown on the plat.
B. Access is indicated to the SE Lot from State Hwy 392. Colorado Department of Transportation
(C.D.O.T.) has jurisdiction over all accesses to State Highways. State Hwy. 392 Is designated
on the Transportation Map as a principal arterial road, that requires 150 feet of right-of-way, 75'
from the centerline. The 75 feet of right-of-way shall be delineated on the plat.
C. The applicant shall provide evidence to the Department of Planning Services that an access
permit exists or that access has been granted by C.D.O.T.
D. A 30-foot wide joint access easement extending across Lot A from State Hwy 392, for the benefit
of the SE-789 Lot, shall be clearly shown on the plat. The joint access easement shall be
dedicated for the use as shown utilizing the language set forth in Section 11.7.1.12.5 of the Weld
County Subdivision Ordinance.
E. The applicant shall submit a completed Road Access Information Sheet to the Weld County
Department of Public Works.
F. Submit evidence to the Department of Planning Services that any existing septic system(s)
meets all requirements of the Weld County Health Department. The Environmental Protection
Services Division of the Weld County Health Department was unable to locate a septic permit for
the septic system located at 12,000 Weld County Road 392. Any existing septic
system(s) which is not currently permitted through the Weld County Health Department will
require an I.S.D.S. Evaluation prior to the issuance of the required septic permit(s). In the event
the system(s) is found to be inadequate, the system(s) must be brought into compliance with
current I.S.D.S. regulations.
3. A. The following notes shall be placed on the plat:
(1). All proposed or existing structures will or do meet the minimum setback and offset
requirements for the zone district in which the property is located.
(2). Under the Weld County Subdivision Ordinance, the property is still recognized as one
parcel. No additional building sites are created with this Subdivision Exemption. The lot
created for financing purposes shall not longer exist upon termination of the financing
arrangements.
(3). RE-2578 was approved in conjunction with this subdivision exemption for the purpose of
dividing off a second set of existing improvements from the parcel.
4. Planning Staffs approval of this subdivision exemption is based upon satisfying the above conditions.
Should an applicant be unwilling or unable to meet any one of these conditions, within 60 days of
approval, then this case will be forwarded to the Board of County Commissioners with a
recommendation for denial.

Dear Commissioners:
1. This Subdivision Exemption will create a lot that is considered an "island lot." That is,
the lot does not have a boundary that is contiguous with the nearest county road or, in this
case, State Highway 392.
2. On August 9, 1999, Department of Planning Staff recommended "denial" for a recorded
exemption (RE-2503), for Mr. Ed Orr, on land that is adjacent to the site owned by Mr.
Boyd Meyer. Department of Planning Staff is recommending denial of SE-789 because
of concerns with this application that are similar to those posed by RE-2503.
The Department of Planning Services' staff requests that the Board of County Commissioners
consider the application and determine if the standards of Sections 11.2 through 11.8 of the Weld
County Subdivision Ordinance have been met and adhere to the goals and policies of the Weld
County Comprehensive Plan.

A statement describing the request,the purpose,and benefits of the request.
Our request is for a Subdivision Exemption in Conjunction with a Recorded Exemption. Our
purpose is to remove existing improvements and residence from a large agricultural lot that will remain. A
future residence may be planned by future owners but is not planned at the present time. The agricultural
productivity of the ground will not be affected by the proposed Subdivision Exemption. The SE Lot is
estimated to be approximately 2.5 Acres in size.

REQUIREMENTS:
The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to the State Highways.
Please contact Gloria Hice-Idler or Tess Jones at the Greeley office to verify the access permit or for any additional
requirements that may be needed to obtain or upgrade the permit.
The applicant shall indicate, on the plat, type of right-of-way or easement, dedicated, private, or a deed to provide
adequate access to the parcel. Section line accesses are considered private lanes with no county maintenance.
