The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity
with the laws of the State of Colorado at the regular place of meeting in the Weld County Centennial
Center, Greeley, Colorado, January 12, 2000, at the hour of 9:00 a.m.
ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were
present, constituting a quorum of the members thereof:

MINUTES: Commissioner Hall moved to approve the minutes of the Board of County Commissioners
meeting of January 10, 2000, as printed. Commissioner Vaad seconded the motion, and it carried
unanimously.
ADDITIONS TO AGENDA: There were no additions to the agenda.
CONSENT AGENDA: Commissioner Vaad moved to approve the consent agenda as printed.
Commissioner Geile seconded the motion, and it carried unanimously.
PROCLAMATIONS:
PROCLAMATION FOR CENSUS 2000:Chair Kirkmeyer read said proclamation into the record regarding
Weld County's commitment to conduct an accurate 2000 Census count. Chair Kirkmeyer stated
Commissioner Geile will be appointed to the 2000 Census Committee.
PRESENTATIONS:
RECOGNITION OF SERVICES-DEPARTMENT OF BUILDINGS AND GROUNDS, CHARLES SCHELL:
Chair Kirkmeyer read the certificate into the record recognizing Charles Schell for ten years of service in
the Department of Buildings and Grounds. Pat Persichino, Director of General Services, presented Mr.
Schell with a pin.
COMMISSIONER COORDINATOR REPORTS: There were no Commissioner Coordinator Reports.
PUBLIC INPUT: There was no public input.

WARRANTS: Donald Warden, Director of Finance and Administration, presented the following warrants
for approval by the Board:

Commissioner Hall moved to approve the warrants as presented by Mr. Warden. Commissioner Geile
seconded the motion, which carried unanimously.

Persichino, Director of General Services, presented the five bids received. Said bids will be considered

PRESENT SKID LOADER WITH SMALL BACKHOE BID - DEPARTMENT OF PUBLIC WORKS: Mr.
Persichino presented the seven bids received. Said bids will be considered for approval on January 26,
2000.
PRESENT MID-SIZED, FOUR-WHEEL DRIVE PICKUP BID - DEPARTMENT OF BUILDINGS AND
GROUNDS: Mr. Persichino presented the five bids received. Said bids will be considered for approval
on January 26, 2000.
APPROVE TRAINING CENTER (CONSTRUCTION) BID - FINANCE DEPARTMENT: Mr. Persichino
recommended approval of the second low bid from Growling Bear Company, Inc., and referred to a
memorandum dated January 7, 2000, to explain this recommendation. Sonny Jackson, Sinnett Builders,
Inc., expressed concern with the bid process. He stated Sinnett Builders, Inc., submitted the low bid;
however,the amount was disclosed to a competitor and the second low bid was selected. In response to
Commissioner Geile, Mr. Jackson stated the Purchasing Department required each contractor to submit
a value engineer to attempt to lower the bid amounts. Mr. Persichino stated once the bids are opened,
they become public record and the various qualifications were detailed in the original bid request. Loren
Bley, Bley Associates Architects, stated he was present at the interview of both bidders, and the directions
were clear as to what could be deducted and what had to be left alone. He reviewed the general
conditions for bidding, and stated both contractors were asked to submit the site work amounts and there
was a significant difference in the final amounts. Mr. Bley stated the Board has the right to work with the
bidders to ensure they get the best bid amount. In response to Commissioner Geile, Mr. Bley stated
because the bids were close, it was not inappropriate for the Board to interview both contractors.
Responding to further questions from Commissioner Geile, Mr. Persichino reviewed the last four major
construction bids and stated three were vendors outside of Weld County. Mr.Jackson stated it would have
been better had the low bidder been brought in to redesign or reduce the amount, not start a bidding
competition. Commissioner Vaad commented he agreed with the option to work with both bidders and
added the preference is to select the local bid if within a close enough range. James Woody, Growling
Bear Company, Inc., stated Growling Bear did not participate in bid chopping; however, it did reduce the
bid at the request of the County. He further stated on other occasions Growling Bear has been the low
bidder and due to various circumstances, another bid was selected. Mr. Bley stated all of the bidders for
this project have had prior experience with Weld County. Commissioner Vaad moved to approve the low
bid from Growling Bear in the amount of$754,295.00. Commissioner Hall seconded the motion, which
carried unanimously.
APPROVE BITUMINOUS PAVEMENT HOT/COLD MIX AND ASPHALT BID - PUBLIC WORKS
DEPARTMENT: Mr. Persichino read a memorandum from the Public Works Department,dated January 6,
2000,which recommends approval of the bids from Camas Colorado, Inc., and Western Mobile Northern,
Inc., for various products in northern and southern Weld County. He stated Public Works reserves the
right to use Camas Colorado, the next low bidder, if Western Mobile Northern is periodically unable to
provide asphalt. Mr. Persichino stated these bids are effective for one year. Commissioner Hall moved
to approve the bids as recommended by staff. Seconded by Commissioner Geile, the motion carried
unanimously.
NEW BUSINESS:
CONSIDER CONTRACTAMENDMENT#1 FOR CANCER PREVENTION PROGRAM AND AUTHORIZE
CHAIR TO SIGN: Judy Nero, Weld County Department of Public Health and Environment, stated this
amendment will provide additional funding in the amount of$150 per breast and cervical cancer screening,
per client. She stated the term of this contract is from February 1, 2000, through August 14, 2000.
Commissioner Hall moved to approve said amendment and authorize the Chair to sign. Seconded by
Commissioner Geile, the motion carried unanimously.

CONSIDER TASK ORDER FOR CHLAMYDIA TESTING PROGRAM AND AUTHORIZE CHAIR TO SIGN:
Ms. Nero stated under this task order Weld County will provide Chlamydia tests. For these services, the
Weld County Department of Public Health and Environment will be reimbursed $7.80 per test, not to
exceed $6,481.00, for the term beginning January 1, 2000, and ending December 31, 2000. Ms. Nero
stated this task order amount is an increase of $163.00 over last year. Commissioner Hall moved to
approve said task order and authorize the Chair to sign. Seconded by Commissioner Geile, the motion
carried unanimously.
CONSIDER TASK ORDER FOR HIV COUNSELING AND TESTING PROGRAM AND AUTHORIZE
CHAIR TO SIGN: Ms. Nero state this task order is part of the Five-Year Master Plan. Under this task order
the Weld County Department of Public Health and Environment will be reimbursed$1,887.00 for providing
confidential HIV counseling and testing beginning January 1, 2000, and ending December 31, 2000.
Commissioner Hall moved to approve said task order. The motion,which was seconded by Commissioner
Vaad, carried unanimously.
CONSIDER EIGHTEEN AGREEMENTS FOR SAMPLING AND ANALYSIS OF DRINKING WATER AND
AUTHORIZE CHAIR TO SIGN: Ms. Nero stated these agreements for the sampling and analysis of
drinking water are between the Weld County Department of Public Health and Environment and eighteen
various entities, with terms beginning January 1 or 2, 2000, and ending December 31, 2000. Ms. Nero
stated the terms of said agreements are in accordance with Ordinance#82-U. Commissioner Hall moved
to approve said agreements and authorize the Chair to sign. Seconded by Commissioner Vaad, the
motion carried unanimously.
CONSIDER FOUR AGREEMENTS FOR SAMPLING AND ANALYSIS OF POLLUTANT DISCHARGE:Ms.
Nero stated these four agreements are for the sampling and analysis of pollutant discharge and waste
water. She stated the fees are in accordance with Ordinance #82-U, with terms beginning January 1,
2000, through December31, 2000. Commissioner Hall moved to approve said agreements. The motion,
which was seconded by Commissioner Vaad, carried unanimously.
CONSIDER APPOINTMENT OF ALTERNATE MEMBERS TO JUVENILE COMMUNITY REVIEW BOARD:
Commissioner Geile moved to appoint Patryce Engel, Joyce Hause, Patricia Orleans, Michael Guthrie,
Tracey Frank, Marvin Wade, Paul Cooper, Richard Brady, and Joan Rhoads to the Juvenile Community
Review Board. Bruce Barker, County Attorney, stated the draft resolution needs to be altered to reflect
that these will be alternate members. Commissioner Hall seconded the motion,which carried unanimously.
PLANNING:
CONSIDER RECORDED EXEMPTION#2606- EDWARD AND DEBRA LENERS: Mr. Barker explained
the procedure regarding a hearing with only four members of the Board. Wayne Howard represented the
applicants and stated they would like to proceed today. Kim Ogle, Department of Planning Services,gave
a brief description of the location of the site, as well as a history of how Section 24 has been divided
through various Recorded Exemptions and Subdivision Exemptions since 1992. He stated this is the
second Recorded Exemption request within Section 24 this year and although staff supports this individual
application, subsequent Recorded Exemptions on adjacent properties raise the issue of compliance with
the intent of the Recorded Exemption process. Mr. Ogle stated Department of Planning Services staff
recommends denial because this request does not comply with the Weld County Subdivision Ordinance.
In response to Chair Kirkmeyer, Mr. Ogle reviewed the chronological order of how Section 24 has been
split up to this point.
Mr. Howard stated he informed the applicant that Subdivision Exemption #460 is not a sellable lot, and
added he and the applicant were not adequately advised by the Department of Planning Services staff on
other options for dividing the parcel. Mr. Howard stated when he met with Mr. Ogle and Ben Patton,

Department of Planning Services staff, they advised this specific layout. Mr. Howard explained that Lot
B of Amended Recorded Exemption#1410 is already an approved legal lot,and the applicant is requesting
Subdivision Exemption#460 be converted to a legal lot. In response to Commissioner Geile, Mr. Howard
stated if staff had advised the proposed division prior to approval of Amended Recorded Exemption#1410,
there would not be a problem. In response to Commissioner Hall, Mr. Howard stated Subdivision
Exemption#460 is divided off by an irrigation ditch and is not farmable. He further stated the large parcel
has a pivot sprinkling system and will remain in agricultural use. Mr. Howard further stated approval of this
request will create four legal lots in this Section, which is less than in other areas. He stated this proposal
will not adversely affect Weld County; the current residence on Subdivision Exemption #460 is very
valuable; and the 74-acre parcel will remain in agricultural use. Chair Kirkmeyer stated in 1992 the three-
lot Recorded Exemption was not an option.Mr. Howard stated when he discussed options with Department
of Planning Services staff in July, this option was not discussed, and at this point a three-lot Recorded
Exemption is not possible because Amended Recorded Exemption#1410 has already been approved and
recorded. In response to Commissioner Hall, Mr. Howard stated he has reviewed the Conditions of
Approval and would be willing to establish a building envelope on the large agricultural lot to conserve the
agricultural land.
Edward Leners, applicant, stated he invested $75,000 to level the 74-acre parcel and install a sprinkler
system. He stated he intends for the large parcel to remain as farmland, and added approval of this
request will simply allow him to sell the house or land separately from the other. Mr. Leners stated as the
property is now, he will have to sell the home and farmland together. Chair Kirkmeyer commented the next
owner may not intend to keep the large lot in agricultural use. No public testimony was offered concerning
this matter. Commissioner Hall moved to approve Recorded Exemption #2606 with the Conditions of
Approval as presented by staff. Seconded by Commissioner Vaad,the motion carried unanimously. Chair
Kirkmeyer directed staff to keep the three-lot Recorded Exemption as a option to explain to applicants.
RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the consent
agenda. No Ordinances were approved.
Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted
by the Acting Clerk to the Board.
There being no further business, this meeting was adjourned at 10:05 a.m.
